Resolution 2020-31290 RESOLUTION NO. 2020-31290 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE CHANGE ORDER NO. 1 TO THE CONSTRUCTION CONTRACT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND J.R.T. CONSTRUCTION CO., FOR CONSTRUCTION SERVICES AT MIDDLE BEACH RECREATIONAL CORRIDOR PHASE III PROJECT, TO INCLUDE ADDITIONAL CONSTRUCTION SERVICES ASSOCIATED WITH THE INSTALLATION OF INFRASTRUCTURE FOR SECURITY CAMERAS INCLUDING, BUT NOT LIMITED TO, THE SUPPLY AND INSTALLATION OF HANDHOLES, ELECTRICAL SERVICE PANELS AND CAMERA POLES, RESULTING IN AN INCREASE OF $382,548.15 WHICH INCLUDES AN INCREASE IN THE OWNER'S CONTINGENCY BY THE AMOUNT OF$34,777.10, OR 10%OF THE CHANGE ORDER AMOUNT,INCREASING THE TOTAL VALUE OF THE CONTRACT TO $9,824,349.75, AND FURTHER PROVIDING THE CONTRACTOR A TIME EXTENSION OF SIXTY (60) CALENDAR DAYS TO ACCOMMODATE THE CHANGE IN SCOPE. WHEREAS, on July 31, 2019, the City Commission awarded the contract in the amount of$9,441,801.60 for construction services for the Middle Beach Recreational Corridor Phase III ("Project") to. J.R.T. Construction Co. ("Contractor") pursuant to ITB2019-002-DF, AND Construction began on November 18, 2019 and is scheduled for completion in Spring of 2021; and WHEREAS, this Project consists of the construction of an on-grade ADA compliant pedestrian paver walkway, with bollard lights, landscaping and irrigation, and the path will run north from approximately 24th Street to 46th Street; and WHEREAS, exotic dune vegetation will be removed and replaced with dune enhancements such as native dune vegetation species and beach compatible dune fill will be provided for the landscaping; and WHEREAS, the proposed path lighting will meet Florida Fish and Wildlife Commission's marine turtle nesting requirements; and WHEREAS, in an effort to provide increased security along the beachwalk, and in order to minimize impact to newly installed improvements, the Miami Beach Police Department ("MBPD")has requested construction of the necessary infrastructure which will allow for the future installation of security cameras along the path,and MBPD hired a consultant to design the security camera infrastructure; and WHEREAS, initially the design of the security cameras underground conduits was provided by MBPD; and WHEREAS, City staff requested that the Contractor provide a proposal to supply and install the conduits, and in order to avoid any delays to the MBRC3 project, and incur any additional costs for demolition and restoration during the future security cameras improvements, City staff and the project engineer reviewed the proposal submitted by the contractor in the amount of$143,295.33 and approved the work under the project contingency; and WHEREAS, while the empty conduit was being installed, MBPD was able to finalize the security camera design. J.R.T. Construction Co was then able to provide a proposal, attached as Exhibit A to the Memorandum accompanying this Resolution, for the remaining infrastructure work , including handholes, electrical service panels to supply power for security cameras and camera poles; and WHEREAS,this Change Order No. 1 in the amount of$347,771.05, plus$34,777.10(10% contingency) for a total of $382,548.15, includes the remaining security camera infrastructure; and WHEREAS, the cost was reviewed by the project engineer and MBPD and was found to be fair and reasonable; and WHEREAS, additionally, Change Order No 1. Provides the Contractor a time extension of sixty(60)calendar days to accommodate the change in scope; and WHEREAS,the cost associated with the installation of the infrastructure will utilize current allocated funding for the security camera project, managed by the Miami Beach Police Department; and WHEREAS, the total amount of the contract, including this change order is $9,824,349.75; and WHEREAS, the Administration recommends that the City Commission approve the resolution; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, approving and authorizing the City Manager to negotiate and execute Change Order No. 1 to the construction contract between the City of Miami Beach, Florida and J.R.T. This proposal does not include trench compaction, any conduit and pull string work, the CCTV equipment and cameras, material and installation of any low voltage and/or communications cabling, and restoration of new work performed that may need to be restored as a result of work performed pursuant to this CPR. If not accepted within the stated time frame this proposal will automatically expire. Please proceed immediately and issue a written change order accepting this proposal so that we can proceed with this work. No work will be performed without an official executed change order to our contract. Will you be laying the conduit for the poles which will go at the ends of the streets(25/26/27)now or coming into the handholes at a later time in the project? Just kind of a reminder. First, I am good with the cost proposal(JRT RCO#3R3)for the conduit we had asked for. Unfortunately,we identified an issue while we continue to plan for"the whole" Beachwalk up to 87St.That issue is fiber connectivity, and that there is none available as we continue to plan north of 46St. In order to have fiber for the second half of the CCTV beachwalk projects(46St-87St)we need to plan for it now and bring it along from our Lummus Park and 14P1-24St Beachwalk projects and ultimately through this Middle Beachwalk Project(24St-46St). We have identified a type of Fiber package which will help us complete this goal for our current projects and future. But in order to bring the second leg of the fiber up to 46St,we will be adding a 2"empty conduit throughout all of the project components.This empty 2"conduit can run parallel to the 3"conduit there will be installing.This conduit does not need to stop at all the communication handholes and just need to run from the first handhole to the last in each section of the project so we can tie into it later as we complete the missing sections. For example,the section 24St-29St.There is a communication handhole at the most southern part within the SoW and one on the northern end.The 2" empty conduit needs to run from one to the other,and does not need to stop at any other point so no additional handholes are needed just for this conduit addition. (unless there is some construction reason and it needs to stop at a certain handhole along the way).I hope this explains it properly.So for simple math,JRT can add to the quote an empty 2"conduit for the whole length. Burns and McDonnell has completed the designs outtakes for 30-32St and 36-46St similar to what they did for 24-29St for the contractor. However,they are adding in this extra conduit we identified so the plans match. I want to add this note in now, but it should not affect anything listed above or previously discussed. In the new fiber solution we have identified,the 3" conduit in the communication handholes should not be stubbed up. Instead it comes into the handhole on one side,stops/opens for the handhole space and continues through the other side horizontally. The fiber we will later pull horizontally through the handhole has a pigtail which will stay in the handhole while the cable continues on.We can speak about this at a later time. For now,and to not delay the project, please have JRT add the extra empty 2"conduit into their quote.
