A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, URGING AGAINST THE
INCREASE OF DEVELOPMENT INTENSITIES AND DENSITIES
THROUGH RELAXATION OR MODIFICATION OF THE CITY'S
AND SURROUNDING COMMUNITIES' LAND DEVELOPMENT
REGULATIONS, COMPREHENSIVE PLANS, AND
CONCURRENCY SYSTEMS, AS A RESULT OF ITS
RECOMMENDATION ON RAIL.BASED TRANSPORTATION
SYSTEMS, SO AS TO PROTECT AGAINST
OVERDEVELOPMENT OF THE CITY, AND SURROUNDING
COMMUNITIES THAT MAY IMPACT THE CITY.
WHEREAS, the City Commission has recently adopted, and the Miami-
Dade County Metropolitan Planning Organization is presently considering,
recommendations for a street car transportation system to serve Miami Beach,
and connect Miami Beach to other parts of Miami-Dade County; and
WHEREAS, the Florida Legislature has required each city in Florida to
adopt a concurrency management system, to evaluate all new development and
ensure that necessary infrastructure is timely in place to serve such
development; and
WHEREAS, the availability of mass transit is taken into consideration in
evaluating the impact of new development on the transportation network system,
and in calculating the mitigation fees such development must contribute to
ensure the ability of such system to support such development; and
WHEREAS, it is the opinion of the Mayor and City Commission that the
street car transportation system, while desirable from the point of view of
increased mobility and alleviating congestion, should not be used as justification
for relaxing development regulations and allowing such increased new
development that the City, and surrounding communities that may impact the
City, become overdeveloped; and
WHEREAS, it is the opinion of the Mayor and City Commission that
because the concurrency system already accounts for the availability of mass
transit, and provides a credit for mass transit to the amount of mitigation fees a
new development project must pay in order to obtain a building permit, such
concurrency system should not be modified to further encourage new
development to the extent that the City becomes overdeveloped.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND
CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the
Mayor and City Commission urge such persons and boards considering changes
to the City's and surrounding communities' land development regulations,
comprehensive plans, and concurrency management systems not use the City's
recommendation of the street car system to the Metropolitan Planning
Organization, or the adoption of any street car or rail-based transportation
system, as justification for relaxing such development regulations,
comprehensive plans, or concurrency management systems, to allow the City,
and surrounding communities that may impact the City, to become
overdeveloped.
