NO. 56-1999 LETTER TO COMMISSION March 4, 1999 TO: Mayor and Members of the City Commission ~ FROM: Sergio Rodriguez, City Manager SUBJECT: Loews Hotel Out Parcel Development Pursuant to an inquiry raised by the Chairman and Members of the Miami Beach Redevelopment Agency at the City CommissionlRedevelopment Agency meeting on March 3, 1999, the following report has been prepared concerning the "out-parcel" development of the Loews project. The original plans for the Loews calls for the development of a free-standing restaurant facility on the southwest comer of the project site, next to the St. Moritz Hotel, referred to as the "out-parcel". A copy of the original site plan and a conceptual rendering reflecting the location of the facility are included with this L.T.C. While Loews included plans for the restaurant facility in the master permit drawings, the original building permit that was issued did not include this component of the project. In order to preserve its rights under the original joint Design Review/Historic Preservation Board (Joint Board) development approval, Loews has until the issuance of the last Certificate of Occupancy for the hotel portion of the project to obtain a building permit for the out parcel development. In the event Loews does not pull a building permit, Loews would have to go back to the Joint Board for approval of the out parcel as a separate new application. Since the out parcel falls on the portion of the site zoned MXE, the FAR falls well below 3.5, allowing the applicant to proceed with a new application if the situation arises. Since Loews is currently contemplating the use of the facility for a purpose other than a re5taurant as originally planned, any significant change in use or design of the structure may require an amendment to the existing development order by the Joint Board. Among the uses being considered are meeting and banquet space or a spa facility. If the use does not vary significantly from the intended use, as in the case of meeting/banquet space, an amendment will most likely not be required. The Planning Department has requested correspondence from Loews once options have been narrowed down. On a related issue, the Hotel Status Report provided at the March 3, 1999 Commission Meeting, reflected that Loews had lost its appeal to not have to pay road impact fees on the out-parcel development, and that the fees were subsequently paid to the County as a prerequisite to pulling the building permit.
