Resolution 2020-31487 RESOLUTION NO. 2020-31487 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE ART IN PUBLIC PLACES COMMITTEE AND APPROVING THE 500 ALTON ROAD PUBLIC ART COMMISSION BY MIAMI BASED ARTIST MARK HANDFORTH; TO BE FUNDED THROUGH THE ESCROW AGREEMENT BETWEEN TCH 500 ALTON, LLC AND THE CITY OF MIAMI BEACH IN THE AMOUNT OF $95,812.00, THUS SATISFYING THE REQUIREMENTS OF THE ART IN PUBLIC PLACES ORDINANCE. WHEREAS, in 1995, the Mayor and City Commission adopted Ordinance No. 95-2985, also known as the Art in Public Places ("AiPP") Ordinance, to "enhance the aesthetic environment of the City of Miami Beach by including works of art on public property within the City and in City construction projects"; and WHEREAS, the goals of the AiPP program are: overseeing the City's public art collection; enhancing the physical environment of Miami Beach with artworks of the highest level of quality and suitability for the site; serving as the coordinating body for all public art projects on City property; building partnerships with the private sector, non- profit and community groups that connect the AiPP projects to the life of the City; encouraging participation by artists based locally, nationally and internationally; and serving as a source of information about public art; and WHEREAS, on September 11 , 2019, the Mayor and City Commission adopted Ordinance No. 2019-4296, amending the Art in Public Places Ordinance to increase the amount to be appropriated to the Art in Public Places fund from not less than 1 .5%, to not less than 2% of the construction cost of city construction projects and joint public /private developments; to decrease the dollar threshold of city construction projects from $500,000 to $250,000 for projects subject to the provisions of Art in Public Places; amend the definition of City construction projects; amend applicable projects to include management agreements for a City-owned buildings or facilities having a term of ten (10) years or more; and amend consideration of a waiver of the required AiPP appropriation to require a resolution approved by 5/7th vote of the City Commission; and WHEREAS, currently, the AiPP program is funded by 2% of all "hard costs" of City capital construction projects, including new construction, additions, and costs for construction of joint private/public projects; and WHEREAS, pursuant to Section 82-562 of the AiPP ordinance, entitled "Powers and Duties" of the Art in Public Places Committee, the AiPP Committee shall recommend to the City Commission whether a particular proposed city construction project is an appropriate site for works of art and whether all or a part of the appropriation required by Section 82-587 should be utilized at the site or, reduced or waived in its entirety or, placed, whether in its entirety or a portion thereof, in the art in public places fund for other acceptable uses; and WHEREAS, the AiPP Committee shall also recommend to the City Commission the selection of existing work of art or determine whether to recommend the selection of new works of art, and screen submissions therefore; and WHEREAS, on December 12, 2018, the City of Miami Beach entered into an agreement with South Beach Heights I, LLC, 500 Alton Road Ventures, LLC, 1220 Sixth, LLC, and KGM Equities, LLC (collectively the "Developer") via Resolution No. 2018-30647 for the development of properties located at 500 Alton Road, 630 Alton Road, 650 Alton Road, 1220 6th Street, 659 West Avenue, 701 West Avenue, 703 West Avenue, 711 West Avenue, 721 West Avenue, 723 West Avenue, 727 West Avenue, and 737 West Avenue ( collectively, the " Development Sites"); and WHEREAS, as part of the Agreement, the Developer is required to comply with the City's Art in Public Places Ordinance, defined in Section 16 of the Development Agreement as follows: The Developer shall comply with the City' s Art In Public Places (the "AIPP') program requirements under Section 82-536 through 82-612 of the City Code (as applicable) and shall contribute to the City' s Art in Public Places fund the total of 1.5% of the " construction cost" as such term is defined in Section 82- 537 of the City Code) of the Park Project (the "Public Art Funds') no later than the date of execution of a construction contract for or that includes the construction of the Park Project, as required by the City Code. The full amount of the Public Art Funds shall be dedicated to Developer' s use for public art within the Park Site. In view of the Developer' s overall design responsibility for the Park Project, the Developer shall either: (a) submit the proposed artworks to be funded with the Public Art Funds to the City' s Art In Public Places Committee for its review, recommendation and approval; or (b) seek the City Commission' s approval of the proposed artworks and waiver of any applicable AIPP program requirements, which approval by the City Commission shall not to be unreasonably withheld, conditioned or delayed. WHEREAS, on October 20, 2020, the Developer presented to the City's AiPP Committee a proposed artwork, Mark Handforth's Snow White, 2016, to be funded with the Public Art Funds; and WHEREAS, following a presentation of the proposed work by artist Mark Handforth and upon reviewing the required submission materials, the AIPP Committee made a unanimous motion to accept the work as part of the City of Miami Beach Art in Public Places Collection, and further recognized that the Developer has fulfilled its public art contribution, as required by the Art in Public Places Ordinance. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Art in Public Places Committee, and approve the 500 Alton Road Public Art Commission by Miami based artist Mark Handforth; to be funded through the escrow agreement between TCH 500 Alton, LLC and the City of Miami Beach in the amount of $95,812.00, thus satisfying the requirements of the Art in Public Places Ordinance. ANALYSIS On December 12, 2018, the City of Miami Beach entered into an agreement with South Beach Heights I, LLC, 500 Alton Road Ventures, LLC, 1220 Sixth, LLC, and KGM Equities, LLC (collectively the "Developer")via Resolution No. 2018-30647 for the development of properties located at 500 Alton Road 630 Alton Road, 650 Alton Road, 1220 6th Street, 659 West Avenue, 701 West Avenue, 703 West Avenue, 711 West Avenue, 721 West Avenue, 723 West Avenue, 727 West Avenue, and 737 West Avenue ( collectively, the " Development Site"). On October 20, 2020, the Developer presented to the City's Art in Public Places Committee a proposed artwork, Mark Handforth's Snow White, 2016, to be funded with the Public Art Funds. In considering the work, the Art in Public Places Committee reviewed the following criteria, as fully presented in Exhibit A and B: 1. Photographs of proposed work Mark Handforth's Snow White (2016) is composed of painted aluminum and is 112 x 120 x 50 inches. 2. Artist Resume Mark Handforth (b. 1969, Hong Kong) was raised in London and has been based in Miami since 1992. His work has appeared in exhibitions worldwide, including solo presentations and outdoor public sculptures at the Museo d'Arte Contemporanea, Villa Croce, Genova, Italy (2016); Museum of Contemporary Art Chicago (2011); Dallas Museum of Art (2007); Kunsthaus Zu-rich (2005); and the Hammer Museum, Los Angeles (2002). Page 247 of 1430 Handforth's work is held in the collections of the Whitney Museum of American Art, Museum of Contemporary Art Los Angeles, Dallas Museum of Art, Pinault Collection, The Bass Museum of Art, Carnegie Museum, Rubel! Family Collection and Jumex Foundation, among others. 3. Project Description The all white star titled Snow White is part of a series of seven sculptural stars by Miami artist Mark Handforth. A red star, Texas Tom, is on exhibit at the Rachofsky House, a private home and contemporary art collection in Dallas; a deep violet star graces the rustic grounds of the Domaine du Muy sculpture park in southeastern France; a saffron star adds a brilliant splash of color to the Governors Island park in New York Harbor. Handforth is debating whether to complete his star series by creating an eighth and final star in silver. According to Handforth, it was a challenge to convert the abstract rays of light that make up stars into a concrete sculptural form that also conveys movement. He succeeded by twisting the point of at least one of the five prongs, conveying the sense of a star streaking through the sky. 4. Proposed Location Within the Development Site public park, as further referenced in Exhibit B. 5. Project Budget/Compliance with Art in Public Places Contribution The City held in escrow $95,812.00, which was the required contribution of the Developer to the Art in Public Places Program. As provided by the Developer, the actual cost of acquiring and installing the work is $177,250.00. The additional cost of $81,438.00 is being contributed by the Developer. 6. Engineering Requirements Renderings were provided as part of the submission package, Exhibit A, page 13. 7. Maintenance Plan As provided by the artist, the work will require periodic waxing to protect the paint and a periodic wash of clean water to remove construction dust and ocean salt. 8. Appraisal Report The Developer provided an appraisal report by Morrissey Fine Art for the retail replacement value of Mark Handforth's Snow White (2016). This appraisal report is used for insurance inventory purposes. The market for works by the artist remains successful both on the auction and retail levels. The replacement value of the work is $281,500.00 9. Condition Report The work is in pristine condition and is currently stored at Galerie Eva Presenhuber, Zahnradstrasse2l, CH-8005, Zurich. Following a presentation of the proposed work by artist Mark Handforth and upon reviewing the required submission materials, the Art in Public Places Committee made a unanimous motion to accept the work as part of the City of Miami Beach Art in Public Places Collection and further recognizes that the Developer has fulfilled its public art contribution, as required by the Art in Public Places Ordinance. Page 248 of 1430 FINANCIAL INFORMATION The City has held in escrow $95,812.00, which was the required contribution of the Developer to the Art in Public Places Program. He revels in the skewed perspectives and unintended consequences that result from cultural exchange and displacement. Known for his humorous sculptural appropriations of public objects, Mark Handforth has used a breadth of subjects,including fire hydrants,stop signs,and even celestial forms such as stars. His highly popular neon installation at PAMM,Western Sun,is part of a group of works consisting of fluorescent light fixtures installed directly into the gallery wall in pictorial arrangements--in this case,a partially setting sun disappearing into the floor.The work immerses everything around it, including the viewers body,in a dramatic,red-orange glow. Evoking the notion of human-made sunlight,it relates to visions of a world in which all things natural have been replaced by manufactured products. It is among the most Instagrammed works in the PAMM collection. Locally,he has also shown at MOCA in North Miami under the direction of Bonnie Clearwater. Effective Valuation Date of Appraisal: Values expressed in this appraisal are effective as of 8/27/2020, the date the client engaged Morrissey Fine Art for this appraisal. Use of Appraisal: Insurance inventory. Users of Appraisal: This appraisal can be used and relied upon by the client,as well as its insurance agent and personal accountant. Any other user is considered an unintended user. Ownership Interest: The question of title was not an issue. As such,the appraiser did not perform an Art Loss Registry Inquiry. As such, the artwork is assumed to be in good condition. Additionally, the appraiser is relying upon measurements supplied by the client. Measurements are given to the nearest inch, height x width x depth. Photographs of the artwork were supplied by the artist. The color accuracy of the photographs cannot be guaranteed. General Condition of Items:No formal condition report was supplied by the client for the artwork. As such,the appraiser assigned the artwork a general condition comment—good,fair or poor with description qualifications when needed. Condition" refers to what is considered generally acceptable, with ordinary wear and tear for its type,unless otherwise noted.The following can be used as a general definition for the condition standards: Good is used when the work is unrestored with no apparent damage to the original condition or restored/conserved/stabilized with concern for preserving the integrity of the work. The sculpture remained in situ. In this case, the artwork remained at the artist's gallery in Zurich and was not inspected. I found no reason to question the authenticity of the artwork. The artist verbally confirmed to the appraiser that he created the sculpture in question. Additionally, to my knowledge, no laboratory testing has been performed on the subject property. This Appraisal Report is not an indication or certificate of title ownership. The appraised value is based on whole ownership and possessory interest undiminished by any liens,fractional interests or any other form of encumbrance or alienation. Hypothetical Conditions: Defined by USPAP as a condition directly related to this assignment that is contrary to what is known by the appraiser to exist on the effective date of the assignment results, but is used for the purpose of analysis. The following Hypothetical Conditions exist in this assignment: The sculpture was purchased for installation at Canopy Park in Miami Beach, Florida. The developer, Terra, does not currently own the artwork. The replacement value could conceivably change if the artwork were purchased for installation in a different location, especially with regard to taxes and costs associated with insurance,crating,and shipping. Research Methodology: Research was conducted in the offices of Morrissey Fine Art. The offices are equipped with an extensive library of research books and auction catalogues. Additional research was conducted online using standard search engines as well as pricing databases to which Morrissey Fine Art subscribes,including artnet. Appropriate galleries and auction houses were contacted for information when necessary. Minimal outside library/museum research was conducted for this specific appraisal. Definition of Sales Comparison Approach and Market Examined: The Sales Comparison Approach' analyzes recent sales and prices of comparable articles at retail establishments,galleries, and private sales, as well as international, national and regional auctions where objects such as the subject property are normally traded. Given the items and the purpose of the assignment, I selected the Sales Comparison Approach to arrive at the Retail Replacement Value. The Income Approach and the Cost Approach were considered and rejected as not applicable to this appraisal. The Income Approach was not considered appropriate because the subject property at present is not income-generating. The Cost Approach was not considered appropriate as there is no need to determine the value of the subject property based on the cost of manufacturing or recreating an identical object at this time. The family later resettled in London, England, where Handforth grew up and later attended the Slade School of Fine Art. Handforth met his future wife, celebrated video artist Dara Friedman, while studying at Staatliche Hochschule filr Bildende Kunste, Stadelschule in Frankfurt am Main in Germany. He landed in Miami in 1992 and stayed because the weather was warm and the rents were reasonable. Since then, Handforth has exhibited his monumental sculptures worldwide, including solo shows at the Museo d'Arte Contemporanea di Villa Croce in Genoa Italy;the Museum of Contemporary Art in Chicago; the Dallas Museum of Art;Kunsthaus Zurich;and the Hammer Museum in Los Angeles. Handforth has also shown locally at MOCA in North Miami,under the direction of Bonnie Clearwater. His Western Sun was a hit at the Perez Art Museum Miami. The neon installation represented a setting sun that enveloped viewers in a warm red-orange glow as they sat contemplating the sunset that seemed to slip into the museum floor. Handforth played on the idea of manmade sunlight in a world where nature is rapidly being replaced by manufactured goods. Western Sun resonated with viewers so much so that it became one of the most Instagram-worthy works in the PAMM collection. Handforth is known for his minimalist approach and his focus on urban art. He takes recognizable objects, such as pay phones, street lights and motorbikes, and transforms them by making them larger than life, toppling them to eye level or festooning them with candles that drip multi-colored wax. His series of five- pronged stars follow in that tradition. According to the artist, it was a challenge to convert the abstract rays of light that make up stars into a concrete sculptural form that also conveys movement. He succeeded by twisting the point of at least one of the five prongs,conveying the sense of a star streaking through the sky. Each star is a single color, and seven works currently comprise the series. A red star, Texas Tom, is on exhibit at the Rachofsky House, a private home and contemporary art collection in Dallas; a deep violet star graces the rustic grounds of the Domaine du Muy sculpture park in southeastern France; a saffron star adds a brilliant splash of color to the Governors Island park in New York Harbor. Handforth is debating whether to complete his star series by creating an eighth and final star in silver. To date,of his 38 sculptures have gone to auction. Sold by Sotheby's New York on May 15, 2008 [Lot 4511. Estimate: $50,000-$70,000. Price realized,with premium: $205,000. On the retail level, Handforth is represented by the eminent Galerie Eva Presenhuber, with locations in Zurich and New York. The Snow White sculpture currently resides at the Zurich gallery, which exhibited the star to coincide with the Art Basel 2016 in Switzerland(Snow White and Pink Panther,June 12—July 23, 2016). According to Handforth, each of his star sculptures are roughly the same size and sell for $250,000 to $300,000. Snow White is listed at$250,000,he said. Handforth agreed to provide a$100,000 discount for Snow White in an effort to support art in public places. An added incentive is that the star would be installed within an easy drive from his home in Miami. Image 6of6 - Dog Star (2018), painted aluminum, 109 x 120 x 58 inches. Listed for $250,000 at Gavin Brown's Enterprise in New York. Price realized with a 20 percent discount and then sales tax: $217,250. Sale date: December 14,2018. Conclusion Because Snow White is being appraised at Retail Replacement Value,the retail value of$250,000 is used, not the discounted price. The value is supported by the sale of earlier works,that the artist states were listed at$250,000 to $300,000 and all sold in the $250,000 range. With Miami-Dade County's 7 percent sales tax,the value increases to$267,500. Because this is a retail replacement appraisal it is appropriate to include the costs associated with obtaining the artwork. In this case, the artwork is located in Zurich and is slated for installation in Miami Beach. According Andreas Grimm, the managing director of Galerie Eva Presenhuber, it would cost $14,000 to crate,ship and insure the sculpture during transit. Based on the foregoing analysis, I conclude the Mark Handforth sculpture titled Snow White has a Retail Replacement Value of: $281,500(Two Hundred Eighty-One Thousand,Five Hundred Dollars). According to the ASB, value can"be numerically expressed as a specific amount, as a range of numbers, or as a relationship(e.g.,not more than,not less than)to a previous value opinion or numerical benchmark (e.g., assessed value, collateral value)." It should be noted that USPAP states that calling an appraisal something else such as"valuation"or"valuation estimate"does not remove it from being considered as an appraisal if the opinion of value is given. The document contains a valuation executed for a specific purpose and follows specified guidelines. ASSUMPTIONS AND LIMITING CONDITIONS: According to USPAP, the appraiser is required to identify and explain the circumstances and appropriateness of any assumptions,extraordinary assumptions, hypothetical and limiting conditions that have been used in an appraisal assignment. These terms or concepts are generally linked together in most appraisals. They refer to the assignment conditions and how, if varied,they might alter the appraisal results. MOST APPROPRIATE MARKET: The venue in which the appraiser determines an object can be sold most easily and at the highest price. Frequently in the case of personal property,where comparable works are scarce,the most appropriate market can be a combination of auction and private gallery sales. PRIMARY MARKET: The primary market is one created by the maker or maker's agent when an object is originally sold,usually in galleries or other retail outlets. The secondary market is the venue for the sale of an object between a seller and a buyer with neither having participated in the creation or initial sale of the object. In the instance of multiples,a valid secondary market cannot exist while the maker or his agent retains a supply of the original offering. PROVENANCE: History of ownership for an item back to its maker. Provenance not only supports the authenticity of the work, but also enhances the value if the work was at one time part of an important collection or appeared in a major exhibition. QUALIFIED APPRAISAL: A Qualified Appraisal is an appraisal conducted by a qualified appraiser in accordance with generally accept appraisal standards. The IRS further states that an appraisal will be treated as having been conducted in accordance with generally accepted appraisal standards if it is consistent with the substance and principles of the Uniform Standards of Professional Appraisal Practice, also known as USPAP. QUALIFIED APPRAISER: A Qualified Appraiser is an individual who has earned an appraisal designation from a recognized professional appraiser organization or has otherwise met minimum educational and experience requirements set forth in regulations prescribed by the IRS. Handforth's dynamic and playful works extend ideas that have been at play in the artist's work for several years. He typically utilizes materials drawn from everyday civic infrastructure,such as streetlamps, road signs,fluorescent lights,and the like,but radically reworks and deforms them into new and exciting configurations.Known for his humorous sculptural appropriations of public objects, Mark Handforth has used a breadth of subjects,including fire hydrants,stop signs,and even celestial forms. Handforth's bold style and large format have been compared to those of Claes Oldenberg and other Pop Artists, his more unusual creations also compared to Surrealism. The sculpture titled'Platz'which has been created specially for the town of Zurich,has on the one hand a nautical touch to it,as it refers to Lake Zurich,which is just a stone's throw away from the Tessinerplatz,while at the same time evoking industrial and urban influences:Oversized,intertwined links of a chain pile up to form a seemingly organic entity,alowing an abstracted perception of the chaining of the individual elements. Handforth is known for his adaptations of industrially manufactured signposts and urban'furnishings'such as street lamps,tires,motorcycles,parking meters,public telephones,or hydrants.He uses these objects,altering them and sometimes reproducing them partially,thus often keeping the viewer in the dark about whether they are ready-mades or not.He recognises things existing in the world and takes lir them as a basis for his work,subjecting them to a shift in time.By transforming the objects,the artist lets them gain a new sense of poetry that carries the idea of vanity..
