A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE RENEWAL OF THE
ENVIRONMENTAL SYSTEMS RESEARCH INSTITUTE SOFTWARE
MAINTENANCE AND SERVICES AGREEMENT BETWEEN THE CITY OF
MIAMI BEACH AND ENVIRONMENTAL SYSTEMS RESEARCH INSTITUTE,
THE SOLE PROVIDER AND LICENSOR OF THE ESRI SOFTWARE, IN AN
AMOUNT NOT TO EXCEED $55,000 ANNUALLY, FOR A TERM OF THREE
(3) YEARS; AND FURTHER ACCEPTING THE WRITTEN
RECOMMENDATION OF THE INTERIM CITY MANAGER TO WAIVE, BY
5/7TH VOTE, THE FORMAL COMPETITIVE BIDDING REQUIREMENT,
FINDING SUCH WAIVER TO BE IN THE BEST INTEREST OF THE CITY.
WHEREAS, the City's Geographic Information System ("GIS") is a critical element for
various departments throughout the City, and many programs rely on GIS including the Public
Works Utilities System, Cityworks Asset Management System, New World Computer Aided
Dispatch system, Energov Permitting System, Munis Financial System, Geocortex Mapping
System, and more;
WHEREAS, GIS also provides mapping, analysis and reporting solutions for all City
departments including:
• The Police Department's Crime Analysis Division's ArcGIS Online Portal;
• Automated processes for updating Miami-Dade County Property Appraiser parcel
data;
• Support services for the City's Emergency Operations Center;
• Mapping support services for the Mayor's Blue Ribbon Panel on Sea Level Rise;
• Provides consultants and contractors working outside the City's computer network
access to view live storm water and sanitary GIS data; and
WHEREAS, in 2007, the Mayor and City Commission adopted Resolution No. 2007-
26486, which approved the purchase of a "site" software license for GIS services from the
Environmental Systems Research Institute ("ESRI"), which GIS software supports multiple
applications for the City; and
WHEREAS, in 2017, the Mayor and City Commission adopted Resolution No. 2017-
30038, which approved the Resolution to waive, by a 5/7ths vote, the formal competitive bidding
requirement, finding such a waiver to be in the City' s best interest, and authorizing a three (3)
year extension to the software license agreement with ESRI, the sole source provider and
licensor of the ESRI Software; and
WHEREAS, the Public Works' GIS Division currently operates and maintains seven (7)
servers running ESRI GIS software, and these GIS servers currently support over twenty (20)
departments and two hundred(200)users throughout the City,with more departments and users
forecast to come online; and
WHEREAS, the ESRI brand is the global market leader in GIS with over a million users
in 200 countries and provides support, expertise, and the highest quality products available in
GIS; and
WHEREAS, the ESRI brand has an understanding of the industry, long term experience,
strong technical competencies, and continuous innovation which allows them to provide
outstanding service and support.
WHEREAS, the ESRI brand of GIS is considered the leader in GIS and is used by many
different municipalities in and including Miami-Dade County; and
WHEREAS, the renewal of the ESRI brand will be in an amount not to exceed $55,000
annually, for a term of(3) years; and
WHEREAS,the City Manager recommends the Mayor and City Commission approve this
Resolution and waive, by 5/7ths vote, the formal competitive bidding requirement, finding such
waiver to be in the best interest of the City, and authorize the renewal with ESRI for a period of
three (3) years.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, herby, authorizes the renewal of the
Environmental Systems Research Institute Software Maintenance and Services Agreement
between the City of Miami Beach and Environmental Systems Research Institue, the sole
provider and licensor of the ESRI software, in an amount not to exceed $55,000 annually, for a
term of three (3) years; and accepts the written recommendation of the Interim City Manager
to waive, by 5/7th vote, the formal competitive bidding requirement, finding such waiver to be in
the best interest of the City.

RECOMMENDATION

such a waiver to be in the City' s best interest, and authorizing a three (3) year extension to
the software license agreement with ESRI, the sole source provider and licensor of the ESRI
Software.
The Public Works' GIS Division currently operates and maintains seven (7) servers running

used by many different municipalities in and including Miami-Dade County.
ANALYSIS
Maintaining the ESRI software and standardizing the GIS services eliminates the hardships, of
switching providers which would require staff to train in the use of different software and
integration in the various other software programs utilized by the City. As such,
the Administration recommends the City continue the standardization on ESRI GIS Software.
The purpose of this item is to waive the competitive bidding requirements of the City and
maintain the standard for ESRI GIS brand software so that future GIS software maintenance,
services and related items can be sourced from the one standard brand as applicable to the
intended use.
SUPPORTING SURVEY DATA
Results from the 2019 Resident Survey show that 69% of resident's perception of the City with
regards to overall quality of City services rated as very satisfied, satisfied. In order to continue
maintaining excellent standards in this area, the Administration is considering renewing its
contract with ESRI for a term of three (3)years.
CONCLUSION
The Administration recommends that the Mayor and City Commission approve the request to
waive, by a 5/7ths vote, the formal competitive bidding requirement, finding such a waiver to be
in the City's best interest, and authorize the Administration to renew the ESRI software
maintenance, services and related items for future GIS needs through ESRI for purposes of
maintaining standardization of the City's GIS software in an amount not to exceed $55,000
annually,for the period of three (3)years.

The purchase of the ESRI site license will expand the individual license available to some departments
into a Citywide ability to access GIS technology. Other companies provide GIS Software. However,
these GIS software products would not be compatible with the Computerized Maintenance Management
System that has been developed using the ESRI geo-database structure in Public Works.
ESRI software for GIS was part of the original proposal in 2004 for an integrated Infrastructure
Management System (IMS) which included a Computerized Maintenance Management System
(CMMS)integrated with GIS.The IMS was awarded after a competitive bid process which included
presentations by five companies. Four of the five companies proposals included the use of ESRI,
GIS software.
The Administration recommends adopting the Resolution.

FUNDING
Funding for the ESRI site license is from the Water and Sewer Enterprise Fund
previously appropriated June 7, 2006.
ANALYSIS
ESRI software for GIS was part of the original proposal for an Infrastructure
Management System (IMS) in Public Works which included a Computerized
Maintenance Management System (CMMS) integrated with GIS. A Request for
Proposals (RFP) was issued in 2004. ESRI software was featured in four of the five
responses. The contract for the development of the CMMS portion of the project
was awarded to Camper Dresser, McKee, Inc. in 2005.
The Public Works, F1 Vie, Police, Parks and Planning Departments have, in the past,
purchased individual Icenses for ESRI software. The GIS System Manager, working
with the IT Department, will consolidate these individual licenses and expand the
current limited access into a citywide site license at a cost of $101,275 and enable
access to the GIS by all departments.
There are other companies that provide GIS software. However, these GIS software
products would not be compatible with the state of development of the IMS because
the CMMS geo-database component already has been developed using the ESRI
standard.
Working closely with the Information Technology Department, and the IT Steering
Committee, the Public Works Department has made significant progress in
developing the IMS. Major accomplishments include:
- CMMS operational in Utilities, Streets, Streetlights and Sanitation.
- GIS User Group established.
- GIS Manager hired.
- Data Stream 7i Facilities CMMS has been upgraded and is operational.

- Facilities Assessment CMMS VFA Program has been implemented.
- Contracted for the conversion of 164,000 features into GIS Data Points.
- Purchased CMMS Site License for Public Works and Parks Department
- Corrected City Addressing System.
- Subscribed to Miami-Dade County GIS Data Service
The IMS program is an important asset to many departments in the City. The newly
hired GIS System Manager will be working to integrate GIS with the Public Works
CMMS for infrastructu ile management and with all Departments with respect to their
individual requirement for informational mapping. Approval of this request would
provide access and allow for expanded development of the GIS.

Throughout the industry the ESRI brand of GIS is considered the leader in GIS and is used by many
different municipalities in and including Miami-Dade County.
Maintaining the ESRI software and standardizing the GIS services would eliminate the hardships of
switching providers which would require staff training of different software and integration in the
various other software programs utilized by the City.
As a result of the aforementioned, the Administration recommends that the City standardize on ESRI
GIS Software.

The purpose of this item is to waive the competitive bidding requirements of the City and establish a
standard for ESRI GIS brand software so that future GIS software, maintenance, services and
related items can be sourced from the one standard brand as applicable to the intended use.
CONCLUSION
Based on the foregoing, the City Manager recommends that the Mayor and City Commission
approve this resolution to waive, by a 5Rths vote, the formal competitive bidding requirements,
finding such a waiver to be in the City's best interest, and authorize the Administration to purchase
ESRI software, maintenance, services and related items for future GIS needs through ESRI for
purposes of standardizing GIS software Citywide.

consolidation, merger,or reorganization of Customer
with or into another corporation or entity;
(ii)Customer's acquisition of another entity;or(iii)a
transfer or sale of all or part of Customer's
organization(subsections i, ii, and iii,collectively

no decrease in Fee as a result of any Ownership
Change.
9.1 If an Ownership Change increases the
cumulative program count beyond the maximum
level for this Agreement, Esri reserves the right
to increase the Fee or terminate this Agreement
and the parties will negotiate a new agreement.
9.2 If an Ownership Change results in transfer or
sale of a portion of Customer's organization, that
portion of Customer's organization will transfer

and destroy all copies of the Products.
9.3 This Agreement may not be assigned to a
successor entity as a result of an Ownership
Change unless approved by Esri in writing in

Sole Source Procurement Request for Environmental Systems Research
Institute (ESRI) Software Maintenance/Support For Small Government
Term Enterprise License Agreement (ELA)
1. The ESRI ELA is a three-year agreement that grants the City of Miami Beach access to ESRI term
license software on an unlimited basis. ESRI provides Geographic Information Systems (GIS)
software that combines geographic data(the location of man-made and natural features of the
earth's surface)and other types of data(names,classifications,addresses and other data)to
generate visual maps and reports.The City has been using ESRI enterprise software as its core
GIS software platform'supporting all city departments and divisions since 2006. Many of the
third-party applications used throughout the city such as Cityworks Asset Management System
and EnerGov interface directly with ESRI software as part of their functionality.
2. ESRI is the world's leading provider of Geographic Information Systems(GIS)software,web GIS
and geodatabase management applications. ESRI is the standard GIS platform with the majority
of all government agencies.The City has consulted with many agencies and vendors that use or
provide GIS services alnd has concluded that the majority have adopted ESRI products as their
standard GIS system. By adopting the use of ESRI GIS products,the City ensures that we can
obtain and share dat between public and private agencies while maintaining data standards
and compatibility. ESRI is the sole-source provider for ESRI products in the U.S.commercial,
state,and local government marketplace.
3. This purchase would obligate the City to renew the Maintenance/Support ELA at an annual cost
of$55,000 per year for three years.
4. The price for this product is considered to be fair and reasonable because it's standardized
across all government agencies and based on the population of that agency's municipality.
5. Miami Beach has verified that the pricing by the vendor is the same pricing quoted to all its
customers.
6. Without this Maintenance/Support agreement, deployment of the GIS system citywide while
providing the same features and capabilities would involve considerable cost in the form of
individual third-partyi software,staff,man hours,training and maintenance.On average the cost
could be estimated at around $100,000-$150,000 a year.

Agreement.An EA is a bundled package for licensing software, maintenance, and online services for
redistribution within the organization. Esri products are provided with a special grant to copy and deploy
specified quantities of capped items and unlimited quantities of items without a cap, during the term of the
