RESOLUTION NO. 2021/016: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, URGING THE BAHAMIAN GOVERNMENT TO DENY OFFSHORE OIL DRILLING EXPLORATION LICENSES AND PERMANENTLY BAN OFFSHORE OIL DRILLING ACTIVITIES IN THE BAHAMAS; PROVIDING FOR TRANSMITTAL AND AN EFFECTIVE DATE. RESOLUTION NO. 2021/017: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO APPROVE FLORIDA SENATE BILL 334/HOUSE BILL 239 AUTHORIZING COUNTIES AND MUNICIPALITIES TO FURTHER RESTRICT SMOKING WITHIN THE BOUNDARIES OF PUBLIC BEACHES AND PUBLIC PARKS; PROVIDING FOR DISTRIBUTION OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. REG/rg Attachment F:CLER\SALL\LILIA\LTC's - Transmittal's\Deerfield Beach\Resolution 2021-016 and 2021-017 Deerfield Beach.docx II RESOLUTION NO. 2021/016 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, URGING THE BAHAMIAN GOVERNMENT TO DENY OFFSHORE OIL DRILLING EXPLORATION LICENSES AND PERMANENTLY BAN OFFSHORE OIL DRILLING ACTIVITIES IN THE BAHAMAS; PROVIDING FOR TRANSMITTAL AND AN EFFECTIVE DATE WHEREAS, the Baham as Petroleum Comp any ("BPC") has been granted an offshore oil drilling exploration license by the Bahamian governm ent that allows them to construct exploratory offshore oil drilling wells 150 miles off the coast of Florida; and WHEREAS, exploratory and comm ercial drilling, extraction, and transportation of offshore oil and gas resources by BPC poses a sign ificant risk of oil spills and chronic leak age that may adversely impact the Baham as, coastal comm unities in the Caribb ean, and Florida; and WHEREAS, offshore drilling activities pose threats to treasured vacation destinations in the Caribbean and along Florida's coasts, which are of intrinsic economic value for numerous industries and countries, provide essential nursery habitats for recreational and com mercially imp ortant fisheries, and act as natural buffers from storm surge and hurricanes; and WHEREAS, the City is one of num erous comm unities in Florida whose local or nearby marine habitats, industries, and public health could be devastated by offshore drilling oil spills originating in the Bah ama s; and WHEREAS, the City end eavors to protect the environm ental health of all marine habitats, and, particularly, off the coast of the City; and WHEREAS, exploration and developmen t of oil and gas resources off the Bahami an coast may not effectively address the long-term econo mi c diversification goals of the Bahamas, and sub stantially damage the tourism sector of the Bahamian economy, wh ich makes up sixty percent of the country's econom y; and WHEREAS, the City urges the Bahamian government to deny offshore oil drilling exploration licenses and to perm anently ban offshore oil drilling activities in the Bah amas, and furth er urges Broward County and the State of Florida to oppose such offshore oil drilling and work with the Bahamian government in such efforts. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, AS FOLLOWS: Section 1. The above referenced "Wh ereas" clauses are true and correct and made a part of this Resolution. R esol u ti on 2 0 2 1/0 16 Section2. The City Commission respectfully urges the Bahamian government to deny offshore oil drilling exploration licenses and to permanently ban all offshore oil drilling activities in the Bahamas. The City Commission urges Broward County and the State of Florida to oppose such offshore oil drilling and to work with the Bahamian government in such efforts. Section3. The City Commission hereby directs the City Cl e rk to transmit a copy of this Resolution to the Bahamian Prime Minister Hubert Minnis, the Bahamian Ambassador to the U,S. Sidney S. Collie, the Broward County Board of County Commissioners, Governor Ron DeSantis, the Miami-Dade County League of Cities and the Broward County League of Cities. Section 4. This Resolution shall take effect immediately upon adoption. PASSED AND ADOPTED THIS 2ND DAY OF FEBRUARY, 2021. CI T Y O F D EE RFI E LD BEA CH BILL GANZ, MAYOR ATTEST: 2 E RESOLUTION NO. 2021/017 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO APPROVE FLORIDA SENATE BILL 334/HOUSE BILL 239 AUTHORIZING COUNTIES AND MUNICIPALITIES TO FURTHER RESTRICT SMOKING WITHIN THE BOUNDARIES OF PUBLIC BEACHES AND PUBLIC PARKS; PROVIDING FOR DISTRIBUTION OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, according to the United States Center for Disease Control, the combination of smoke from the burning of tobacco products and the smoke exhaled from the smoker, referred to as secondhand smoke, exposes nonsmokers to thousands of chemicals, hundreds of which are toxic and 70 are known to cause cancer; and WHEREAS, as 0f2018, nearly 14% of U.S. adults aged 18 years or older currently smok e cigarettes; and WHEREAS, cigarette smoking causes more than 480,000 deaths each year in the United States and approximately 2.5 million nonsmokers have died from health-related illnesses caused by exposure to secondhand smoke since 1964; and WHEREAS, there is no risk-free level of secondhand smoke exposure, as even brief exposure can be harmful to health; and WHEREAS, according to the Ocean Conservancy, cigarette butts are the most common waste item collected from beach cleanups; and WHEREAS, currently, state law preempts counties and municipalities from further restricting smoking within public beaches and public parks; and WHEREAS, Florida Senate Bill 334 ("SB 334") and House Bill 239 ("HB 239), which were recently filed for consideration in the 2021 Florida Legislative Session, propose to provide authorization to counties and municipalities to further restrict smoking within public beaches and public parks; an d WHEREAS, City Commissioner Todd Drosky has been appointed to lead the Broward League of Cities Regulation of Smoking Task Force (the "Task Force"); and WHEREAS, the City Commission supports the efforts of the Task Force and legislative efforts to enable counties and municipalities to further restrict smoking within public beaches and public parks; and WHEREAS, the City Commission finds that this Resolution is in the best interest of the citizens and residents of the City. 1 R eso lu ti o n 2 0 2 1/0 17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, AS FOLLOWS: Section 1. The above referenced "Whereas" clauses are true and correct and made a part hereof. Section2. The City Commission of the City of Deerfield Beach urges the Florida Legislature to approve SB 334/HB 239 authorizing counties and municipalities to further restrict smoking within the boundaries of public beaches and public parks. Section3. The City Clerk is directed to transmit a certified copy of this Resolution to the Florida Governor, the President of the Florida Senate, the Speaker of the Florida House of Representatives, the Broward County Legislative Delegation and the Broward League of Cities.
