RESOLUTION NO. 86-18381
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE CITY MANAGER TO GRANT A TWO YEAR
EXTENSION OF THE EXISTING CONCESSION
AGREEMENT WITH JEFF BLUMENFELD AND JOE
FELTON DATED MARCH 23, 1983 FOR THE NORTH
SHORE OPEN SPACE PARK
WHEREAS, the City entered into a Concession Agreement ("Agreement")
with Jeff Blumenfeld and Joe Felton dated March 23, 1983 for a concession in the
North Shore Open Space Park for a three (3) year term expiring on March 25,
1986; and
WHEREAS, pursuant to Paragraph 35 of the Concession Agreement, the
Concessionaire may request a two year extension of said agreement which
extension periodis subject to an increase in percentage rental to 8 percent of
gross receipts , and concessionaire has requested such extension; and
WHEREAS, the concessionaire has complied with the terms and conditions
of the agreement and is not in default thereunder; and
WHEREAS, the City Commission deems it to be in the best interests of
the City of Miami Beach to authorize the two year extension to the
concessionaire as set forth in the agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH:
That the City Manager is authorized to grant a two year extension of the above
referred Concession Agreement upon the terms and conditions as set forth in the
said Agreement.

SUB.)ECT: EXTENSION OF THE BEACHFRONT CONCESSION AGREEMENT WITH
JOE FELTON/JEFF BLUMENFELD
On March 23, 1983, the City entered into a Concession Agreement with Jeff
Blumenfeld and Joe Felton to provide food and beverage service to beach patrons in
Area J of North Shore Open Space Park in accordance with the specifications of Bid
No.143-82.
The Concession Agreement was for a three (3) year period which expires on March 25,
1986 and provides for an extension of two successive one (1) year terms at the sole
option of the City Manager subject to the approval of the City Commission.
The payment terms of the Concession Agreement are a rental payment to the City of
six (6%) percent of monthly gross receipts the first year, seven (7%) percent of
monthly gross receipts_the second and third years; or a minimum monthly guarantee of
Two Thousand ($2,000.00) Dollars, whichever is greater.
The conditions for extension set forth in the Agreement are that:
The Concessionaire would pay to the City for any extended one (1) year term(s)
eight (8%) percent of monthly gross receipts, or a minimum monthly guarantee
of Two Thousand ($2,000.00) Dollars, whichever is greater.
Every other term and condition existing in the Concession Agreement of March
23, 1983, between the City and the Concessionaire shall be applicable thereto and
continue in full force and effect for any extended term(s).
During the difficult start up years of the beachfront concession program, this
concessionaire has provided superior service to beach patrons during both good and bad
weather. In addition, this concessionaire has paid to the City, from inception through
February 15, 1986, a total of $68,085.41 in guaranteed minimum rental payments.
ADMINISTRATION RECOMMENDATION:
That the Commission approve the Resolution authorizing the City Manager to grant a
two (2) year extension of the Concession Agreement.
