Resolution 86-18406 RESOLUTION NO. 86-18406 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING ACCEPTANCE OF A SETTLEMENT AGREEMENT WITH JOSEPH SWARTZ,. AND THE APPROPRIATION OF FUNDS IN THE AMOUNT OF $263,125.00, FOR THE ACQUISITION OF LOTS 29, 30, AND 31, BLOCK 51, OCEAN BEACH ADDITION #3, PLAT BOOK 2, PAGE 81, PUBLIC RECORDS OF DADE COUNTY, FLORIDA, AT WASHINGTON AVENUE AND BISCAYNE STREET FOR THE WIDENING OF WASHINGTON AVENUE FROM BISCAYNE STREET TO FIRST STREET/HN-426. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA; WHEREAS, the City Commission approved the site selection for the widening of Washington Avenue from Biscayne Street to 1st Street; and WHEREAS, the City Manager and the City Attorney, through their staffs or through special counsel were authorized by the City Commission to acquire said lots by purchase, donation, or through eminent domain proceedings; and WHEREAS, the City Administration has negotiated the purchase price of $263,125.00 for Lots 29, 30, and 31, Block 51, Ocean Beach Addition #3, Plat Book 2, Page 81, Public Records of Dade County, Florida; and WHEREAS, the funding for this project is to be taken from the $9.8 million South Pointe Infrastructure Bond Issue. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT: r-_ 1. The recommendation of the City Manager and staff as to the purchase price of $263,125.00 for Lots 29, 30, and 31, Block 51, Ocean Beach Addition #3, Plat Book 2, Page 81, Public Records of Dade County, Florida for the widening of Washington Avenue from Biscayne Street to 1st Street is hereby accepted and approved. 2. The funds in the amount of $263,125.00 be appropriated from the $9.8 million South Pointe Infrastructure Bond Issue to be placed in Work Order #2947 (Washington Avenue Improvement/HN-426). Parks — City Manager % SUBJECT: AUTHORIZING THE ACCEPTANCE OF A SETTLEMENT AGREEMENT WITH JOSEPH SWARTZ FOR THE ACQUISITION OF THE NEEDED RIGHT-OF-WAY PROPERTY AT WASHINGTON AVENUE AND BISCAYNE STREET BACKGROUND: The Washington Avenue Street Widening Project affects the west side of Washington Avenue from Biscayne Street to 1st Street. The right-of-way width is to be increased from 60' to• 100' in this project area. The City Commission authorized a contract with Post, Buckley, Schuh and Jernigan, Inc., for thedesign of the Widening of Washington Avenue from Biscayne Street to 1st Street. Post, Buckley, Schuh and Jernigan, Inc., has been authorized to proceed with preliminary design only. Appraisal work on the properties to be affected by the Washington Avenue Widening Project were completed, and at the regularly-scheduled City Commission Meeting of January 22, 1986,the City Commission authorized the Administration to negotiate.with the property owners affected by the proposed right-of-way widening. • CURRENT STATUS The City Administration has met with Joseph Swartz and his wife, Doris Swartz, owners of the property located on the westerly side of Washington Avenue and Biscayne Street (Lots 29, 30, and 31, Block 51, Ocean Beach Addition #3, Plat Book 2, Page 81, Public Records of Dade County, Florida). The negotiations with the property owners has resulted in an offer in the amount of $263,125.00 (copy of offer attached). ADMINISTRATION RECOMMENDATION: The City Administration recommends that the City Commission approve the settlement agreement and adopt the attached Resolution authorizing the acquisition and appropriation of.Lots 29, 30, and 31, Block 51, Ocean Beach Addition #3, Plat Book 2, Page 81, Public Records.of Dade County, Florida, for $263,125.00.
