RESOLUTION NO. 86-18464
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE A MANAGEMENT AGREE-
MENT BETWEEN THE CITY OF MIAMI BEACH AND
AMERICAN GOLF CORPORATION FOR MANAGEMENT OF
THE CITY' S MUNICIPAL GOLF COURSES.
WHEREAS, the City of Miami Beach, on December 9, 1985, under
Request for Proposal ( "RFP" ) 232-85/00 solicited proposals for the
management of the City' s municipal golf courses, and
WHEREAS, American Golf Corporation submitted its proposal pur- -
suant to the RFP, and on March 5, 1986 the City Commission
authorized negotiations with American Golf Corporation for a firm
agreement, and
WHEREAS, Resolution # 86-18447 passed by the City Commission
on May 21, 1986 was invalidated by the Courtin Kaufman. v. City of
Miami Beach, Case No. 86-21504 ( 02) , 11th Judicial Circuit, by Or-
der of Temporary Injunction dated May 29, 1986, and the action of
the City Commission of March 5, 1986 authorizing negotiations with
American Golf Corporation was also invalidated, and
WHEREAS, American Golf Corporation has again been selected as
the first ranked proposer and a Management Agreement has been
prepared, the City Manager has recommended execution of the
Management Agreement and the City Attorney has approved it as to
form.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk are authorized and directed to execute the Management Agree-
ment between the City of Miami Beach and American Golf Corporation
for management of the City ' s municipal golf courses.
