RESOLUTION NO. 86-18465
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE A CONSENT TO ASSIGN-
MENT OF LEASE FROM ANDY FRAIN FLORIDA, INC. TO
AMERICAN GOLF CORPORATION FOR THE CONCESSIONS
AT BAYSHORE AND NORMANDY SHORES GOLF COURSES.
WHEREAS, the City of Miami Beach, on December 9, 1985, under
Request for Proposal ( "RFP" ) 232-85/00 solicited proposals for the
management of the City' s municipal golf courses, and
WHEREAS, American Golf Corporation submitted its proposal pur-
suant to the RFP, and on March 5, 1986 the City Commission
authorized negotiations with American Golf Corporation for a firm
agreement, and
WHEREAS, Resolution # 86-18449 passed by the City Commission
on May 21, 1986 was invalidated by the Court in Kaufman v. City of
Miami Beach, Case No. 86-21504 (02) , 11th Judicial Circuit, by Or-
der of Temporary Injunction dated May 29, 1986, and the action of
the City Commission on March 5, 1986 authorizing negotiations with
American Golf Corporation was also invalidated, and
WHEREAS, American Golf Corporation has again been selected as
the first ranked proposer and a Management Agreement has been
prepared, and the Agreement provides that the existing lease be-
tween the City of Miami Beach and Andy Frain Florida, Inc. dated
September 30, 1983 be assigned to American Golf Corporation, and
WHEREAS, an Assignment with a Consent contained therein has
been prepared and the City Manager has recommended execution of
the Consent and the City Attorney has approved it as to form.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk are authorized and directed to execute the Consent to the
Assignment from Andy Frain, Florida, Inc. to American Golf Cor-
poration of the Concession lease between the City of Miami Beach
and Andy Frain Florida, Inc. dated September 30, 1983 for the Con
cessions at Bayshore and Normandy Shores Golf Courses.
PASSED and ADOPTED this 4th day of n 1986.
