A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
PAYMENT TO METROPOLITAN DADE COUNTY OF
$30 ,660.25 TO BE APPROPRIATED FROM THE CITY'S
GENERAL FUND CONTINGENCY ACCOUNT.
WHEREAS, on May 9 , 1986, the Third District Court of
Appeal for Florida denied the City of Miami Beach and Metropolitan
Dade County' s motions for review of the Order of the Eleventh
Circuit Court in and for Dade County, Florida, taxing appellate
costs against the City and County in Edco Enterprises, Inc. v.
City of Miami Beach and Metropolitan Dade County; and
WHEREAS, Metropolitan Dade County paid Edco Enterprises,
Inc. the total costs taxed against the City and County; and

WHEREAS, Metropolitan Dade County has requested that the
City of Miami Beach reimburse the County for one-half of the
monies paid to Edco Enterprises, Inc. pursuant to the Circuit
Court' s Order Taxing Costs; and
WHEREAS, the amount paid to Edco Enterprises, Inc. , by
Metropolitan Dade County, was $61,320.50 (representing the sum of
the judgment for $54,461.00 plus interest at 12% dating from
May 30, 1985) and one-half of said amount totals $30 ,660.25.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of
Miami Beach pay $30 ,660.25 to be appropriated from the City' s
General Fund Contingency Account to Metropolitan Dade County.
