RESOLUTION NO. 86-18572
A RESOLUTION OF THE MIAMI BEACH CITY COMMIS-
SION APPROVING IN CONCEPT THE PROPOSAL THAT
THE NORTH SHORE OPEN SPACE PARK AND PROPOSED
PARK EXTENSION BE INCORPORATED INTO THE STATE
OF FLORIDA PARK SYSTEM, SUBJECT TO A MANAGE-
MENT PLAN AND A HISTORIC PRESERVATION DESIG-
NATION FOR INTERPRETATIVE HISTORY BEING AP-
PROVED BY THE CITY OF MIAMI BEACH.
WHEREAS, the City of Miami Beach and the Board of
Trustees of the Internal Improvements Fund (State Cabinet) entered
into an Agreement whereby the City would acquire lots within the
North Shore Open Space Project by negotiations, donations or, if
necessary, by eminent domain; and
WHEREAS, the deadline for the City acquisition of
the lots was extended from April 1, 1986 to July 1, 1986, and fur-
ther extended to Nov. 18, 1986 to allow the City time to-place a
bond issue before the electorate for funding acquisition of the
remaining lots; and
WHEREAS, it has been proposed by Dr . Elton
Gissendanner, Executive Director of the Department of Natural
Resources, that a possible alternative solution to the present
funding methods would be to incorporate the present North Shore
Open Space Park and the proposed North Shore Open Space Park Ex-
tension into the State of Florida Park System, subject to a
management plan and historic preservation designation for in-
terpretive history being approved by the City of Miami Beach; and
WHEREAS, the City wishes to express its support
and approval of Dr. Gissendanner ' s proposal by adopting this
resolution.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and
City Clerk are hereby authorized to execute a resolution approving
in concept the proposal that the North Shore Open Space Park and
Proposed Park Extension be incorporated into the State of Florida
Park System subject to a management plan and a historic preserva-
tion designation for interpretative history being approved by the
City of Miami Beach.

SUBJECT: SAVE OUR COA T — NORTH SHORE OPEN SPACE PARK
EXTENSION PROJECT •
BACKGROUND:
April 19, 1983 -- Initial negotiations on the project were approved by the Board of Trustees
• (State Cabinet).
September 20, 1983 -- The City of Miami Beach and the Board of Trustees entered into an
agreement whereby the City would acquire lots within the North Shore Open Space Project
by negotiations, donations or, if necessary, by eminent domain.
November 29, 1983 -- The Board of Trustees approved an acquisition plan developed by the
City in which the Project was reduced from 36 lots. to 24 lots. The Board directed that
condemnation proceedings must be commenced or contracts executed within six months of
November 29, 1983, or within six months of the date funds became available.
October 1, 1985 -- Additional funds for the acquisition of the North Shore Open Space lots
became available and an acquisition deadline of April 1, 1986, was established.
April 1, 1986 -- The Board of Trustees approved an extension of this deadline to
July 1, 1986.
June 3, 1986
1. The City requested and was granted a further extension of the deadline to
November 18, 1986, to allow the City the option of placing before the electorate a bond
issue for the funding of the acquisition of-remaining lots in the North Shore Open Space
Project.
2. DNR shall not place on the Cabinet agenda any request to exercise any options and shall
not exercise any options in the North Shore Open Space Project until further direction
of the Trustees. DNR may enter into option agreements, but the delegation of
authority to the Director of the .Division of State Lands to exercise these options is
withheld. DNR shall report the results of the City of Miami Beach referendum for the
sale of bonds to acquire North Shore Open Space lots to the Trustees at the November
Cabinet meeting and the staff is directed to extend any options until after
November 18, 1986.
3. DNR is directed to free any Save Our Coast revenues committed to this project. Should
the City of Miami Beach subsequently comply with the acquisition plan, any State funds
for acquisition would come from future bond sales.

July 23, 1986 -- The City Commission of the City of Miami Beach passed Resolution
No. 86-18530 pertaining to issuance of bonds for acquisition of beachfront property for the
North Shore Open Space Park Extension/Save Our Coast Project in Miami Beach.
August 15, 1986 -- The City Commission adopted Resolution No. 86-18540, amending
Resolution No. 86-18530 changing the date of the special election regarding the $4 million
General Obligation Bond Issue to acquire beachfront property for the North Shore Open
Space Park Extension/Save Our Coast Project from November 4th to the
September 30, 1986, run-off primary to assure its presentation to the electorate;
redesignated the ballot question from #2 to #1; with the County Canvassing Board acting as
the canvassing board for the City.
CURRENT STATUS
On Friday, August 22, 1986, Representative Elaine Bloom held a meeting in City Hall with
interested parties regarding the North Shore Open Space Park Extension Project. In
attendance at that meeting was Dr. Elton Gissendanner, Executive Director of the
Department of Natural Resources; and Pauline Blankenship, Land Acquisition Specialist of
the State of Florida. During the meeting, Dr. Gissendanner proposed that the North Shore •
Open Space Park and the proposed Save Our Coast Park Extension for North Shore Open
Space Park be incorporated into the State of Florida park system. The State of Florida
would manage the North Shore Open Space Park and the Park Extension down to 75th Street,
which would include the 24 lots within the North Shore Open Space Park Project which were
to be purchased, of which seven have been •approved for purchase, one is under option for
purchase and four which were considered for option at the June 3, 1986, Cabinet meeting,
• leaving 12 lots to be acquired between 77th and 79th Streets. Dr. Gissendanner's plan would
be subject to a management plan being approved by the City of Miami Beach and Board of
Trustees which would include a historical district designation for an interpretive history on
those existing residences to be acquired. The proposal would include the State of Florida
obtaining from the current property owners who wish to continue to live on their property
conservation easements/air rights which would effectually restrict the height limitation and
lot coverage on any of those existing lots. A reverter clause would be included in the
conservation easement to ensure that those property rights would be retained by the
property owners in the event that the State Park proposal was not approved.
The City of Miami Beach would have the option of creating its own historical preservation
district for those lots included in this Park expansion, or the State of Florida through the
Department of State could create a historical district for interpretive history in this project
area.
The State of Florida Park Operational Managementwould control the ingress and egress to
the North Shore Park facility. Some controlled parking for the North Shore Park would be
included west of Atlantic Way.to Collins Avenue in the overall Park Master Plan. The State
would seek some land contribution west of Collins Avenue for State Park parking purposes.
Dr. Gissendanner would propose to the Board of Trustees that the City of Miami Beach be
released from the 85 percent acquisition requirement of the purchase of the 24 lots in the
77th through 79th Streets expansion area. Additionally, Dr. Gissendanner would propose
that Blocks 7 and 10 be included in the proposed Save Our Coast Park Expansion as well as
Blocks 8 and 9, which would carry the Park Expansion down to the public library and
adjacent beach frontage at 75th Street.
ADMINISTRATIVE RECOMMENDATION
The City Administration recommends that the City Commission adopt a resolution of
approval of Dr. Elton Gissendanner's proposal-that the. North Shore Open Space
Park and the Park Extension be incorporated into the State Park System subject to the
approval of a management plan and historical preservation district being approved for this
area.
