RESOLUTION NO. 86-18676
A RESOLUTION OF THE CITY . COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE ACCEPTANCE OF A
SETTLEMENT AGREEMENT WITH THE OWNERS OF THE
PROPERTY, AND THEIR ATTORNEY MEL ENGLANDER, AND THE
APPROPRIATION OF FUNDS IN THE AMOUNT OF $518,700.00 FOR
THE ACQUISITION OF LOTS 15, 16, 17 and 18, BLOCK 51, OCEAN
BEACH ADDITION NO. 3, AS RECORDED IN PLAT BOOK 2, PAGE
81, PUBLIC RECORDS OF DADE COUNTY, FLORIDA, AT
BISCAYNE STREET AND ALTON ROAD, FOR THE ROADWAY
IMPROVEMENTS/ALTON ROAD AND BISCAYNE STREET, PHASE
II/HN-425.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, THAT:
WHEREAS, the City Commission authorized the Administration to proceed with
negotiations for the right-of-way realignment at Biscayne Street and Alton Road to ease the
left-hand turn at that intersection; and
WHEREAS, the City Manager and the City Attorney, through their staffs or
through special counsel, were authorized by the City Commission to acquire said lots by
pruchase, donation, or through eminent domain proceedings; and
WHEREAS, the City Administration has negotiated the purchase price of
$518,700.00 for Lots 15, 16, 17 and 18, Block 51, Ocean Beach Addition No. 3, as recorded in
Plat Book 2, Page 81, Public Records of Dade County, Florida; and
WHEREAS, the City Commission finds, determines and declares that it is
necessary to confirm the site selection of the above-described property and to acquire fee
simple title to such property for use in connection with the Roadway Improvements at Alton
Road and Biscayne Street, Phase II/HN-425; and
WHEREAS, the City Commission, finds determines and declares that the
acquisition of the above-described property is a public necessity and is necessary, practical
and in the best interest of the City of Miami Beach; and
WHEREAS, the funding for this project is to be taken from the $9.8 million South
Pointe Infrastructure Bond Issue Fund 357 to be placed in Work Order No. 2938.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, THAT:
1. The recommendation of the City Manager and staff as to the purchase
price of $518,700.00 for Lots 15, 16, 17 and 18, Block 51, Ocean Beach Addition No. 3, as
recorded in Plat Book No. 2, Page 81, Public Records of Dade County, Florida for the
Roadway Improvements/Alton Road and Biscayne Street Phase II/HN-425 is hereby accepted

2. The funds in the amount of $518,700.00 are available in the $9.8 million
South Pointe Infrastructure Bond Issue Fund 357 in Work Order No. 2938.
PASSED and ADOPTED this 19th day of November 1986.
