A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING
THE CRITERIA ESTABLISHED BY THE COMMUNITY
AFFAIRS COMMITTEE TO EVALUATE REQUESTS FOR
THE ACCEPTANCE OF MONETARY DONATIONS IN
CONSIDERATION FOR THE NAMING OF PUBLIC
FACILITIES AND THE INTERIOR PORTION OF A PUBLIC
FACILITY OR A PLAZA.
WHEREAS, the Mayor and City Commission, at its June 9, 1999 meeting, referred a request
to the Community Affairs Committee to establish criteria for the acceptance of monetary donations
in consideration for naming public facilities and the interior portion of a public facility or a plaza;
and
WHEREAS, the Community Affairs Committee was created by Resolution No. 98-22693
on March 18, 1998, and is designated to review and make recommendations on requests of this
nature; and
WHEREAS, there is currently no established criteria for the review and approval of said
requests; and
WHEREAS, the Community Affairs Committee, at its regular meeting of February 24,
1999, voted to approve the attached criteria, to be used to evaluate requests for the acceptance of
monetary donations in consideration for the naming of public facilities.
NOW, THEREFORE, BE IT RESOL VED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein accept the criteria established by the Community Affairs Committee, and
attached hereto as Exhibit "A", to evaluate requests for the acceptance of monetary donations in
consideration for the naming of public facilities and the interior portion of a public facility or a plaza.

CRITERIA ESTABLISHED BY THE COMMUNITY AFFAIRS COMMITTEE ON
FEBRUARY 24.1999. TO EVALUATE REQUESTS FOR THE ACCEPTANCE OF
MONETARY DONATIONS IN CONSIDERATION FOR NAMING OF PUBLIC FACILITIES
(COLLECTIVEL Y, THE PUBLIC FACILITY)
1. A fair market value appraisal shall be obtained by the donor to establish the value of the
public facility and/or the interior portion ofthe public facility or plaza. The City department
that has jurisdiction over the public facility will oversee and have input in the selection for
the appraiser.
2. Donations must be proportionate to the relative value of the public facility. A minimum
donation shall be required for the naming of a public facility. The City department having
jurisdiction over the facility will establish the minimum donation necessary for the naming.
In doing so, the location, size and visibility of the public facility must be considered.
Donations can be accepted for rooms, or portions of public facilities, however, a separate list
should be created with the dollar value associated with each level of donation.
3. The Community Affairs Committee must consider the appropriateness of the donor prior
to recommending acceptance of the donation. A public facility will not be named after an
individual who has committed an illegal act which became known to the City before or
after the donation.
4. Fundraising groups may make non-binding recommendations to the appropriate City
department( s).
5. A separate account shall be established for each public facility. The account may be used
for the purchase of equipment, services etc. All expenditures shall be strictly in
accordance with any special terms or conditions attached to the donation. No money shall
be expended from the account except in compliance with each special term or condition
under which such money was accepted.
6. Certain public facilities are so significant that they should be excluded from the above
criteria, e.g., City Hall.
7. Terms for future donations should address the present value of future pledges for donations.
F or example a pledge of $1 million today will be worth considerably less in twenty (20)
years and the building would be "under contract during that time".
8. Potential recognition may include but not be limited to buildings, floors, wings, and rooms
of building, parks, athletic fields, walkways, gardens, all other indoor and outdoor
structures, objects and spaces or other areas.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
BACKGROUND
On February 3, 1999, the City Commission referred an item to the Community Affairs Committee
for review and discussion regarding naming public facilities and the interior portion of a public
facility or a plaza after individuals or corporations in return for monetary donations.
At its February 24, 1999 meeting, the Community Affairs Committee discussed the issue. The
Committee agreed that although the referral indicated that the policy be proposed for fundraising for
the North Beach Youth Center, the donation policy should apply to all publicly-owned property. The
Committee discussed basic parameters and criteria for accepting donations. All members of the
Committee agreed that the policy for accepting donations in consideration for naming public
facilities and the interior portion of a public facility or a plaza should follow a procedure similar to
the current policy in the City Code on naming public facilities and streets.
At the June 9, 1999 City Commission meeting, an Ordinance was presented to the Commission
amending Chapter 82 of the City Code to create guidelines for the acceptance of monetary donations
in consideration for the naming of public facilities and the interior portion of a public facility or a
plaza. The Ordinance was approved on first reading and is before the Commission today for second
and final reading.

The Ordinance states that proposals shall first be presented to the Community Affairs Committee
for review and recommendation. The Community Affairs Committee (Committee) shall review
proposals in accordance with established selection criteria. If approved, the proposal will then be
presented to the entire City Commission at a public hearing.
ANALYSIS
This Resolution serves to establish selection criteria for the Committee to use when reviewing
proposals.
The proposed guidelines will apply to all donations received by the City in consideration for the
naming of public facilities, the interior portion of public facilities, and plazas. (The interior portions
of parks - such as baseball diamonds, athletic fields and ice skating rinks, etc., shall be defined as
the interior portion of a public facility.)
Criteria:

CONCLUSION
The criteria established by the Community Affairs Committee to evaluate requests for the acceptance
of monetary donations in consideration for the naming of public facilities and the interior portion
of a public facility or a plaza should be approved by the City Commission in order to provide
guidelines for the Committee.
