A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY OF MIAMI BEACH TO
ACT AS NON-FEDERAL SPONSOR TO MOUNT SINAI MEDICAL CENTER OF
FLORIDA, INC. ("MOUNT SINAI"), IN ORDER FOR MOUNT SINAI TO APPLY
FOR FEDERAL EMERGENCY MANAGEMENT AGENCY FUNDING, AS
REQUIRED BY APPLICABLE GRANT RULES, IN CONNECTION WITH MOUNT
SINAI'S RESILIENCY PROJECT TO HARDEN AND RAISE CRITICAL
INFRASTRUCTURE SYSTEMS AND STRUCTURES AT THE HOSPITAL
CAMPUS, SUBJECT TO MOUNT SINAI INDEMNIFYING THE CITY OF MIAMI
BEACH FOR ANY COSTS AND EXPENSES IN CONNECTION WITH THE CITY
OF MIAMI BEACH ACTING AS THE NON-FEDERAL SPONSOR FOR THE
RESILIENCY PROJECT.
WHEREAS, Mount Sinai Medical Center of Florida, Inc. ("Mount Sinai") is the only hospital
and emergency service provider on the barrier island of the City of Miami Beach; and
WHEREAS, Mount Sinai has developed a Resiliency Master Plan comprised of multiple
individual elements to protect its campus facilities and mitigate any damage from storm surge,
seawater intrusion, windstorm damage, and flooding ("Resiliency Master Plan"); and
WHEREAS, in connection with its Resiliency Master Plan, Mount Sinai is seeking funding
from the Federal Emergency Management Agency ("FEMA") to be used for a resiliency project to
raise and make more resilient Mount Sinai's critical systems and structures, which will harden
critical Mount Sinai structures, and improve elevation and drainage of access roads, emergency
power systems, HVAC, and other critical systems (the "Resiliency Project"); and
WHEREAS, in order to qualify for FEMA assistance for the Resiliency Project, FEMA has
advised Mount Sinai that Mount Sinai would require a non-Federal government agency ("Non-
Federal Sponsor") to sponsor Mount Sinai, such as the City of Miami Beach, in connection with
the Resiliency Project; and
WHEREAS, the Administration was contacted by the leadership of Mount Sinai regarding
their hope of submitting their Resiliency Project for a Federal legislative appropriation; and
WHEREAS, the deadline for Mount Sinai's submission of an application for FEMA
assistance was March 8, 2021; and
WHEREAS, on March 5, 2021, the City, via LTC No. 092-2021, notified the Mayor and
Commission of the City's intent to act as Non-Federal Sponsor for Mount Sinai in connection with
Mount Sinai's efforts to receive FEMA assistance for the Resiliency Project, and further advised
the Mayor and Commission that the Administration intends to present an after the fact resolution
at the March 17, 2021 Commission meeting; and
WHEREAS, LTC No. 092-2021 further provided that in the event the Mayor and
Commission does not adopt this Resolution, the City would withdraw its sponsorship for the
Resiliency Project; and
WHEREAS, on March 8, 2021, Mount Sinai provided the City of Miami Beach with a Letter
of Indemnity, whereby Mount Sinai agreed to indemnify and hold harmless the City from all
claims, liabilities and costs of any kind that the City may incur as a result of or in connection with
the City of Miami Beach serving as the Non-Federal Sponsor for the Resiliency Project; and
WHEREAS, the Administration recommends that the Mayor and City Commission
approve this Resolution.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby adopts this Resolution and authorizes the City of Miami Beach to act as Non-
Federal Sponsor to Mount Sinai Medical Center of Florida, Inc. ("Mount Sinai"), as required by
applicable grant rules, in order for Mount Sinai to apply for Federal Emergency Management
Agency funding in connection with Mount Sinai's Resiliency Project to harden and raise critical
infrastructure systems and structures at the hospital campus, subject to Mount Sinai indemnifying
the City of Miami Beach for all costs and expenses in connection with the City of Miami Beach
acting as Non-Federal Sponsor for the Resiliency Project.

ANALYSIS

CONCLUSION
The Administration requests the Mayor and City Commission adopt the Resolution and
authorize the City of Miami Beach to act as Non-Federal Sponsor to Mount Sinai, as required by
applicable grant rules, in order for Mount Sinai to apply for Federal Emergency Management
Agency funding in connection with Mount Sinai's Resiliency Project to harden and raise critical
infrastructure systems and structures at the hospital campus. Mount Sinai, in return will indemnify
the City of Miami Beach for all costs and expenses in connection with the City of Miami Beach
acting as Non-Federal Sponsor for the Resiliency Project.
