SUBJECT: Status update of the completion of Lifeguard Tower Replacement and
Refurbishment.

The purpose of this LTC is to provide an update to the Mayor and City Commission on progress
in completing the replacement and refurbishment of the City's Lifeguard Towers. During the
November 19, 2014 Commission Meeting, an item was brought to the Board requesting approval
to negotiate with the lowest responsive, and responsible bidder to ITB 2014-385-YG, and if
unable to successfully negotiate with the lowest bidder, the City Manager shall direct the
Administration to negotiate with the second lowest and responsive bidder to the ITB.
On December 3, 2014, a negotiation meeting was held with ABC Construction Inc. An
alternative proposal was requested to provide six (6) prototypes by March 23, 2015, and to
include a price to provide the remaining 23 with an appropriate schedule. Per this meeting, a
revised proposal was received by the City on December 5, 2014; however it showed the ability to
only provide three (3) prototypes at an amount higher than the original bid. On December 9,
2014 an impasse was declared.
On December 10, 2014, a negotiation meeting was held with AARYA Construction & Design, Inc.
(second lowest bidder). Similarly to what was requested of ABC Construction, a revised proposal
of providing six (6) prototypes by March 23, 2015, and include a price to provide the remaining
23 with an appropriate schedule was requested. Per this meeting, a revised proposal was
received by the City on December 15, 2014, however the Contractor proposed the use of
tempered glass instead of impact glass, and proposed to use "any" certified wood instead of the
specified FSC certified wood. The revised pricing was still in excess of the originally submitted
bid and on December 17, 2014 an impasse was declared.
Due to unsuccessful negotiations with the two (2) bidders, and as further approved by
Commission, the City Manager directed the Administration to secure a contractor to refurbish all
29 existing towers. On December 19th, staff met with Hartzell, P&P Contracting, and Inclan
Painting to review the scope of requested services. On Monday December 22nd, the City
received quotes from each of the painting contractors to which Inclan was the lowest bidder in
the amount of $43,471. CIP anticipates the painting of the towers will commence the week of
January 5, 2015.
Finally, as also directed by the City Manager, CIP remains in discussion with other entities to
establish a tower replacement program.
