LTC 007-2004 Planning Board - Mr. Melvyn Schlesser (Attorney) CITY OF MIAMI BEACH Office of the City Manager Letter to Commission No. 007-2004 To: From: Subject: Mayor David Dermer and Members of the City Commission Jorge M, Gonzalez {~ ~_ ~-'- City Manager /,~ Planning Board - Mr. Melvyn Schlesser (Attorney) Date: January 13, 2004 Pursuant to the City Code Sec 2-22 (5) board members terms are two years, commencing on January 1, and expiring on December 31; the City Code further establishes a term limit of six consecutive years for board members appointed by the City Commission as a whole ("at-large appointees"). Appointments to the Planning Board are "at-large." In January 1998, Melvyn Schlesser was appointed to the Planning Board for a term of one year. He was reappointed to this Board for a two year term commencing on January 1, 1999 and expiring December 31,2000; in January 2001, he was reappointed to a two year term expiring on December 31, 2002; finally, he was reappointed in January, 2003 for a two year term expiring on December 31,2004. The City Attorney's Office has confirmed that in light of these facts and the relevant City Code section 2-22(5), as of December 31,2003, Mr. Schlesser has served his term limit of six consecutive years, thus leaving a vacancy on the Planning Board for the unexpired term of one year (commencing on January 1, 2004 and expiring on December 31, 2004).
