2003-25376 ResoRESOLUTION NO. 2003-25376 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND OFFICIALLY ADOPTING THE BISCAYNE POINT NEIGHBORHOOD BASIS OF DESIGN REPORT (BODR) AND ADDENDUM NO. '1, WHICH DEFINES AND DESCRIBES G.O. BOND, WATER AND SEWER BOND, AND STORMWATER BOND FUNDED CAPITAL IMPROVEMENTS TO BE IMPLEMENTED THROUGH THE BISCAYNE POINT RIGHT OF WAY IMPROVEMENT PROJECT. WHEREAS, the City has issued General Obligation (G.O.) Bonds and Water and Wastewater Revenue Bonds, to provide funding for a number of needed capital projects to be constructed in various areas of the City to upgrade and improve the infrastructure for the purpose of providing better service to residents and visitors; and WHEREAS, funding allocated for construction of improvements in the Biscayne Point Neighborhood includes $1,275,250 in Series 2000 Water and Sewer Bond funds; $4,150,000 in G.O. Bond funds, and $1,767,321 in Stormwater Bond funds; and WHEREAS, The Corradino Group was selected as the successful proposer, pursuant to Request for Qualifications (RFQ) No. 10-00/01 for Urban Design, Landscape Architecture and Engineering Services for the Biscayne Point Right-of-Way Improvement Project; and WHEREAS, pursuant to Resolution No. 2002-24822, adopted by the Mayor and City Commission on April 10, 2002, the Mayor and City Clerk executed an Agreement between the City and The Corradino Group to provide professional services for the Biscayne Point Right-of-Way Improvement Project for urban design, landscape architecture and engineering services for the planning, design, preparation of construction documents, assistance with bidding, and construction administration, in the amount of $90,512; and WHEREAS, The Corradino Group and City staff have undertaken a professional and comprehensive planning effort to identify and describe improvements in the Basis of Design Report (BODR); and WHEREAS, two Community Design Workshops were held to obtain input from residents and property owners with regard to the proposed improvements, and general consensus in support of the proposed improvements was obtained; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve and officially adopt the Biscayne Point Neighborhood Basis of Design Report (BODR) and Addendum No. 1, defining and describing Water and Sewer Bond, G.O. Issue: Should the City adopt the Biscayne Point Basis of Design Report (BODR) and Addendum #1, prepared byThe Corradino Group and City staff, as the officially approved description of capital improvements to be designed and constructed through the Biscayne Point Right of Way Improvement Proiect? Item Summary/Recommendation: On April 10, 2002, the City entered into an agreement with The Corradino Group (the Consultant) to provide for Planning Phase services for the Biscayne Point ROW Right of Way Improvement Project. The Consultant and City staff initiated a comprehensive planning process that included a review of historic information, neighborhood site visits, and inter-departmental staff and consultant visioning sessions. The Consultant then developed an initial program of recommended improvements presented at a Community Design Workshop (CDW #1 ) on Sept. 19, 2002 at the Lehrman Day School. Public comment and feedback from this forum was analyzed and incorporated where appropriate in a revised plan, which was presented at a second Community Design Workshop (CDW #2) on January 9, 2003. At CDW #2, a substantial consensus was achieved among residents on the recommended improvements. The BODR was prepared by the Consultant, carefully reviewed by all applicable City Departments and refined as necessary, including Addendum #1 which was requested by staff to correct errors and omissions in the final draft of the report. At the GO Bond Oversight Committee meeting where the BODR was considered, the Biscayne Pointe Island Homeowner's Association requested an increase in the number of acorn lighting fixtures, with funding to be reallocated from deleting the milling and resurfacing of streets in the sub-neighborhood. Residents of Biscayne Beach requested a greater share of the available funding, due to what they perceive as a greater need for improvements in the multi-family area, particularly with regard to drainage. Subsequent to the G.O. Bond Committee recommendation, the Administration held a meeting with representatives of the Biscayne Pointe Island Homeowners Association and achieved consensus to accept the Consultant's and the Administration's recommendation for lighting and repaving. The GO Bond Oversight Committee concurred with the staff recommendation and did not accept the Biscayne Beach request to reallocate funding from other neighborhoods to them. The next step is for the City Commission to approve the BODR and Addendum #1, which will then serve as a basis for the preparation of construction drawings for recommended improvements. Advisory Board Recommendation: On August 4, 2003, the BODR and Addendum #1 were approved by the GO Bond Oversight Committee, with the following amendment: delete $163,630 for repaving roadways and reallocate those funds to the decorative acorn lighting budget. This Basis of Design Report (BODR) has been reviewed by City staff from all relevant Departments and refined as necessary, including Addendum #1 which was requested by staff to correct errors and omissions in the final draft of the report. The next step is for the City Commission to approve the BODR and Addendum #1, which will then serve as a basis for the preparation of construction drawings for recommended improvements. Neighborhood Description The Biscayne Point neighborhood is entirely residential in land use, and includes two neighborhood parks. It consists of three sub-neighborhoods with varying needs and funding sources. Therefore, the improvement plan is subdivided into three sub-plans based on the needs of the sub- neighborhoods of Biscayne Pointe Island, a peninsular island of single family homes which has a gated entry one block west of the intersection of 77th Street and Hawthorne Avenue; Stillwater, a peninsula of single family homes with a gated entry located west of 85th Street and Stillwater Park; and Biscayne Beach, an island bounded to the east and south by Tatum Waterway, to the north by Biscayne Bay, and to the west by a canal and Biscayne Bay. Biscayne Beach consists of predominantly multi-family residential uses, with a number of single family homes located west of Hawthorne Ave. and north of 86th Street. Background On April 10, 2002, the Mayor and City Commission approved the professional services agreement, pursuant to Request for Qualifications (RFQ) No. 10-00/01, with The Corradino Group (the Consultant) for Planning Phase services for the Biscayne Point ROW Improvement Project. The total cost for the Planning Phase was $90,512, with $69,703 from Series 2000 General Obligation Bonds, $3,358 from Water and Sewer Bonds, and $17,451 from the Stormwater Bond Fund. Biscayne Point BODR October 15, 2003 Page 2 of 7 The Consultant's Notice to Proceed was given on June 10, 2002 and the Project Kick-off Meeting was held on the same day. The official onsite reconnaissance meeting with City staff and Program Managers, Hazen and Sawyer, was held on June 17, 2002. Using information gathered from these meetings, as well as resident input collected at Biscayne Point GO Bond meetings held previously during the spring of 2000, the Consultant developed an initial program of recommended improvements. On August 23, 2002, the Consultant presented this program to City staff for comment and further development. On September 19, 2002, a revised program was presented at Community Design Workshop (CDW)#1 held at Lehrman Day School. Public comment and feedback from this forum was analyzed and incorporated into the plan, where appropriate. In addition, the Project Team held individual meetings with each of the sub-neighborhood homeowner's associations and conducted several more site visits. This revised program was presented at CDW #2 on January 9, 2003. At this meeting, a substantial consensus was achieved among residents on recommendations related to the GO Bond improvements. However, the following issues were identified for further study. The Biscayne Pointe Island Homeowner's Association (HOA) requested an increase in the number of fixtures in the proposed pedestrian scale lighting system by reducing the spacing between fixtures. In order to cover the increased cost for light fixtures, the HOA proposed that the milling and resurfacing of asphalt pavement should be deleted from the Project. Subsequently, the Public Works Department conducted testing and analysis of the condition of the pavement and concluded that milling and resuffacing of the island's streets will be necessary. This issue was resolved in later meetings between the Administration and the HOA, which resulted in the HO^ agreeing to accept the Consultant's and the Administration's recommendation for the BODR. The Stillwater Drive Homeowner's Association requested additional enhancements to the entrance area near the guardhouse. There is a total of $23,640 recommended in the BODR for landscaping, lighting and sign enhancement for this entrance. However, some of the residents feel this is not sufficient and would like a more elaborate entrance design with masonry walls, brick pavers and other amenities. Residents were informed that the consultants will work with them during the design phase of the project to achieve the best possible design within the available budget. Residents of Biscayne Beach requested a greater share of the available funding, due to what they perceive as a greater need for improvements in the multi-family area, particularly with regard to drainage. The response from consultants and staff was that the funding for drainage and water and sewer improvements was directly linked to priorities developed in the citywide master plans. Water and Stormwater Bond funding cannot be expended outside of areas that meet these priority criteria, thus stormwater improvements in the Biscayne Beach sub-neighborhood are targeted for the area north of 83r~ Street. In addition, residents were advised that since the GO Bond funding allocation for Biscayne Point was presented as a single line item in the bond issue, funding was roughly allocated between the three sub- neighborhoods based upon a ratio of linear feet of roadway. This is the same method that has been implemented in other neighborhoods throughout the City where the bond line item was allocated for an entire area with mixed residential uses and sub-neighborhoods. On March 21, 2003, the Consultant submitted a draft BODR, representative of the culmination of planning efforts. The initial draft went through several revisions to address comments by City staff and the Program Managers, Hazen and Sawyer. On July 18, 2003, the Consultant submitted the (Draft Final) BODR. A review of that document revealed a number of minor errors and omissions that Biscayne Point BODR October 15, 2003 Page 3 of 7 did not warrant a full reprinting of the document; therefore, the ClP Office requested the Consultant to prepare Addendum No. 1. The Addendum, submitted August 15, 2003, addresses the remaining comments from City staff and Hazen and Sawyer. Basin 142 encompasses all of the land north of 83rd Street, including Stillwater Drive. This priority basin was not funded dudng the bonding process. However, the City has recently completed a citywide stormwater funding analysis that allowed it to identify a sufficient amount of funding for the necessary drainage improvements. These funds can only be expended within the confines of the pdodty drainage basin. Residents have expressed dissatisfaction with the lack of stormwater funding for the remaining parts of the neighborhood, with particular emphasis on flooding near the intersection of Crespi Blvd. and 81st Street. Water Distribution System The City of Miami Beach Water System Master Plan identifies neady 400' of cast iron pipe (priority 1) that is in need of replacement. Similarly, the Master Plan identifies approximately 5,800 linear feet of existing galvanized mains (priority 2) and cast iron (priority 3 aged cast iron) mains throughout the neighborhood that have been corroded over time and reached the end of their useful life. The Consultant estimates that the total construction cost for water lines will be $748,897. It must be noted that a portion of the water line improvements were not funded sufficiently dudng the bonding process. However, the City has recently completed an analysis that allowed it to identify $1,075,250 for improvements, including contingencies and "soft" costs. Streetscape Improvements G.O. Bonds are used for above-ground streetscape improvements that were developed from the priorities expressed bythe neighborhood. In general, the streetscape effort focused on landscaping, lighting, and traffic calming. Improvement options dealt with enhancing the character of the area by providing shade trees, making the area pedestrian friendly with bulbouts, crosswalks and wider sidewalks, and maintaining the current availability of parking. In addition, project work schedules will be planned in coordination with the City's desire to evenly distribute construction throughout the north, mid and south beach portions of the city, along with other ongoing construction projects in North Beach. As a result, construction will not begin before October of 2005. Residents have voiced opposition to this implementation timeline, requesting that construction in the Biscayne Pointe neighborhood commence as soon as possible. In response, staff has noted that the ROW Program attempts to schedule an equivalent amount ongoing construction in each of the three Miami Beach districts (north, mid and south) so as to prevent too much construction affecting one area at the same time. Since multiple ROW projects will already be ongoing in the North Beach area, the proposed implementation schedule offers the requisite timing required to coordinate projects in the North Beach area. GO Bond Oversight Committee Recommendation The BODR was transmitted to members of the G.O. Bond Oversight Committee on July 18, 2003. On the same date, the BODR was posted on the City's website, and neighborhood residents were notified that the BODR was available for review and comment. The Corradino Group presented the BODR to the G.O. Bond Oversight Committee at their meeting on August 4, 2003. A number of residents testified during the meeting; and generally, their comments were similar to those expressed in the second CDW. While in general agreement with the majority of planned improvements, there was disagreement on the amount of funding allocated to the Biscayne Beach sub-neighborhood and the lighting on Biscayne Pointe Island. The greatest number of comments came from Biscayne Pointe Island residents who want the repaying of the streets to be deleted from the GO Bond funding in order to increase the budget for acorn lighting. After much discussion, the G.O. Bond Oversight Committee voted to support the Biscayne Pointe Island residents' request to delete $163,630 for repaving roadways from the G.O. Bond budget and to reallocate those funds to the decorative acorn lighting budget. On September 22, 2003, the CIP Office and Program Manager held a meeting with representatives of the Biscayne Pointe Island Homeowners Association to discuss the lighting issue. As a result of that meeting, the residents gained a more complete understanding of the minimum lighting standard, and agreed to accept the Consultant's and the Administration's recommendation for the BODR. The BODR recommendation of the consultant which is now supported by the Homeowners Association is for the installation of a pedestrian-scale lighting system with light fixtures staggered every 100' on-center. The lighting system recommended by Corradino and the Administration, combined with the existing overhead cobra lights, meets the City standard for residential neighborhoods for an average of 0.60 foot-candles. The additional "acorn" lights requested by the community would have decreased the spacing to approximately 80' to 85' staggered and the foot- candles would be estimated to increase to an average of + 0.75. Both options contemplate the overhead cobra lights remaining. Staff's recommendation is based on the premise that both the minimum lighting standard would be met, as well as milling and resurfacing within the available budget. It should be noted that "acorn" fixtures may be replaced by another style of fixture with Biscayne Point BODR October 15, 2003 Page 7 of 7 similar height (-12 ft.) and photometric performance, depending upon a pending decision to standardize fixtures Citywide. CONCLUSION The Administration recommends approval of the Biscayne Point BODR as submitted, including Amendment No. 1 which corrects a number of minor errors and omissions in the final report. The Administration does not support the amendment recommended by the G.O. Bond Oversight Committee to delete the roadway repaying in favor of additional acorn lighting. This is due to the fact that The Corradino Group believes the minimum lighting standard (average of 0.6 foot candles) for single family neighborhoods will be met by the odginal lighting plan with approximate 100-feet staggered spacing; and because testing and analysis of the condition of the pavement indicates that the existing pavement will be near the end of its useful life by the time the project is completed, thus milling and resurfacing of the island's streets is necessary. By approving the BODR, the City will officially end the planning process for this neighborhood and finalize the design concept. It is important to note that negotiations are currently ongoing with the Corradino Group for remaining design, bid, award and construction management services for this neighborhood. Once completed, the preparation of formal construction drawings will commence.
