AMENDMENT NO. 1
INDEPENDENT CONTRACTOR AGREEMENT BETWEEN
THE CITY OF MIAMI BEACH, FLORIDA AND JONATHAN ANDRE
THIS Amendment No.1 to the Independent Contractor Agreement ("Agreement")for
the Miami Beach Math Intervention and Tutoring Programs dated February 16, 2021,
between the City o f Miami Beach, Florida, a municipal corporation existing under the laws
of the State of Florida (the "City") and Jonathan Andre, ("Contractor") is made and entered

RECITALS
WHEREAS, on April 11, 2018 the Mayor and City Commission adopted Resolution
Number 2018-30259 to implement educational enhancements in the City's public schools; and
WHEREAS, on April 22, 2018, pursuant to Resolution No. 2018-30259, the following
educational enhancements were approved for funding and implementation: Extracurricular after-
school activities for Biscayne Beach Elementary School and Miami Beach Fienberg Fisher K-8;
reading interventionists during school hours at North Beach Elementary School, Miami Beach
South Pointe Elementary School, and Miami Beach Nautilus Middle School; math interventionists
during school hours at Miami Beach Nautilus Middle School and Miami Beach High School; and
expanded mental health services at all public elementary and middle schools in Miami Beach;
and
WHEREAS, on January 13, 2021, the Mayor and City Commission adopted Resolution
No. 2021-31562, amending Resolution 2018-30259 to approve the afterschool mathematics
tutorial program at Miami Beach Senior High School and Miami Beach Nautilus Middle School for
the 2020-21 school year and subsequent school years, subject to funding appropriation and
approval during the City's budgetary process for each school year, in an amount not to exceed
$15,000; and
WHEREAS, on February 16, 2021,the City and the Contractor entered into an Agreement
for educational math intervention services for children between Grades 8 to 12, with an effective
starting date of February 8, 2021 and an end date of April 30, 2021; and
WHEREAS, the City and Contractor wish to amend the Agreement with the Contractor to
extend the effective date of this contract to May 28, 2021.
NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises,
covenants, agreements, terms, and conditions herein contained, and other good and valuable
consideration, the respect and adequacy are hereby acknowledged, the City and Contractor do
agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this
Amendment No. 1.

2. MODIFICATIONS
The Agreement is hereby amended (deleted items struck through and inserted items
underlined) as follows:
a) The first paragraph of the Agreement is hereby deleted in its entirety and replaced
with the following:
This Agreement is entered into on this 16 day of February 2021 between Jonathan Andre
("Contractor") and the City of Miami Beach, Florida (the "City"), for a period of
approximately 15 weeks during the Spring semester, with an effective starting date of
February 8, 2021 and an end date of May 28, 2021, upon written confirmation from the
City Manager to Contractor(the "Term").
b) Nothing contained herein shall amend, increase, or decrease the City Funding,
as provided in the Agreement.
3. OTHER PROVISIONS.
All other provisions of the Agreement, as amended, are unchanged.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 1 to be
executed in their names by their duly authorized officials as of the date first set forth above.
