Resolution 2021-31799 RESOLUTION NO.1 2021-31799 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO: (1) EXECUTE AN AGREEMENT WITH A CITY APPROVED CONTRACTOR TO PROVIDE A PORTION OF THE UPGRADES RELATED TO THE MIAMI BEACH SENIOR HIGH SCHOOL COURTYARD IMPROVEMENT PROJECT, FOR A TOTAL COST NOT TO EXCEED $60,000; (2) EXECUTE AN ACCESS AGREEMENT WITH MIAMI-DADE COUNTY PUBLIC SCHOOLS; AND (3) EXECUTE ANY OTHER AGREEMENT OR DOCUMENT IN CONNECTION WITH THE CITY'S CONTRIBUTION TO THE PROJECT. WHEREAS, in January 2008, the City of Miami Beach, Florida ("City") entered into an Education Compact with Miami-Dade County Public Schools (M-DCPS) to enhance learning opportunities for youth; and WHEREAS, the Education Compact reflects the desire of the Miami Beach community to support excellence in the City's public schools; and WHEREAS, the Education Compact currently addresses and supports the following priority areas: Teacher Recruitment/Retention; Communication; Parental Involvement/Family Support; Youth and Community Engagement; Health and Well-Being; Student Achievement; Safety; and Technology; and WHEREAS, Resolution 2020-31428 approved a one-time enhancement request of $60,000 for the Miami Beach Senior High School Parent Teacher Student Association (PTSA) project to renovate the school courtyard; and WHEREAS, the project consists of certain greenscape and hardscape improvements geared toward improving the feel and functionality of the M-DCPS courtyard; and WHEREAS, the Administration recommends that the Mayor and City Commission authorize the City Manager to: (1) execute a contract with a City approved contractor to perform work related to a portion of the upgrades related to the project, in the amount not to exceed $60,000; (2) execute an access agreement with M-DCPS; and (3) execute any other document or agreement which may be required relating to the City's contribution to the project. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby authorize the City Manager to: (1) execute an agreement with a City approved contractor to provide a portion of the upgrades related to the Miami Beach Senior High School courtyard improvement project, for a total cost not to exceed $60,000; (2) execute an access agreement with Miami-Dade County Public Schools; and (3)execute any other agreement or document in connection with the City's contribution to the project. RECOMMENDATION The Administration recommends that the Mayor and City Commission authorize the City Manager to: (1) execute a contract with a City approved contractor to perform work related to a portion of the upgrades related to the project, in the amount not to exceed $60,000; (2) execute an access agreement with M-DCPS; and (3) execute any other document or agreement which may be required relating to the City's contribution to the project BACKGROUND/HISTORY In January 2008, the City of Miami Beach, Florida ("City'') entered into an Education Compact with Miami-Dade County Public Schools (M-DCPS)to enhance learning opportunities for youth. , The Education Compact reflects the desire of the Miami Beach community to support excellence in the City's public schools. The Education Compact currently addresses and supports the following priority areas: Teacher Recruitment/Retention; Communication; Parental Involvement/Family Support; Youth and Community Engagement; Health and Well-Being; Student Achievement; Safety; and Technology. In September 2020, Resolution 2020-31428 approved a one-time enhancement request of $60,000 for the Miami Beach Senior High School Parent Teacher Student Association (PTSA) project to renovate the school courtyard. These funds are part of the FY2021 budget. The City will be retaining the contractor for the hardscape component of the project and will be paying the Contractor directly. City and District staff have been working to determine how best to support this project. Following months of discussions, both legal departments determined • Page 510 of 2012 that an Access Agreement would be the best approach. Per email dated July 12, 2021 from Ana Craft, Assistant School Board Attorney, the requested Access Agreement will be drafted and require School Board approval. Information regarding the scope of work, deliverables, estimated costs, etc. have been provided by the Miami Beach Senior High School Parent Teacher Association. ANALYSIS This location affects approAmately 2,300 Miami Beach youth, which is about 30% of the Miami Beach public school student population. This Resolution allows the City to (1) execute a contract with a City approved contractor to perform work related to a portion of the upgrades related to the project, in the amount not to exceed $60,000; (2) execute an access agreement with M-DCPS; and (3) execute any other document or agreement which may be required relating to the City's contribution to the project. Funding in an amount not to exceed$60,000 was approved in September 2020 per Resolution 2020- 31428. Funding is available in the FY21 budget. SUPPORTING SURVEY DATA 49.1% of residents were either very satisfied or satisfied with the quality of public schools in Miami Beach FINANCIAL INFORMATION FY 2021 $60,000 one-time enhancement budgeted per Resolution 2020-31428.
