Hudak, City Mana~ DATE: October 1, 2021 SUBJECT: Ordinance 2020-4358: One Year Update On September 16, 2020 Ordinance 2020-4358 was adopted by the City Commission. This Ordinance created a framework for roof-top, outdoor movie theaters, with accessory bars, within the CD-2 zoning district on the west side of Alton Road. A subsequent Ordinance amendment (Ordinance No. 2021- 4397, adopted on January 13, 2021) reduced the allowable boundaries for outdoor, roof-top theaters with accessory bars to the west side of Alton Road between 16 th Street and Collins Canal. At the time of adoption, the City Commission requested that a one-year look back be provided, to summarize the status of any applications made for outdoor movie theaters on Alton Road . To date only one application for an outdoor theater has been submitted; the following is a summary of the required Land Use Board approvals for this application: • On December 14, 2020, the Planning Board approved a Conditional Use Permit (CUP) for an Open-Air Entertainment Establishment, an Outdoor Entertainment Establishment, and a Neighborhood Impact Establishment, for an outdoor, roof-top movie theater at 1600 Alton Road (PB20-0377). The CUP approval was in accordance with the criteria set forth in Ordinance 2020- 4358, and included additional requirements to mitigate sound at the roof level. • On January 5, 2021 , the Design Review Board reviewed and approved the construction of the new rooftop outdoor movie theater and bar addition on the rooftop of the existing 5-story parking garage at 1600 Alton Road (DRB20-0556). The ORB approval included requirements for additional landscape planters at the roof level. On August 25, 2021, a building permit application for the build-out of this outdoor movie theater was submitted , in accordance with above noted Land Use Board approvals. The first review of the permit has been completed by all disciplines and the applicant is in the process of addressing all the outstanding comments and is expected to resubmit the permit application for review .
