Resolution 2021-31916RESOLUTION NO. 2021-31916 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING RAUL J. AGUILA'S . NOTICE OF EARLY RETIREMENT AS CITY ATTORNEY, AND . APPROVING AN AMENDMENT TO MR. AGUILA'S EMPLOYMENT AGREEMENT TO PROVIDE FOR THE CITY TO ENGAGE MR. AGUILA AS SPECIAL COUNSEL TO THE CITY, COMMENCING AS OF OCTOBER 13, 2021 THROUGH THE REMAINDER OF HIS CONTRACT TERM, EXPIRING ON MARCH 31,.2022. .WHEREAS, City Attorney Raul J. Aguila has served in the City Attorne'y's Office for Miami Beach for twenty-three (23) years as either a First Assistant City Attorney or Chief Deputy City Attorney, before being unanimously appointed by the City Commission to serve as the City Attorney in 2014; and WHEREAS, on December 9, 2020, the City Commission unanimously appointed Mr. Aguila to serve as the Interim City Manager until the term of a new City Manager commenced on April 21, 2021; and WHEREAS, on April 27, 2021, Mr. Aguila took an extended medical leave of absence; and WHEREAS, Mr. Aguila's tenure as the City. Attorney is set to end in March 2022, both as a matter of his employment contract, and the requirements of the City's Deferred Retirement Option Program ("DROP"); and WHEREAS, on August 30, 2021, Mr. Aguila submitted a letter to the Mayor and City Commission advising them of his intent for early retirement; and WHEREAS, at the October 13, 2021 City Commission meeting, .the Mayor and City Commission officially accepted Mr. Aguila's notice of early retirement; and WHEREAS, in recognition of Mr. Aguila's decades of excellent and dedicated public service, during which he served the City as City Attorney and Interim City Manager, the Mayor and City Commission hereby deem that it is in the best interest, of the City to continue to engage Mr. Aguila as Special Counsel to the City until the end of his contract term on March 31, 2022; and WHEREAS, except as specified herein with respect to Mr. Aguila's engagement as Special Counsel forthe City, all otherterms and conditions of Mr. Aguila's employment agreement shall remain unchanged and in full force and effect. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH FLORIDA, that the Mayor andl City Commission hereby accept Raul J. Aguila's notice of early retirement as.City Attorr and approve an amendment to Mr. Aguila's employment agreement, to provide for City to retain Mr. Aguila as Special Counsel to the City, commencing as of October 2021, through the remainder of his contract term, expiring on March 31,. 2022.
