Deauville Enforcement History - RAP_ 01-20-2022 CC Mtg Items R9 S, R9 T and R9 X DEAUVILLE BEACH RESORT 6701 Collins Avenue Miami Beach, Florida Enforcement History/Timeline 1 2017 April 28, 2017 - Recertification package due; owners did not comply July 19, 2017 - Stop work order issued for unpermitted electrical work July 25, 2017 - Fire; building vacated and unoccupied since then Building violation issued requiring the Deauville to submit an engineering report, signed and sealed by an electrical engineer to evaluate the cause of the fire, the extent of damage and methods of repair. September 2017 - Hurricane Irma – damage amplified by wind and water damage 2 2018 September 19, 2018 - Building Official and Planning Director determined Property had fallen into a state of disrepair thereby jeopardizing the structural and architectural integrity of the building. In accordance with 118-532(g)(1)(b), the City issued its “48 Hour Prior Notice Of Intent To Inspect Pursuant To The City’s Demolition By Neglect Ordinance. October 11, 2018 - Deauville notified of City’s findings – inspection confirmed that the property did not meet the minimum maintenance standards and place Deauville on Notice that the City would commence a demolition by neglect claim. 3 2018 - Continued Dec. 12, 2018 - Unsafe Structure Board Hearing – Board ruled that: The structure(s) are to be maintained secure, clean and sanitary, free of debris, overgrown grass or weeds and free of discoloration or graffiti. A temporary electrical power permit must be applied for within thirty (30) days of the date of the ruling. The temporary electrical permit shall be obtained within sixty (60) days from the date of the ruling. The building permit(s) to repair windows and for concrete spalling must be applied for within sixty (60) days after obtaining the temporary electrical permit, with the understanding that no work can be performed until the temporary power permit is issued. A 40-Year Recertification Report shall be submitted within one hundred twenty (120) days from obtaining the temporary electrical permit to the City of Miami Beach Building Official as required in standard form signed and sealed by a structural and electrical engineer and to obtain all necessary permits to repair and restore said structure. 4 2019 February 5, 2019 - Complaint filed seeking injunctive relief, damages for unpaid resort taxes, and the appointment of a receiver August 28, 2019 - City renews its Motion for Appointment of Receiver. Court suggests parties go to mediation. 5 2020 February 26, 2020 - Concrete failure on east façade – closed Beachwalk behind Deauville until March 27, 2020. June 26, 2020 - Initial Mediation Conference December 3, 2020 - In connection with the pending Motion for Appointment of Receiver, Court finds Deauville in violation of the Orders dated March 13, 2019 and April 1, 2019. 6 2021 March 2021 - Special Magistrate Zamora assesses the maximum daily fines ($5,000) for Deauville’s violation of the demolition by neglect ordinance. February 24, 2021 - City files its Amended Complaint seeking Injunctive Relief to Avoid Demolition by Neglect; Compliance with the Unsafe Structures Board Order; damages for unpaid utilities (resort tax obligation had been paid) and for the appointment of a receiver.  June 11, 2021 - City moves once again for the appointment of a receiver and injunctive relief (compliance with Unsafe Structures Board Order) and to take corrective action. (June 24, 2021 – collapse of Champlain Towers South). 7 2021 - Continued July 26, 2021 - Second Mediation Conference October 4, 2021 - Court orders Deauville to apply for/secure a full demolition permit on or before October 26, 2021; Orders City to provide a complete checklist for all items needed for demolition within 48 hours on or before October 6, 2021; and reserves on the appointment of a receiver; requires the City to expeditiously process the permit for total demolition; and stays the case until a final determination is made by the City. December 15, 2021 - Structural engineer report is provided to the City; reviewed by the Building Official and is declared unsafe. 8 2022 January 3, 2022 - Building Official sends inspectors to verify outside condition of building. January 14, 2022 - Building Official sends inspectors to verify inside condition of building. First time that owners consented to interior inspection by City staff since October of 2018. 9
