Resolution 2022-32004RESOLUTION NO. 2022-32004 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO PASS SENATE BILL 1208 AND ITS IDENTICAL COMPANION BILL, HOUSE BILL 883, WHICH WOULD AMEND FLORIDA STATUTES 775.085 AND 775.0863 BY SPECIFICALLY INCLUDING STATE AND LOCAL GOVERNMENTAL ENTITIES AS QUALIFYING VICTIMS OF HATE CRIMES UNDER FLORIDA LAW; AND DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE SPEAKER OF THE FLORIDA HOUSE OF REPRESENTATIVES AND THE PRESIDENT OF THE FLORIDA SENATE. WHEREAS, Florida Statute 775.085 reclassifies the offense level, which reclassification enhances the potential penalty for any felony or misdemeanor crime if the commission of such crime evidences prejudice based upon race, color, ancestry, ethnicity, religion, sexual orientation, national origin, homeless status, or advanced age; and WHEREAS, Florida Statute 775.0863 reclassifies the offense level, which reclassification enhances the potential penalty, for any felony or misdemeanor crime if the commission of such crime evidences prejudice based upon a mental or physical disability; and WHEREAS, presently under Florida law, Offices of the State Attorney throughout the State of Florida ("State") are unable to pursue hate crime reclassification enhancements against alleged offenders when acts of hate are perpetrated against public property or governmental entities because presently State and local governments are not designated as victims of hate crimes pursuant to Florida Statutes 775.085 and 775.0863; and WHEREAS, Senate Bill 1208, which is sponsored by Florida Senator Tina Polsky, and its identical companion bill, House Bill 883, which is sponsored by Florida House Representative Emily Slosberg-King, seek to specifically include State and local governmental entities as qualifying victims of hate crimes, if such State or local governmental entity owns property that is defaced, damaged, or destroyed based upon the perpetrator's prejudice against a person or group identified in Fla. Stat. 775.085 or Fla. Stat. 775.0863; and WHEREAS, as set forth in the declaration of purpose and policy of the City's Human Rights Ordinance, which is codified in Section 62-33 of the City Code, "prejudice, intolerance, bigotry, discrimination and disorder occasioned thereby threaten the rights and proper privileges of its inhabitants and menace the very institutions, foundations and bedrock of a free, democratic society;" and WHEREAS, the Mayor and City Commission hereby declare their strong support for Senate Bill 1208 and House Bill 883 because the City of Miami Beach prides itself on being a diverse and inclusive community that has long demonstrated a history of opposing discrimination in any and all forms. NOW, THEREFORE, BE. IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the City Commission hereby urge the Florida Legislature to pass Senate Bill 1208 and its identical companion bill, House Bill 883, which would amend Florida Statutes 775.085 and 775.0863 by specifically including State and local governmental entities as qualifying victims of hate crimes under Florida law; and directing the City Clerk to transmit a copy of this Resolution to the Speaker of the Florida House of Representatives and the President of the Florida Senate.
