Resolution 2022-31992RESOLUTION NO. 2022-31992 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE ART IN PUBLIC PLACES COMMITTEE AND APPROVING NORMAN BRAMAN'S GENEROUS DONATION OF ARTIST JAUME PLENSA'S MONUMENTAL SCULPTURE, MINNA, FOR INSTALLATION IN PRIDE PARK. WHEREAS, the Art in Public Places Ordinance (No. 95-2985) was adopted in 1995 and was created to "enhance the aesthetic environment of the City of Miami Beach by including works of art on public property within the City and in City construction projects;" and WHEREAS, as provided in Sec. 82-562 "Powers and Duties" of the Art in Public Places Committee, the Art in Public Places Committee shall recommend to the City Commission the placement of proposed donations of works of art for placement on public property in the city; and WHEREAS, proposed donations, monuments, memorials, or plaques undergo a review process to ensure that acceptance of such donations take place in a fair and uniform manner that supports the criteria set forth by the City Commission; and WHEREAS, the Art in Public Places Committee assists in the process relative to any donation of work of art to be accepted by the City for placement on public property in the City or located on public facilities within the City; and WHEREAS, on November 23, 2021, Richard Gray Gallery (Chicago), on behalf of the donor Norman Braman, presented to the City's Art in Public Places Committee the proposed artwork, Jaume Plensa's Minna (2022); and WHEREAS, following a presentation of the proposed work by artist Jaume Plensa and upon reviewing the required submission materials,.the Art.in Public Places Committee made.a unanimous motion to accept the work as part of the City of Miami Beach Art in Public Places Collection and further recognize the generosity of Mr. Norman Braman in gifting this monumental work of public art to the city of Miami Beach. RECOMMENDATION Accept the recommendation of the Art in Public Places Committee. BACKGROUND/HISTORY The Art in Public Places Ordinance (No. 95-2985) was adopted in 1995 and was created to "enhance the aesthetic environment of the City of Miami Beach by including works of art on public property within the City and in City construction projects." On September 11, 2019, the Art in Public Places Ordinance was amended to increase the amount to be appropriated to the Art in Public Places fund from not less than 1.5%, to not less than 2% of the construction cost of city construction projects and joint public /private developments; amend the dollar threshold of city construction projects from $500,000 to $250,000, for projects subject to the provisions of Art in. Public Places; amend the definition of City construction projects; amend applicable projects to include management agreements for City -owned buildings or facilities having a term of ten (10) years or more; and amend consideration of a waiver of the required AiPP appropriation to require a resolution approved by 5/7th vote of the City Commission The goals of the AiPP program are: overseeing the Citys public art collection; enhancing the physical environment of Miami Beach with artworks of the highest level of quality and suitability for the site; serving as the coordinating body for all public art projects on City property; building partnerships with the private sector, non-profit and community groups that connect the AiPP projects to the life of the City; encouraging participation by artists based locally, nationally and intemationally; and serving as a source of information about public art. As provided in Sec. 82-562 "Powers and Duties" of the Art in Public Places Committee, the Art in Public Places Committee shall recommend to the City Commission the placement of proposed donations of works of art for placement on public property in the city. Proposed donations, monuments, memorials, or plaques shall undergo a review process to ensure that Page 418 of 1313 acceptance of such donations take place in a fair and uniform manner and supports the criteria set forth by the City Commission. AiPP shall assist in the process relative to any donation of work of art to be accepted by the City for placement on public property in the City or located on public facilities within the City, including monuments, memorials, busts and other art work. ANALYSIS On November 23, 2021, Richard Gray Gallery (Chicago), on behalf of the donor Norman Braman, presented to the City's Art in Public Places Committee the proposed artwork, Jaume Plensa's Minna (2022). In considering the work, the Art in Public Places Committee reviewed the following criteria, as fully presented in Exhibit A: 1. Photographs of proposed work Images of the proposed work are referenced in the attached Exhibit A, pages 18-22. The artwork is currently in production and is expected to be completed in 2022. 2. Artist Resume Over the past thirty-five years, internationally celebrated Spanish artist Jaume Plensa (b. 1955) has produced a multifaceted body of work creating sculpture that speaks to the capacity and beauty of humanity. Conventional sculptural materials like glass, steel, and bronze blend with unconventional media such as water, light, and sound to create hybrid works of intricate energy, psychological weight, and symbolic richness. . Jaume Plensa has received many national and international awards including the Honorary Doctorate from Universitat Autonoma de Barcelona in 2018 and the 2013 Velazquez Prize awarded by the Spanish Cultural Ministry. His solo museum exhibitions include MMOMA— Moscow Museum of Modem Art, Moscow, Russia; Museo Nacional Centro de Arte Reina Sofia, Madrid, Spain; MAMC—Musee d'art modeme et contemporain Saintl�tienne Metropole, Saint-I=tienne, France; Max Ernst Museum Bruhl des LVR, Bruhl, Germany; Yorkshire Sculpture Park, Yorkshire, England; and Nasher Sculpture Center, Dallas, Texas. He lives and works in Barcelona. 3. Project Description Minna, the proposed donation to the City of Miami Beach, is a monumental sculpture composed of marine grade stainless steel, measuring approximately 17'x 17'x 12'. 4. Proposed Location The Art in Public Places Committee, along with artist, gallery and donor, have identified the western edge of Pride Park as the ideal location for installation, as referenced in the attached Exhibit A, page 23. 5. Project Budget The proposed donation is inclusive of costs associated with the acquisition of the artwork. Costs associated with shipping, installation, site work, permitting, plinth design, and lighting need to be identified. These costs are estimated at approximately $175,000. 6. Maintenance Plan The artwork is a large-scale depiction of a human head composed of 316L marine grade stainless steel rods, shaped and welded into five (5) sections mechanically fastened together. The routine maintenance guidelines for the artwork will ideally be performed by dedicated staff Page 419 of 1313 overseen and in collaboration with a local professional art conservator. Remove loose particulate matter and debris with an air compressor, air blower, or vacuum and dry brush. Starting at the bottom, rinse surface with clean, potable water. While the surface is wet, apply cleaning solution with a nylon brush, mason/grout sponge, microfiber wash sponge, or glove. Gently agitate surface to loosen dirt and grime. Rinse surface thoroughly with clean water. Final rinse with distilled water. Dry the surface with an air compressor or leaf blower to prevent water from pooling in the crevices. In addition, soft, clean cotton cloths or a chamois may be used to dry. A qualified art conservator should be contracted to make the necessary recommendations as it relates to the optimum schedule for routine maintenance and what products can be safely used. Routine maintenance shall be overseen by a qualified sculpture conservator and all staff shall be trained by conservator prior to working on the sculpture. Similar outdoor sculpture by the artist have been successfully maintained with a budget of $10,000 per year. 7. Appraisal Report An appraisal report was provided by Richard Gray Gallery for the retail replacement value of Jaume Plensa's Minna (2022). This appraisal report is used for insurance inventory purposes. The market for works by the artist remains successful both on the auction and retail levels. The reasonable insurance value of the work is $2,000,000. 8. Condition Report The work is in pristine condition. Following a presentation of the proposed work by artist Jaume Plensa and upon reviewing the required submission materials, the Art in Public Places Committee made a unanimous motion to accept the work as part of the City of Miami Beach Art in Public Places Collection and further recognize the generosity of Mr. Norman Braman in gifting this monumental work of public art to the city of Miami Beach.
