Resolution 2022-32125 RESOLUTION NO. 2022-32125 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION TO CONDUCT A FEASIBILITY STUDY TO DETERMINE THE COSTS OF DESIGNING, PERMITTING, AND CONSTRUCTING A BAYWALK ALONG THE MOUNT SINAI WATERFRONT, PURSUANT TO THE CITY'S EASEMENT RIGHTS FOR A BAYWALK UNDER AN AGREEMENT WITH MOUNT SINAI MEDICAL CENTER OF FLORIDA, INC., DATED MARCH 2, 2016. WHEREAS, on June 11, 2014, the Mayor and City Commission approved Resolution No. 2014-28609, authorizing a Grant Agreement with Mount Sinai Medical Center of Florida, Inc ("Mount Sinai"), in the amount of $15,000,000 (the "Grant") for the purpose of reimbursing Mount Sinai for hard and soft costs associated with Mount Sinai's Emergency Room Expansion Project, subject to and conditioned upon the additional conditions set forth in the Resolution including, without limitation, the successful negotiation and the final execution by the City and Mount Sinai of (1) the Grant; (2) a Lease Agreement with the City (as Lessee) and Mount Sinai (as Lessor) for the City's Emergency Management Office; and (3) perpetual public access baywalk easement granted by Mount Sinai in favor of the City for the purpose of the City's design, construction, management, and operation of a public baywalk for public use along the northern and western boundaries of the Mount Sinai property (the "Baywalk") ; and WHEREAS, on December 9, 2015, the Mayor and City Commission adopted Resolution 2015-29232, authorizing the Mayor and City Clerk to execute a Baywalk Easement between Mount Sinai and the City, which was executed pursuant to the Baywalk Easement Agreement dated March 2, 2016; and WHEREAS, the Easement Area is a strip of land that runs immediately adjacent and parallel to the westernmost boundary of Mount Sinai Medical Center and features a beautiful waterfront view that would be enjoyed by the City's residents and visitors alike; ; and WHEREAS, the City is currently in the process of connecting segments of the baywalk along Biscayne Bay, from Lincoln Road to 5th Street, and has further approved the 5t"Street Pedestrian Bridge Project, with the goal of ultimately connecting the baywalk north of 5th Street with the baywalk south of 5th Street; and WHEREAS, building a baywalk along Mount Sinai, pursuant to the City's existing Baywalk Easement rights would further complement the City's effort to obtain public access to the City's most precious natural resource—a beautiful and free waterfront; and WHEREAS, a baywalk project along the Mount Sinai waterfront would be a significant amenity for residents of Mid Beach who live in close proximity to Mount Sinai and would have close, easy access to a baywalk; and WHEREAS, as follows, the Mayor and City Commission desire for the City Administration to conduct a feasibility study to determine the costs of designing and constructing a baywalk along the Mount Sinai waterfront, pursuant to the City's easement rights for a baywalk under an agreement with Mount Sinai Medical Center of Florida, Inc., dated March 2, 2016. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby direct the City Administration to conduct a feasibility study to determine the costs of designing, permitting, and constructing a baywalk along the Mount Sinai waterfront, pursuant to the City's easement rights for a baywalk under an agreement with Mount Sinai Medical Center of Florida, Inc., dated March 2, 2016.
