RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, DIRECTING THE ADMINISTRATION TO
EXPEDITIOUSLY WORK WITH THE PROPERTY OWNER OF THE
BUILDING LOCATED AT 1200 LINCOLN ROAD, FEATURING FOUR
AMERICAN FLAG MURALS BY ITALIAN ARTIST ENZO GALLO (THE
"MURALS"), AND TO TAKE ALL NECESSARY STEPS, WITHOUT
CREATING ANY DELAY OF THE OWNER'S PRIVATE PROJECT, TO
ASSIST WITH THE ON-GOING EFFORTS TO REMOVE AND STORE
THE MURALS AT A TEMPORARY TO-BE-DETERMINED LOCATION;
FURTHER, SUBJECT TO THE SUCCESSFUL REMOVAL OF THE
MURALS, ACCEPTING THE OWNER'S DONATION OF THE MURALS
TO THE CITY, AND REFERRING THE FOREGOING TO THE ART IN
PUBLIC PLACES COMMITTEE FOR AN ADVISORY
RECOMMENDATION AS TO POTENTIAL LOCATIONS FOR THE
PERMANENT INSTALLATION OF THE MURAL; AND FURTHER,
DIRECTING THE ADMINISTRATION TO IDENTIFY ANY AVAILABLE
ART IN PUBLIC PLACES FUNDING WHICH MAY BE APPROPRIATED
FOR THE STORAGE, RESTORATION AND RE-INSTALLATION OF THE
MURALS.
WHEREAS, on July 6, 2016, the property owner of the building located at 1200
Lincoln Road obtained the Design Review Board's approval for a new Citizen M hotel
project, and since then, has obtained the the demolition permit for the existing building
located on the premises (a former American Savings and Loan Association building
currently used as a branch office for Wells Fargo Bank); and
WHEREAS, the building scheduled to be demolished features four murals,
together entitled "The Glory of Old Glory" (the "Murals), which were created in 1971 by
Italian artist and sculptor Enzo Gallo, an immigrant who fled Italy for Cuba and
subsequently emigrated to South Florida; and
WHEREAS, the Murals were commissioned by the building's former owner,
Shepard Broad, developer of the Bay Harbor Islands, and have been displayed on this
prominent corner of Alton Road and Lincoln Road for more than 50 years; and
WHEREAS, the Murals are part of Miami Beach history and have high artistic
value; and
WHEREAS, the Murals are also one of the few public art works in the City -- if not
the only public art work in the City —depicting key elements of American history, making
the preservation thereof important not just artistically, but as a matter of civic pride; and
WHEREAS, members of the Miami Beach preservation community have urged the
City to take action to save the Murals; and
WHEREAS, the private property owner has no obligation to save the Mural, and
subject to City confirmation, the owner's representatives have indicated the owner will
take steps to cut and remove the Murals in an effort to preserve the Murals, provided that
the owner is not responsible for storing the Murals for future installation, and provided
further that the removal does not delay the owner's project; and.
WHEREAS, as such, the Mayor and City Commission desire for the Administration
to take all steps to assist with the efforts to remove and store the Murals at an appropriate
City-designated facility, pending selection and approval of a suitable permanent location
for the Murals; and
WHEREAS, further, the Mayor and City Commission wish to accept the owner's
_ donation of the Murals to the City, and refer the foregoing to the Art in Public Places
Committee for an advisory recommendation as to potential locations for the placement of
the Murals.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the Administration to expeditiously work with the property
owner of the building located at 1200 Lincoln Road, featuring four American flag murals
by Italian artist Enzo Gallo (the"Murals"), and to take all necessary steps, without creating
any delay of the owner's private project, to assist with the on-going efforts to remove and
store the Murals at a temporary to-be-determined location; further, subject to the
successful removal of the Murals, accept the owner's donation of the Murals to the City,
and refer the foregoing to the Art in Public Places Committee for an advisory
recommendation as to potential locations for the permanent installation of the Murals; and
further, direct the Administration to identify any available Art In Public Places funding
which may be appropriated for the storage, restoration and re-installation of the Murals.
