Resolution 2022-32210 RESOLUTION NO. 2022-32210 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO SELECT, NEGOTIATE, AWARD AND REJECT ALL BIDS, CONTRACTS, AGREEMENTS, AND GRANT APPLICATIONS AND TO RENEW EXISTING CONTRACTS WHICH MAY EXPIRE, AND TERMINATE EXISTING CONTRACTS, AS NEEDED, FROM THE LAST COMMISSION MEETING ON JULY 20, 20221, UNTIL THE FIRST REGULARLY SCHEDULED MEETING ON SEPTEMBER 14, 2022, SUBJECT TO RATIFICATION BY THE CITY COMMISSION AT ITS FIRST REGULARLY SCHEDULED MEETING ON SEPTEMBER 14, 2022. WHEREAS, between the City Commission meeting on July 20, 2022, and the first regularly scheduled meeting on September 14, 2022, the City Commission will not be in session; and WHEREAS, during this period there may be bids or contracts in excess of the $100,000 for goods and services or $300,000 for construction, which may need to be issued, rejected, awarded, or terminated; and WHEREAS, the City Commission has historically, during its August recess, authorized the City Manager to, as needed, select, negotiate, award and/or reject bids, execute contracts and agreements, submit grant applications, renew existing contracts that may expire, and terminate existing contracts, subject to subsequent ratification by the City Commission; and WHEREAS, it is therefore requested that the City Manager, or her designee, be authorized to, as needed, select, negotiate, award, and/or reject all bids, execute contracts and agreements, submit grant applications, renew existing contracts that may expire, and terminate existing contracts, during the recess period between the City Commission meeting on July 20, 2022, until the first regularly scheduled Commission meeting on September 14, 2022, subject to ratification by the City Commission at its first regularly scheduled meeting on September 14, 2022. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby authorize the City Manager, or her designee, to select, negotiate, award and reject all bids, contracts, agreements, and grant applications and to renew existing contracts which may expire, and terminate existing contracts, as needed, from the last Commission meeting on July 20, 20221, until the first regularly scheduled meeting on September 14, 2022, subject to ratification by the City Commission at its first regularly scheduled meeting on September 14, 2022. RECOMMENDATION It is recommended that the Mayor and City Commission of the City of Miami Beach, Florida, for the period during which the City Commission is in recess, allow the City Manager, or designee, to select, negotiate, award and reject all bids, contracts, agreements, and grant applications; renew existing contracts which may expire; and terminate existing contracts, as needed to ensure a continuation of essential services, subject to ratification by the City Commission at its first regularly scheduled meeting on September 14, 2022. BACKGROUND/HISTORY Between the last meeting on July 20, 2022, and the first regularly scheduled meeting on September 14, 2022, the City Commission will not be in session. During this period, there may be bids or contracts in excess of the $100,000 for goods and services or $300,000 for construction, which may need to be issued, rejected, awarded, renewed, or terminated. Typically, during the City Commission's recess period, the City Manager has been authorized by the City Commission to sign all contracts, agreements, and grant applications, renew any existing contracts and terminate existing contracts, as needed. ANALYSIS The requested authorization is necessary to ensure that essential services and projects continue for the period during which the City Commission is in recess.Any item approved by the City Manager subject to the Resolution is,subject to ratification by the City Commission.
