A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, EXPRESSING APPRECIATION TO
GOVERNOR RON DESANTIS FOR TAKING ACTION TO ALLOW
LOCAL GOVERNMENTS THE AUTHORITY TO RESOLVE CERTAIN
LOCAL ISSUES FOR THE SAFETY AND BENEFIT OF THEIR CITIZENS,
INCLUDING VETOING SENATE BILL 620, WHICH SOUGHT TO
INFRINGE ON MUNICIPAL AUTHORITY TO REGULATE BUSINESSES;
SIGNING HOUSE BILL 105, WHICH ALLOWS CITIES AND COUNTIES
TO RESTRICT SMOKING AT BEACHES AND CITY AND COUNTY-
OWNED PUBLIC PARKS; AND SIGNING HOUSE BILL 1435, WHICH
IMPOSES PENALTIES ON MOTORISTS PLAYING EXCESSIVELY
LOUD MUSIC.
WHEREAS, in recent years, the Florida Legislature has increasingly implemented
legislation that restricts municipal and county home rule authority by preempting and
prohibiting local governments from implementing regulations on a variety of matters; and
WHEREAS, Senate Bill 260 ("SB 620") and its related House Bill 569 ("HB 569")
(together, the "Bills") were passed by the Florida Legislature during its 2022 session; and
, WHEREAS, .SB 620 and HB 569 sought to authorize businesses to sue local
governments for damages if their profits or revenues drop 15% as a result of a local
government regulation; and
WHEREAS, it is a local governing body's jurisdiction to determine the appropriate
steps to solve local issues for the safety and benefit of all of its property owners and
citizens; and
WHEREAS, Governor Ron DeSantis vetoed SB 620, citing concerns over broad
and vague language, and potential costly litigation,; and
WHEREAS, in addition, during the 2022 Legislative session, Governor Ron
DeSantis signed House Bill 105, which allowed cities and counties to restrict smoking on
the beaches and in public parks, and House Bill 1435, which imposed penalties on
motorists playing excessively loud music; and
WHEREAS, as such, the Mayor and City Commission of Miami Beach wish to
express appreciation to Governor Ron DeSantis for taking action to allow local
governments the authority to resolve certain local issues for the safety and benefit of their
citizens.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby express appreciation to Governor Ron DeSantis for taking action to
allow local governments the authority to resolve certain local issues for the safety and
benefit of their citizens, including vetoing Senate Bill 620, which sought to infringe on the
municipal authority to regulate businesses; signing House Bill 105, which allows cities
and counties to restrict smoking at beaches and city and county-owned public parks; and
signing House Bill 1435, which imposes penalties on motorists playing excessively loud
music.
