Resolution 2022-32289 RESOLUTION NO. 2022-32289 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF THE MIAMI BEACH, FLORIDA, APPROVING, PURSUANT TO CITY CODE SECTION 138- 204(a)(2), A REQUEST BY OSIB MIAMI BEACH PROPERTIES, LLC, FOR A NON-ELECTRONIC ARTISTIC GRAPHIC LOCATED AT 1628-1634 ALTON ROAD,WHICH GRAPHIC EXCEEDS 100 SQUARE FEET IN SIZE. WHEREAS, OSIB Miami Beach Properties, LLC, (the "Applircant") is the owner of the property located at 1628-1634 Alton Road (the "Property") in Miami Beach, and is requesting approval for the installation of a non-electronic artistic graphic, with an exterior area of 300 square feet, at the entrance of the new "citizenM" hotel on the Property; and WHEREAS, on July 5, 2022, the Design Review Board ("DRB") reviewed and approved a request for Design Review Approval of the subject artistic graphic submitted by the Applicant; and WHEREAS, the artistic graphic depicts a work of art by internationally recognized artist Anna Valdez; and WHEREAS, pursuant to Section 138-204(a)(2) of the City Code, any artistic graphic that exceeds an aggregate area of 100 square feet requires the approval of the City Commission, by majority vote. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve, pursuant to Section 138-204(a)(2) of the City Code, a request by OSIB Miami Beach Properties, LLC, owner of the property located at 1628- 1634 Alton Road, Miami Beach, to install a non-electronic artistic graphic, with an exterior area of 300 square feet, at the entrance to the hotel building. Hudak, City Manager DATE: September 14, 2022 SUBJECT:A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF THE MIAMI BEACH, FLORIDA, APPROVING, PURSUANT TO CITY CODE SECTION 138-204(A)(2), A REQUEST BY OSIB MIAMI BEACH PROPERTIES, LLC, FOR A NON-ELECTRONIC ARTISTIC GRAPHIC LOCATED AT 1628-1634 ALTON ROAD, WHICH GRAPHIC EXCEEDS 100 SQUARE FEET IN SIZE. RECOMMENDATION The Administration recommends that the City Commission adopt the attached Resolution. BACKGROUND/HISTORY On July 5, 2022 the Design Review Board (DRB) reviewed and approved an artistic super graphic for the property at 1628-1634 Alton Road (see attached illustrations). The non- commercial graphic / mural is conceived by artist Anna Valdez. The approval of the DRB is subject to the following conditions: 1. Revised elevations shall be provided prior to the installation of the proposed super graphic; at a minimum,such drawings shall incorporate the following: a. The final design of the artwork shall be consistent with Exhibit 'A submitted at the meeting. Any minor change may be reviewed and approved by staff consistent with the Design Review Criteria and/or the directions from the Board. Any substantial alterations or deviations from the artistic imagery approved herein either now or in the future shall be reviewed by the Design Review Board as a new application. b. A small plaque noting the artist and narrative of the artwork shall be provided in a location on the exterior of the building, in a manner to the reviewed and approved by staff. c. The artistic mural shall be maintained by the applicant, in a manner to be reviewed and approved by staff consistent with the Design Review Criteria and/or the directions from the Board. d.A copy of all pages of the recorded Final Order shall be scanned into the plans submitted for Page 459 of 1700 building permit and shall be located immediately after the front cover page of the permit plans. e. Prior to the issuance of a Certificate of Occupancy,the project Architect shall verify, in writing, that the subject project has been constricted in accordance with the plans approved by the Planning Department for Building Permit. ANALYSIS Pursuant to Sec. 138-204 of the City Code, pertaining to noncommercial exterior graphics and images, the maximum aggregate size of any mural, graphic or image shall not exceed 100 square feet, unless otherwise approved by and adopted by a majority vote of the City Commission by Resolution.The proposed graphic exceeds 100 square feet in aggregate size and is subject to approval by the City Commission. The proposed graphic will be located on the north side of the site that is part of the phased commercial development project 1212 Lincoln Road. This project that spans the entire block of the west side of Alton Road, from 16th Street to Lincoln Road. Phase I of the project is complete and the second phase of the project, the northernmost portion of the site, will include retail and the City's first°citizenM" hotel. The applicant is proposing the installation of an artistic super graphic along the ground floor façade of the hotel entrance, which is at the southeast corner of Lincoln Road and Alton Court. As proposed, approximately a third of the artwork (303 square feet) will be located on the exterior wall of the building. The remainder of the roughly 17 foot high mural continues internally through the building into the lobby. The proposal, by multi-disciplinary artist Anna Valdez, will artistically improve an otherwise bland, remote wall with a vibrant mural. The proposed artwork will be printed on film and applied to a smooth substrate. The final design details are still being developed by the artist, but will be representative of her work in subject, color, and expression. Anna Valdez has been exhibited extensively and her work has been featured at the Perez Art Museum. The Administration is supportive of the overall size and concept of the proposed graphic as the installation of the mural will not only invigorate the design of the building, but also enhance the pedestrian experience.
