MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE FLOOD MITIGATION PLAN, A REQUIRED DOCUMENT FUNDED THROUGH A FLOOD MITIGATION ASSISTANCE GRANT (FMA) FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA), AS PART OF THE CITY'S OVERALL RESILIENCE PROGRAM. RECOMMENDATION Approve and accept the flood mitigation plan to close out the F MA grant. BACKGROUND/HISTORY Under the former Emergency Manager, the City applied for, and was approved for a FEMA Flood Mitigation Assistance Program (FMA) grant to develop a Flood Mitigation Plan (FMP). Concurrent with the genesis of this plan, the Public Works Department was working with consultants to develop the citywide comprehensive plans including strategies to address sea level rise. The FMP, prepared by Jacobs Engineering at the direction of the Division of Emergency Managment, was completed in 2020. The plan was reviewed and accepted by the Florida Division of Emergency Management (FDEM) and provides an overview of City strategies to best address vulnerability to flood hazards. This plan is consistent with the Local Mitigation Strategy (LMS), National Flood Insurance Program (NFIP) and its completion benefits the Community Rating System (CRS). ANALYSIS. The Flood Mitigation Plan was developed by Jacobs Engineering, the consultant responsible for other City pans,to address impacts of sea level rise, and therefore serves as an overview of strategies included in City planning to reduce the overall risk of structures within the City experiencing flood damage and reduce the severity of flood damage when it occurs. The process for completing the plan leveraged prior community engagement and input from various City departments, as well as available scientific data. The plan was completed in 2020 and reviewed by FDEM. In order to obtain grant reimbursement, the grant closeout requires formal approval by the City Commission. SUPPORTING SURVEY DATA. Hudak, City Manager DATE: September 14, 2022 SUBJECT: REQUEST FOR COMMISSION APPROVAL OF FLOOD MITIGATION PLAN ADMINISTRATION RECOMMENDATION Approve and authorize the City Clerk and City Attorney to execute the Flood Mitigation Plan (FMP). BACKGROUND The City has addressed flood mitigation in various ways. While the Public Works Department is the custodian of the myriad tactical plans and programs to address flooding in specific neighborhoods, the Flood Mitigation Plan (FMP), coordinated by the Miami Beach Fire Department Division of Emergency Management(DEM), follows FEMA and FDEM requirements and is a compilation of flood mitigation strategies used by the City of Miami Beach. The FMP provides an overview of the vulnerabilities to flood hazards, identifying the sources, frequency, and severity of flooding in our City. The plan provides reference so that City mitigation strategies are consistent with National guidance, such as the National Flood Insurance Program (NFIP), Community Rating System (CRS) and FEMA requirements, as well as adhering to the Local Mitigation Strategy (LMS) in Miami-Dade County. The City's former Emergency Manager applied for the grant and the City's Division of Emergency Management coordinated the creation of the FMP under a grant agreement with the Florida Division of Emergency Management (FDEM) as part of FEMA's Flood Mitigation Assistance (FMA)grant under the Hazard Mitigation Grant Program (HMGP). The City engaged the services of Jacobs, the consultant who worked with the Public Works Department and Resilience Office on the development of important plans addressing sea level rise and other climate impacts. Jacobs' familiarity with the strategies employed as well as the City's vulnerability assessment made them ideal to create the FMP, which now serves as an executive summary of the City's flood mitigation strategies and a reference tool for implementing future mitigation in accordance with regulatory requirements. CONCLUSION The plan was completed in 2020 and submitted to FDEM for approval. FDEM returned a crosswalk response and provided feedback with suggestions for plan updates. Once those were completed, FDEM approved the FMP July 26, 2022, pending adoption by City Commission. In order to obtain the matching grant reimbursement in the amount of$18,750, the grant closeout requires formal approval by the City Commission. RECOMMENDATION That the City Manager and City Clerk execute the State Mutual Aid Agreement to include the City of Miami Beach. ANALYSIS The State Mutual Aid Agreement(SMAA)was updated and distributed to all counties in the State of Florida. The updated version, now known as the 2018 SMAA, was signed last week by the Miami-Dade County Board of County Commissioners. All municipalities, colleges, universities, special districts and Native American Tribes within the County are required to sign the 2018 SMAA so that all jurisdictions are operating under the same agreement. The Emergency Management Act, in Florida Statutes Chapter 252, provides that each local government enter into mutual aid agreements within the State for reciprocal emergency.aid and assistance in cases of escalating emergencies that strain existing resources and personnel. The SMAA ensures timely reimbursement of the costs incurred by the local governments who render such assistance. The 2018 update includes several new provisions, including: No declaration of a state of emergency is needed for agreements to be activated. This allows for a formal mutual aid process for Florida entities to use for smaller events. • The requesting entity agrees to reimburse the assisting party per the terms in the SMAA. If reimbursement terms vary from the provisions of the SMAA, signatures from both parties are required on supplemental Form B prior to the assistance being rendered. Page SUd1t2 The SMAA automatically renews each year; only the contact information needs to be updated on the supplemental Form C each year.
