A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 2022-32112,
WHICH AUTHORIZED THE CITY OF MIAMI BEACH TO ACCEPT CERTAIN
DONATIONS IN SUPPORT OF THE CITY'S 2022 ASPEN IDEAS CLIMATE
CONFERENCE, FOR THE SOLE PURPOSE OF RETROACTIVELY
ACCEPTING A DONATION MADE BY AT&T, INC. IN MAY, 2022, IN THE
AMOUNT OF $150,000, FOR THE BENEFIT OF THE CLIMATE SUMMIT
MIAMI BEACH HOST COMMITTEE, INC., A FLORIDA NOT-FOR-PROFIT
CORPORATION (THE "COMMITTEE"), IN CONNECTION WITH ITS
EDUCATIONAL AND CHARITABLE ACTIVITIES RELATING TO THE ASPEN
IDEAS CLIMATE CONFERENCE IN THE CITY OF MIAMI BEACH; WITH THE
DONATED FUNDS TO BE DISBURSED AS PROVIDED IN RESOLUTION NO.
2022-32112.
WHEREAS, the 2022 Aspen Ideas Climate Conference was held in the City of Miami
Beach from May 9, 2022 through May 13, 2022, to address the impacts surrounding climate
change throughout the world and resiliency strategies for mitigating these issues (the "Event");
and
WHEREAS, the Climate Summit Miami Beach Host Committee, a Florida not-for-profit
corporation (the "Committee") was created in support of the Event; however, in early 2022, at
the time that donations were being made in support of the Event, the Committee was pending
its IRS determination letter to establish its federal 501(c)3 status, and therefore, donations
received directly by the Committee prior to confirmation of its 501(c)(3) status would likely not
be tax-deductible; and
WHEREAS, as donations made to the City are tax-deductible in the same manner as
for a 501(c)3 organization, on April 6, 2022, the Mayor and City Commission adopted
Resolution No. 2022-32112 to approve and authorize the City to accept donations from Lennar
Foundation, Inc. the Miami Foundation, and the Knight Foundation, with the donated funds to
be dedicated for the Committee, and to be used in furtherance of public purposes related to
the Aspen Ideas Climate Conference in the City; and
WHEREAS, in May 2022, AT&T Inc., made a donation to the City in the amount of
$150,000, to be used in furtherance of public purposes related to the Event; accordingly, the
Mayor and City Commission desire to amend Resolution No. 2022-32112 to reflect AT&T
donation, and to authorize the City to retroactively accept and disburse the donated funds as
provided in Resolution No. 2022-32112, in the same manner as other donations made for the
Event.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby amend Resolution No. 2022-32112, which authorized the City of Miami
Beach to accept certain donations in support of the City's 2022 Aspen Ideas Climate
Conference, for the sole purpose of retroactively accepting a donation made by AT&T, Inc. in
May, 2022, in the amount of $150,000, for the benefit of Climate Summit Miami Beach Host
Committee, Inc., a Florida not-for-profit corporation (the "Committee"), in connection with its
educational and charitable activities relating to the 2022 Aspen Ideas Climate Conference in
the City of Miami Beach; with the donated funds to be disbursed as provided in Resolution No.
2022-32112.
