Resolution 2023-32468RESOLUTION NO: 2023-32468 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY ADMINISTRATION TO ALLOW OUTDOOR DINING CONCESSIONS ON THE STREET PORTION OF THE PEDESTRIAN PROMENADE ON OCEAN DRIVE, LOCATED BETWEEN 13T" STREET AND 14T" PLACE, TO THE EXTENT THAT THE CITY- MANAGER, IN .HER SOLE DISCRETION, DEEMS PRUDENT AND ADVISABLE, FOR WHATEVER PERIOD THE PROMENADE REMAINS CLOSED TO VEHICULAR TRAFFIC. WHEREAS, on December 8, 2021,. the Mayor and City Commission directed the Administration to proceed with the implementation of a pilot for a temporary pedestrian plaza (the "Pedestrian Promenade" or "Promenade") on Ocean Drive, located from 13th Street to 14th Place; and WHEREAS, since the Promenade was first implemented in January 2022, it has substantially improved the safety and quality of life of residents, business, and visitors; and WHEREAS,, the Promenade has, attracted diverse elements of the Miami Beach community back to Ocean Drive, including families with children, older residents, and visitors that enjoy the pedestrian friendly environment created by the Promenade; and WHEREAS, transformation of 'Ocean Drive from an Entertainment District into the Art Deco Cultural District remains one of the highest priorities of the City Commission, and the Pedestrian Promenade is an important element of the City's long -'term plan for the area; and WHEREAS, outdoor dining concessions on the street portion of the Promenade, operated by , restauranteurs with full -service restaurants fronting the Promenade, could add a desirable amenity for the City's residents and visitors; and WHEREAS, as such, the Mayor and City Commission authorize the City Administration to allow outdoor dining concessions on the street portion of the Pedestrian Promenade to the extent that the City Manager,. in her sole. discretion, deems prudent and advisable, for whatever period the Promenade remains closed to vehicular traffic. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY .OF. MIAMI BEACH, - FLORIDA, that the Mayor and City Commission hereby authorize the City Administration to allow outdoor dining concessions on the street portion of the Pedestrian Promenade on Ocean Drive, located between 13th Street and 14th Place, to the extent. that the City Manager, in her sole discretion, deems prudent and advisable, for.whatever period the Promenade remains closed to vehicular traffic.
