A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, DELEGATING TO THE CITY MANAGER,
OR HER DESIGNEE, THE AUTHORITY TO APPLY FOR AND ACCEPT
FUNDING, AND TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS
OR AGREEMENTS IN CONNECTION WITH FINANCIAL DISASTER RELIEF
AND RECOVERY ASSISTANCE FUNDS RELATED TO DECLARED
DISASTERS INCLUDING, BUT NOT LIMITED TO, FUNDS FROM THE
FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) PUBLIC
ASSISTANCE PROGRAM, PROGRAMS THROUGH THE U.S.
DEPARTMENT OF HOMELAND SECURITY, AND FUNDING RECEIVED
THROUGH THE STATE OF FLORIDA, DIVISION OF EMERGENCY
MANAGEMENT; AND FURTHER AUTHORIZING THE CITY MANAGER, OR
HER DESIGNEE, TO EXECUTE REQUESTS FOR ASSISTANCE,
RELIEF/ASSISTANCE CLAIMS, AND REQUESTS FOR PAYMENTS
NECESSARY TO SUPPORT REIMBURSEMENTS THROUGH DISASTER
FUNDING PROGRAMS.
WHEREAS, hurricanes, tropical storms and other natural disasters threaten and strike
the State of Florida nearly every year, and the frequency of these storms has increased, as has
their intensity; and
WHEREAS, in addition, there are other hazards, characterized as human -caused or
technical, such as building collapses, acts of terrorism, pandemics, and cyber-attacks, which
could escalate to declared disasters; and
WHEREAS, since 2004, the City of Miami Beach has been impacted by at least three
named storms and several flooding events that resulted in local emergency declarations: and
WHEREAS, when natural disasters threaten to approach to our shores, City
departments engage in preparation activities at an expense to the City in anticipation of landfall,
whether actual landfall occurs or not; and
WHEREAS, in addition, the City, under the State Mutual Aid Agreement (SMAA),
provides resources to assist other communities in Florida when they experience disasters, such
as the aid provided after the Surfside Building Collapse, and Hurricane Ian on the west coast of
Florida; and
WHEREAS, the City incurs costs in relation to the preparation for and impact from
disasters, and in providing resources to mutual aid partners; and
WHEREAS, pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance
Act, funds for disaster public assistance are made available through the Federal Emergency
Management (FEMA) Public Assistance Program; and
WHEREAS, funding is also made available through United States Department of
Homeland Security (DHS) in the aftermath of declared disasters; and
WHEREAS, the State of Florida Division of Emergency Management serves as a pass-
through entity for federal awards from FEMA and the U.S. Department of Homeland Security; and
WHEREAS, the City must enter into agreements and execute required documents to
obtain financial assistance from the State of Florida and the federal government in order to receive
recovery funding and funding as categorized by FEMA and other agencies providing Public
Assistance; and
WHEREAS, prior to applying and accepting funding for all declare disasters, the City
Administration must first seek Commission approval via a resolution; and
WHEREAS, in order to streamline the process and allow the City to efficiently apply for
and accept funding for declared disasters, the Mayor and City Commission wish to delegate to the
City Manager the authority to apply for and accept funding, and to execute any and all necessary
documents or agreements, in connection with financial disaster relief and recovery assistance
funds related to declared disasters including, but not limited to, funds from FEMA, DHS, and
funding received through the State of Florida, Division Of Emergency Management; as well as
executing requests for assistance, relief/assistance claims, and requests for payments necessary
to support reimbursements through disaster funding programs.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
hereby delegate to the City Manager, or her designee, the authority to apply for and accept
funding, and to execute any and all necessary documents or agreements in connection with
financial disaster relief and recovery assistance funds related to declared disasters including, but
not limited to, funds from the Federal Emergency Management Agency (FEMA) Public Assistance
Program, programs through the U.S. Department of Homeland Security, and funding received
through the State Of Florida, Division Of Emergency Management; and further authorize the City
Manager, or her designee, to execute requests for assistance, relief/assistance claims, and
requests for payments necessary to support reimbursements through disaster funding programs.

BACKGROUND/HISTORY
The City has requested and received individual Delegation of Authority resolutions for
reimbursement requests for protective measures and response projects such as Hurricane Irma
and the COVI D-19 programming. Granting the delegation of authority facilitates the process of
receiving funding. The referenced resolution provides authority to the City Manager to accept
funding for all declared disasters without the step of requesting Commission approval,
streamlining the process.
ANALYSIS
The City of Miami Beach is typically the subrecipient o Public Assistance(PA), as the State of
Florida, Division of Emergency Management (FDEM) serves as the recipient, or "pass -
through," entity for funding. FDEM manages awards under the disaster declaration and
disburses funding once the subrecipient is deemed eligible. Emergency Management and other
City Staff ensure that all requests for reimbursement meet the requirements set forth by FEMA:

FEMA reviews the applications for compliance, then, when deemed eligible, awards the funding
to the State, who allocate the funds based on their subsequent review of the applications. The
process from application to receipt of the check can take -months to years.

ANALYSIS
The City of Miami Beach prepares for and mitigates various hazards and threats, including hurricanes
and other natural disasters, public health emergencies and disasters characterized as human -caused
or technical, such as building collapses and cyber-attacks. FEMA's Public Assistance (PA) Program
provides PA grants to local governments so communities can quickly respond to and recover from
major disasters or emergencies. This assistance helps to cover costs for debris removal, life-saving
emergency protective measures, and restoring public infrastructure among many other eligible
expenses. The US Department of Homeland Security (DHS) has similar programs to assist in public
safety preparation, mitigation, response and recovery.
