Resolution 2023-32539RESOLUTION NO. 2023-32539 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A CITY POLICY GOAL RELATING TO THE TIMEFRAMES FOR THE FINAL ISSUANCE OF BUILDING PERMITS, AS FOLLOWS: TO THE EXTENT POSSIBLE, (1) FINAL RESIDENTIAL BUILDING PERMIT APPLICATIONS SHOULD BE APPROVED OR DENIED NOT LATER THAN NINETY (90) DAYS FOLLOWING SUBMITTAL OF A COMPLETED PERMIT APPLICATION, OR EARLIER, IF REQUIRED BY LAW; AND (2) FINAL COMMERCIAL BUILDING PERMIT APPLICATIONS SHOULD BE APPROVED OR DENIED NOT LATER THAN ONE HUNDRED AND TWENTY (120) DAYS FOLLOWING SUBMITTAL OF A COMPLETED PERMIT APPLICATION, OR EARLIER, IF REQUIRED BY LAW; FURTHER, PROVIDING THAT THE FOREGOING TIMEFRAMES SHALL BE USED TO GUIDE THE CITY'S ON -GOING EFFORTS TO STREAMLINE THE PERMIT REVIEW PROCESS. WHEREAS, Sections 553.79 and 553.792 of the Florida Statutes provide certain minimum deadlines for regulatory agency response times relating to the review and approval of certain building permit applications, with a statutory reduction of permit fees for untimely response times; and WHEREAS, both residents and businesses alike regularly apply for building permits from the City of Miami Beach for a variety of reasons, to construct, enlarge, alter, repair, move, remove, improve, convert, or demolish a building or other structure; and WHEREAS, obtaining a building or other regulatory permit can be a time-consuming, complex, and costly process; and WHEREAS, the City is currently in the process of improving its regulatory permitting process and customer experiences — at the December 14, 2022 City Commission meeting, the Mayor and City Commission referred discussions regarding the creation of an Ad Hoc Permit Process Improvement Advisory Committee and the "Permit Advocate" Team to the Finance and Economic Resilience Committee for further discussion and development; and WHEREAS, as part of the City's on -going efforts to streamline the permit review process, the Mayor and City Commission desire to establish a policy goal with specific timeframes for endeavoring to achieve the final issuance of permits, as follows: • final residential building permit applications should be approved or denied not later than ninety (90) days following submittal of a completed permit application, and final commercial building permits should be approved or denied not later than one hundred and twenty (120) days following submittal of a completed permit application WHEREAS, implementation of the foregoing will assist the City with complying with its obligations under Florida law, and will also support the City's efforts to promote the City as a friendly destination for businesses and residents to improve their properties, increase property values and stimulate our local economy. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby establish a City policy goal relating to the timeframes for the final issuance of building permits, as follows: to the extent possible, (1) final residential building permit applications should be approved or denied not later than ninety (90) days following submittal of a completed permit application, or earlier, if required by law; and (2) final commercial building permit applications should be approved or denied not later than one hundred and twenty (120) days following submittal of a completed permit application, or earlier, if required by law; further, provide that the foregoing timeframes shall be used to guide the City's on -going efforts to streamline the permit review process.
