The purpose of this LTC is to share with you a Freedom of Information request filed
recently by the Communications Workers of America (CWA), (see attached). It is
important for you to note the types of unnecessary, time consuming requests and practices
the CW A engages in while the City is working diligently and in good faith to reach a
mutually acceptable Collective Bargaining Agreement. Since the start of negotiations on
June 26, 2003, CWA has filed fifteen (15) public records requests, filed twenty (20)
grievances, and has twenty three (23) pending arbitrations.
While the City has engaged in seven (7) collective bargaining sessions with CW A, the tone
and progress level of these negotiations has been much less cooperative and flexible than
the sessions with Police, Fire and GSA.
The City will continue to work diligently and cooperatively with the CW A to reach an
agreement as soon as possible, The City has requested additional meeting dates to
continue negotiations with CWA, and is currently awaiting their response.

Be advised that this request is made pursuant to the public records act, the public employees
relations (PERC) act, which entitles the union not only to preexisting documents but also
information responsive to specific request, and the Miami Beach citizen's bills of rights.
For the purposes of this request, " documents" indude memoranda, letters, notes (whether typed
or handwritten) work sheets, e-mail, audio tapes, transcripts, work papers, regardless of whether
they are kept in computerized format only or on paper or other medium. If there is no document
responsive to a particular request, please advise me of that fact. In the event the city intends to
charge the union any cost pertaining to this request , I am also requesting an itemized bill
induding the identity of the work performed by that employee in responding to this request .
