Resolution 2023-32606RESOLUTION NO.' 2023-32606 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 2022-23448 TO EXTEND THE TERM OF THE CITY OF MIAMI BEACH AD HOC CHARTER REVIEW AND REVISION BOARD ("CHARTER REVIEW BOARD") FOR AN ADDITIONAL SIX (6) MONTH PERIOD, WITH THE. NEW SUNSET DATE TO BE JUNE 30, 2024, IN ORDER TO PROVIDE THE CHARTER REVIEW BOARD WITH SUFFICIENT TIME TO THOUGHTFULLY DELIBERATE AND MAKE RECOMMENDATIONS TO THE MAYOR AND CITY COMMISSION REGARDING PROPOSED AMENDMENTS TO THE CITY CHARTER, FOR POTENTIAL CONSIDERATION BY THE CITY'S VOTERS AS PART OF THE NOVEMBER 5, 2024 ELECTION. WHEREAS, pursuant to City Charter Section 8.01, the "Charter shall be reviewed ten (10) years from November 3, 1993, and each tenth year thereafter"; and WHEREAS, periodic review of the City Charter is in the public interest to ensure the City Charter reflects the organization, powers, and essential functions of City government desired by the City's voters, and necessary for effective governance of the City; and WHEREAS, the next required Charter review is scheduled to take place in 2023; and WHEREAS, at the June 20, 2022 City Commission meeting, the Mayor and City Commission adopted Resolution No. 2022-32234, establishing the Ad Hoc Advisory Charter Review and Revision Board ("Charter Review Board"); and WHEREAS, unfortunately, due to the untimely passing of Commissioner Mark Samuelian, the Charter Review .Board was unable to commence its work for approximately six (6) months, and was not fully constituted until after December 14, 2022, when the Mayor and City Commission adopted Resolution No. 2022-32448, to provide for newly elected Group II City Commissioner Laura Dominguez to make a direct appointment to the Charter Review Board; and WHEREAS, to date, the Charter Review Board has met on February 6, 2023; March 28, 2023; April 10, 2023; and April 25, 2023, and will continue to meet regularly until its sunset date on December 14, 2023; and WHEREAS, at its April 25, 2023 meeting, the Charter Review Board unanimously recommended that the Mayor and City Commission extend the term of the Board for six months, to allow the Board sufficient time to gather input from the City's Charter Officers, Elected Officials, and other interested stakeholders, and carefully vet proposed amendments to the City Charter; and WHEREAS, the Charter Review Board further recommends that the City follow the precedent set by the Charter Review Board of 2013/14, and elect not to place proposed Charter amendments on the same ballot as the 2023 General Election, at which the City's voters will be electing the Mayor and three City Commissioners, in an effort to avoid unduly politicizing Charter questions and, instead, submit any Charter -related ballot questions to the voters as part of the November 5, 2024 election; and WHEREAS, -the Charter Review Board aims to conclude its fact-finding, research, and recommendations by May or June of 2024, to allow the City Commission sufficient time to review proposed Charter amendments, and corresponding ballot questions, prior to the Miami -Dade County Elections Department's deadline for the November 5, 2024 ballot. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby amend Resolution No. 2022-32448 to extend the term of the City of Miami Beach Ad Hoc Charter Review and Revision Board ("Charter Review Board") for an additional six (6) month period, with the new sunset date to be June 30, 2024, in order to provide the Charter Review Board with sufficient time to thoughtfully deliberate and make recommendations to the Mayor and City Commission regarding proposed amendments to the City Charter, for potential consideration by the City's voters as part of the November 5, 2024 election.
