A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE
FINANCE AND ECONOMIC RESILIENCY COMMITTEE, AT ITS MAY 24, 2023
MEETING, AND APPROVING AND AUTHORIZING THE CITY MANAGER TO
(1) ESTABLISH A RENTAL APPLICATION FEE REIMBURSEMENT PILOT
PROGRAM; AND (2) ALLOCATE FY 2022 HOME AMERICAN RESCUE PLAN
(HOME-ARP) FUNDS, IN THE AMOUNT OF $50,000.00, TO FUND THE PILOT
PROGRAM; AND FURTHER AUTHORIZING THE CITY MANAGER AND CITY
CLERK TO EXECUTE AGREEMENTS WITH SUB-RECIPIENTS.
WHEREAS, the City is an entitlement recipient of U.S. Department of Housing and
Urban Development (HUD) grant funds for the Community Development Block Grant (CDBG),
and HOME Investment Partnership programs (HOME), and the City expects to continue to
receive entitlement funds from these grant programs to operate the City's housing and
community development activities; and
WHEREAS, on September 22, 2021, the City received notification from the U.S.
Department of Housing and Urban Development (HUD) that the City was awarded
$2,245,387.00 in HOME-American Rescue Plan ("HOME-ARP")funding; and
WHEREAS, on January 20, 2022, the Mayor and City Commission approved a
substantial amendment to the City's FY 2021 One-Year Action Plan,.to include the HOME-ARP
funding; and
WHEREAS, on September 15, 2022, the City executed an agreement with HUD for the
purpose of conducting homelessness assistance and supportive services program with federal
financial assistance under the HOME-ARP Program; and
WHEREAS, on October 26, 2022, Commissioner Fernandez made a referral to the
Finance and Economic Resiliency Committee (FERC) to explore an ordinance that would
establish a universal rental application fee program; and
WHEREAS, on February 17, 2023, FERC directed the Administration to provide details
on a pilot program that will provide a reimbursement to households for 80% of the cost of their
rental application fee not to exceed $500 per year; and
WHEREAS, households must be at or below 80% of Area Median Income ("AMI"); and
WHEREAS, on May 24, 2023, FERC recommended the allocation of $50,000.00 in
HOME-ARP funds for the establishment of a universal Rental Application Fee Reimbursement
Pilot Program.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby
accept the recommendation of the Finance and Economic Resiliency Committee, at its May 24,
2023 meeting, and approve and authorize the City Manager to (1) establish a Rental Application
Fee Reimbursement Pilot Program; and (2) allocate FY 2022 HOME American Rescue Plan
(HOME-ARP) funds, in the amount of $50,000.00, to fund the Pilot Program; and further
authorize the City Manager and City Clerk to execute agreements with sub-recipients.

RECOMMENDATION
The Administration recommends the allocation of HOME Investment Partnership- American
Rescue Plan(HOME-ARP)funds for the establishment of the Universal Rental Application Fee
pilot program in the amount of$50,000.
BACKGROUND/HISTORY
At the October 26, 2022City Commission meeting, Commissioner Fernandez requested a
referral to the Finance and Economic Resiliency Committee ("FERC")to explore an ordinance
that would establish a universal rental fee application program.
At its February 17, 2023, meeting, members of the FERC discussed the rental fee application
program and directed the Administration to provide details on a pilot program that will provide a
reimbursement to households for 80% of the cost of their rental application fee not to exceed
$500 per year. Households must be at, or below, 80% Area Median Income ("AMI") to qualify
for this pilot program.
The FERC also directed the Administration to explore possible grants and other funding
opportunities that could assist families between 80% to 120% AMI. Subsequently, the
Administration identified $50,000 in HOME-ARP funds for households at or below 80%AMI.
Additionally, the Administration worked with the Grants Management Division to investigate
potential alternate funding for households earning over 80% AMI and also contacted Miami
Homes for All, but neither approach has yielded identification of available funding at this time.

At its May 24, 2023 meeting, members of the FERC discussed the rental fee application •
program further and recommended the allocation of$50,000 in HOME-ARP funds for approval
by the Mayor and City Commission. The Administration is preparing a budget enhancement
request to be presented to the FERC, to serve households over 80% AMI and up to 120%
AMI.
ANALYSIS
The Administration structured a pilot program to provide financial assistance to Miami Beach
households earning up to 80% AMI paying rental application fees based on a reimbursement
structure.
The Office of Housing and Community Services will be responsible for administering the
program, including the income certification of income-eligible households residing in or moving
to Miami Beach, reimbursement of funding, program compliance with the HOME-ARP program
guidelines, and working with the Office of Marketing and Communications to promote and
market the program.
The HOME-ARP Income Limits are calculated using the same methodology that the U.S.
Department of Housing and Urban Development("HUD") uses for calculating the income limits
for the Section 8 program. The HOME Income Limits are updated annually by HUD's
Economic and Market Analysis Division (EMAD), Office of Policy Development and Research.
Income limits are published annually.

Households earning up to 80%AMI will be able to receive a reimbursement of 80% of the cost
of their rental application fee, up to $500 per year. Households whose income is over 80%AMI
will need to apply through General Fund assistance,to potentially be budgeted and allocated for
Fiscal Year 2024.
All households will be required to provide documentation showing how much they paid for the
application fee(s); multiple applications will be accepted, but the reimbursement amount will not
exceed $500. Examples of this documentation include receipts or copies of money orders for
properties within city limits. Upon approval, a check for the amount approved will be mailed to
