A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE MIAMI
BEACH POLICE DEPARTMENT TO DONATE FIVE (5) OBSOLETE
POLICE VEHICLES, IN "AS IS" CONDITION, TO THE ROYAL
TURKS AND CAICOS ISLANDS POLICE FORCE, WITH ALL COSTS
SURROUNDING SUCH DONATION TO BE THE SOLE
RESPONSIBILITY OF THE ROYAL TURKS AND CAICOS ISLANDS
POLICE FORCE.
WHEREAS, the Miami Beach Police Department has developed professional
relationships with several international law enforcement agencies, including the Royal
Turks and Caicos Islands Police Force; and
WHEREAS, the Miami Beach Police Department has five (5) obsolete police
vehicles -- one (1) 2010 Ford Fusion, one (1) 2012 Ford Fusion, one (1) 2013 Ford Fusion
and two (2) Interceptor Sedans that it wishes to donate to the Royal Turks and Caicos
Islands Police Force; and
WHEREAS, a recent inspection, based upon industry standard metrics such as
age, mileage, maintenance and overall condition, concluded that the aforementioned
vehicles have reached their end of useful life; and
WHEREAS, the vehicles, which have an estimated value of $4,500 each, have
already been declared surplus property and are scheduled for replacement by the Miami
Beach Police Department; and
WHEREAS, the Royal Turks and Caicos Islands Police Force has limited
resources and is in need of additional police vehicles; and
WHEREAS, no funds are required from the City of Miami Beach for this donation
of police vehicles, as the Royal Turks and Caicos Islands Police Force shall be
responsible for all costs surrounding the export, transportation and donation of these
vehicles; and
WHEREAS, the charitable donation of these outdated vehicles to the Royal Turks
and Caicos Islands Police Force is in the best interest of the City of Miami Beach; and -
WHEREAS, this donation is made in an "as is" condition, and the City of Miami
Beach makes no representation as to the condition of the one (1) 2010 Ford Fusion, one
(1) 2012 Ford Fusion, one (1) 2013 Ford Fusion and two (2) Interceptor Sedans, and
further makes no warranties (expressed or implied) and assumes no responsibility for the
condition or operation of such vehicles.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the Miami Beach Police Department to donate five (5)
obsolete police vehicles, in "as is" condition, to the Royal Turks and Caicos Islands Police
Force, with all costs surrounding such donation to be the sole responsibility of the Royal
Turks and Caicos Islands Police Force.

CAICOS ISLANDS POLICE FORCE.
BACKGROUND/HISTORY
The Miami Beach Police Department (MBPD) has developed professional relationships with
several international law enforcement agencies and entertained, with some of them, discussions
about delivering training for their officers. While doing so, in 2018 James Smith, then
Commissioner for the Royal Turks and Caicos Police Force (TCPF), expressed a critical need
for police vehicles through which to better cant' out their law enforcement duties. I n response to
this identified need, the City of Miami Beach drafted a standing Letter of Understanding with
TCPF (included in this item) and identified a prisoner transport vehicle that was at end -of -life
that could be provided to their police force. In addition to the contribution of the 2011 Ford
Police Prisoner Transport Van in 2018, a subsequent donation of four (4) 2011 Ford Explorers
and one (1) Ford Interceptor was carried out in 2021.
ANALYSIS
The Department would like to donate the following five (5) vehicles to TCPF at no cost to the
City of Miami Beach:
1. Vehicle 3370 — 2010 Ford Fusion
2. Vehicle 3467 — 2012 Ford Fusion
3. Vehicle 3440 — 2013 Ford Interceptor Sedan
4. Vehicle 3443 — 2013 Ford Interceptor Sedan
5. Vehicle 13212 — 2013 Ford Fusion
City vehicles are scheduled for review and/or replacement based on a pre-determned schedule and
using various industry standard metrics to include age, mileage, maintenance, engine hour and
overall condition. Once vehicles have reached the pre -determined criteria, they are considered to
have reached their "end -of -life" following a physical inspection and determination of safety and

maintenance cost effectiveness.
The inspection of the aforementioned vehicles determined that they had reached their end -of -
life with the Department.
Under normal circumstances, vehicles reaching their end -of -life are sold at regularly held public
auctions as doing so positively impacts the City's overall cost of asset ownership. Proceeds
from auction sales are used to reduce the cost of purchasing replacement vehicles. MBPD and
fleet staff estimated the fair market value of the vehicles to determine whether any substantial
cost associated with donating versus selling would be incurred. Upon review, Fleet
Management estimated the auction value of the vehicles to be $4,500 each. The appraisal
does not account for costs associated with preparing an end -of -life MBPD vehicle for auction,
which would include costs to remove MBPD graphics, fuel management, and AVL system
systems or the costs of administering the auction itself. The actual sale price of the vehicle is
unknown and would be subject to the mechanical condition of the vehicle and market
environment at the time of the final auction sale.
The MBPD has approved the replacement of the five (5) vehicles as part of the Fleet
Management's annual fleet acquisition list, and the vehicles have officially been declared as
surplus and of no further use to the City. The donation, however, would make a significant and
positive impact to an agency which does not easily have access to vehicles with similar
capacities.

The TCPF has committed to absorb any costs associated with the transport of said vehicles to
Turks and Caicos.
CONCLUSION
The Administration therefore requests the Mayor and the City Commission authorize the City
Manager and Miami Beach Police Department to carry out the donation of the five (5) vehicles
to the Royal Turks and Caicos Police Force.

Re: Letter Agreement between the Miami Beach Police Department
and the Royal Turks and Caicos Islands Police Force
Dear Commissioner Smith:
This letter agreement (the "Letter Agreement" or "Agreement") shall serve to
confirm and ratify the prior verbal understanding between the Royal Turks
and Caicos Islands Police Force (the "RTCIPF") and the Miami Beach Police
Department (the "MBPD") with regard to the MBPD's continued assistance
of the RTCIPF. This Letter Agreement- shall be effective as of November 12,
2018, and will remain in effect so long as the RTCIPF continues to have a
demonstrated need for such assistance, and neither the MBPD nor the
RTCIPF has exercised its option to terminate the Agreement.
Pursuant to this Agreement, the MBPD will support the RTCIPF by
designing and delivering police officer training, and will also provide
additional resources to augment the overall law enforcement efforts of the
RTCIPF, as the MBPD is able. In recent months, examples of the foregoing
include: an MBPD police officer traveling to the Turks and Caicos Islands
where he was instrumental in training a select group of RTCIPF police
officers in the use and deployment of Axon's Taser, a less lethal weapon,
and the Miami Beach City Commission authorizing the MBPD to donate a
surplus MBPD prisoner transport van to the RTCIPF.
In order to ensure the essential objectives and goals of the RTCIPF are
addressed, the MBPD and RTCIPF shall engage in ongoing communication
and collaboration to identify the most crucial areas of need. Furthermore,
the MBPD and the RTCIPF hereby establish the following responsibilities of
the respective agencies:
1. The MBPD Chief of Police and the RTCIPF Police Commissioner will
each appoint a designated agency liaison.

2. The respective MBPD and RTCIPF liaisons will be responsible for
facilitating and managing this Agreement. The liaisons shall provide a
joint, annual evaluation of this Agreement, along with an annual
review of accomplishments for the MBPD Chief of Police and the
RTCIPF Police Commissioner.
3. The RTCIPF will regularly evaluate and determine its training and
resource needs, and inform the MBPD of such needs through the
RTCIPF liaison. Resources needs may include vehicles, equipment or
other supplies.
4. The MBPD will make every effort to address and support the training
and resource needs of the RTCIPF as is practicable and authorized by
the Miami Beach City Commission and/or City of Miami Beach
policies and procedures.
5. Travel expenses (airfare and lodging) incurred as a result of an MBPD
employee providing training or support in the Turks and Caicos
Islands shall be the sole responsibility of the RTCIPF. However, the
MBPD employee's per diem cost for meals shall be the sole
responsibility of the MBPD.
6. Any and all costs associated with the export and shipping'of MBPD
vehicles, equipment or other supplies donated to the RTCIPF will be
the sole responsibility of the RTCIPF.
7. Either the MBPD or the RTCIPF may terminate this Agreement by
providing written notice to the other, in which case the Agreement
shall be deemed terminated five (5) days after receipt of such notice.
