Kasdin and Members of the City Commission FROM: Sergio Rodriguez City Manager SUBJECT: A RESOLUTION ADOPTED BY THE HISTORIC PRESERVATION BOARD RELATIVE TO THE ETHICS ORDINANCE Attached herewith, please find a Resolution adopted by the Historic Preservation Board, at its July 14, 1998, meeting, urging the City Commission to amend the City's ethics ordinance. SR/JG/DG/wc M:\CMGR\$ALL\L TC.98\ETHICS.wPD CITY OF MIAMI BEACH HISTORIC PRESERVATION BOARD RESOLUTION At the July 14, 1998, meeting, the Historic Preservation Board of the City of Miami Beach discussed Ordinance No. 97-3105, adopted on December 17, 1997, amending Miami Beach City Code Chapter 2 entitled "Administration", Article III thereof entitled "Standards of Conduct for City Officers and Employees", by creating Section 2-47.4 entitled "Supplemental Abstention and Disclosure Requirements", and 2-47.5 entitled "Certain Appearances Prohibited" relative to City of Miami Beach Board and Committee members and unanimously resolved (7-0-2 [2 vacant appointments]) as follows: 1. The Historic Preservation Board unanimously urges the City Commission to strengthen the City's ethics standards by adopting an amendment to the aforementioned Ordinance No. 97- 3105, which will uniformly limit the permissible conflicts-of-interest for members on all fuYI City land use boards, including the Historic Preservation Board, Design Review Board, Planning Board, and Zoning Board of Adjustment, to three (3) per year, and will exempt the land use boards from those provisions of the ethics ordinance which now prohibit a person who presents to the board from serving on a City board or committee, due to a conflict-of- interest, by allowing a maximum of three (3) abstentions for voting on a matter before the respective board, due to a conflict-of-interest, on three (3) different applications within a period of one (1) year. 2. The Historic Preservation Board unanimously urges the City Commission to consider an amendment to the Code of the City of Miami Beach, Chapter 118 (Historic Preservation Board), Section 118-105 (Removal) to include the language as follows, "For the purposes of this section, an absence from a board meeting shall be defined as missing more than thirty percent (30%) of the scheduled matters on that meeting's agenda."
