BACKGROUND: The City, in its desire to further enhance ease of visitor access to the convention center are" commissioned Wallace Roberts Todd to do a comprehensive study and master plan for the are,. Within that study, a schematic program was designed for a city-wide signage plan directing visitOI; throughout the City to the convention center area. This plan was approved conceptually by th.~ Tourism and Convention Center Expansion Authority (TCCEA) Board. Additionally, needs have been identified by the City and convention center management for th.~ enhancement of the interior graphics and signage of the Miami Beach Convention Center. Thi; enhancement also includes the requirement of satisfaction of ADA concerns as raised in the receatll completed ADA assessment study of the complex. PROPOSAL SUBMISSION An original and ten copies of complete proposal must be received by October 14, 1997 : t 2:00 p.m. and will be opened on that day at that time. K. EXCEPTIONS TO RFP Proposers must clearly indicate any exceptions they wish to take to any of the terms in hi. RFP, and outline what alternative is being offered. SUNSHINE LAW Proposers are hereby notified that all information submitted as part of a response to this RFl " will be available for public inspection after opening of proposals, in compliance with Cha] )te' 286, Florida Statutes, known as the "Government in the Sunshine Law". M. NEGOTIATIONS The City may award a contract on the basis of initial offers received, without discussion, 0' may require proposers to give oral presentations based on their proposals. The City reser ve.: the right to enter into negotiations with the selected proposer, and if the City and the selectee. proposer cannot negotiate a mutually acceptable contract, the City may terminate th: negotiations and begin negotiations with the next selected proposer. RULES; REGULATIONS; LICENSING REQUIREMENTS Proposers are expected to be familiar with and comply with all Federal, State and local laws ordinances, codes, and regulations that may in any way affect the services offered, includ in! the Americans with Disabilities Act, Title VII of the Civil Rights Act, the EEOC Uniforn Guidelines, and all EEO regulations and guidelines. Q. CONFLICT OF INTEREST The award of this RFP is subject to provisions of State Statutes and City ordinances. The result; were presented to the Tourism and Convention Center Expansion Authority (TCCEA) Board, whic: 1 is responsible for convention center-related capital projects, and conceptual approval was given fa: the schematic designs. Additionally, in conjunction with this project, the City is seeking to upgrad.: and complete the on-site exterior and interior graphics packages at the Convention Center. In order to move forward with this project, the City is seeking the services of architectural firms t,) provide design services that will produce construction and installation bid documents for th.: following: 1.) City-wide directional as signage as outlined and conceptually approved within the attacl1ell Wallace Roberts Todd (WRT) study 2.) Exterior marquee-type signage for the Miami Beach Convention Center to be similar i] l scope to that outlined in the WR T study 3.) It is the intent of the City to utilize a single firm for the entire pr~jec: as described above. Proposals which do not include all required documentation or are not submitted in the requin d format, or which do not have the appropriate signatures on each document, may be deemed 10 1 "e non-responsive. Non-responsive proposals will receive no further consideration. A. CONTENTS OF PROPOSAL 1. Table of Contents Outline in sequential order the major areas of the proposal, including enclosures. A 11 pages must be consecutively numbered and correspond to the table of contents. 2. Technical Proposal: Provide a narrative which addresses the scope of work, the proposed approach t< I tl e work, and any other information called for by the RFP. 3. Price Proposal Fee information is to be submitted in a sealed envelope attached to the ori~ :inll submission. Envelope of the top-ranked proposer will be opened during negotia tic n stage. 4. Qualifications The minimum qualification requirements for this RFP are described be. 0\ '. Respondents must provide documentation which demonstrates their ability to sal isj y all of the minimum qualification requirements. MINIMUM REQUIREMENTS / QUALIFICATIONS: Each firm interested in responding to this Request for Qualifications must provide the follovlin.~ information. Submittals that do not respond completely to all requirements will be considered llot - responsive and eliminated from the process. 1. Firm's Experience: Indicate the firm's number of years of experience in providing architectural/engineerin.~ servIces. 2. Project Manager's Experience: Provide a comprehensive summary of the experience and qualifications of the individual s who will be selected to serve as the project managers for the City. Individuals must ha\i.~ a minimum of five years' experience in architecture/engineering, and have served as preje< t manager on similar projects on a minimum of three previous occasions. 3. Previous Similar Projects: A list of a minimum of five similar projects must be submitted. Information should include: * Client Name, address, phone number. * Description of work. * Year the project was completed. * Total cost of fees paid to firm. * Total cost of the construction, estimated and actual. 4. Oualifications of Project Team: List the members of the project team. Provide a list of the personnel to be used on thi s project and their qualifications. A resume including education, experience, and any othe r pertinent information shall be included for each team member, including subcontractors, to be assigned to this project. RFP NO.: 134-96/97 DATE: 9/10/97 CITY OF MIAMI BEACH 10 376 SECTION IV - EV ALVA TION/SELECTION PROCESS: CRITERIA FOR EV ALVA TIO '~ The procedure for proposal evaluation and selection is as follows: 1. Request for Proposals issued. 2. Receipt of proposals. 3. Opening and listing of all proposals received. 4. An Evaluation Committee, appointed by the City Manager, shall meet to evaluate f:ac 1 proposal in accordance with the requirements of this RFP. If further information is desi reI .., proposers may be requested to make additional written submissions or oral presentat.or s before the Evaluation Committee makes its recommendation. 5. The Evaluation Committee shall recommend to the City Manager the proposal or proposal s acceptance of which the Evaluation Committee believes to be in the best interest of the Cit; . The Evaluation Committee shall base its recommendations on the following factors: Firm's Experience Project Manager's Experience Previous Similar Projects Qualifications of Project Team 6. After considering the recommendation(s) ofthe Evaluation Committee, the City Manage r shall recommend to the City Commission the proposal or proposals acceptance of which th .~ City Manager deems to be in the best interest of the City. 7. The City Commission shall consider the City Manager's recommendation(s) in light of th.~ recommendation(s) and evaluation of the Evaluation Committee and, if appropriate, appIOV.~ the City Manager's recommendation(s). The City Commission may reject City Manag~r'; recommendation(s) and select another proposal or proposals. In any case, City Commis~:io 1 shall select the proposal or proposals acceptance of which the City Commission deems t() b .~ in the best interest ofthe City. The City Commission may also reject all proposals. 8. Negotiations between the selected proposer and the City Manager take place to arrive at 1 contract. If and when a contract or contracts acceptable to the respective parties is approved by thl: City Commission, the Mayor and City Clerk sign the contract(s) after the selected proposer(s) has or have done so. ASSIGNMENT The successful proposer shall not enter into any sub-contract, retain consultant~i, ( r assign, transfer, convey, sublet, or otherwise dispose ofthis contract, or of any or a 1 of its right, title, or interest therein, or its power to execute such contract to an { person, firm, or corporation without prior written consent of the City. J \n( unauthorized assignment shall constitute a default by the successful proposer. B. INDEMNIFICATION The successful proposer shall be required to agree to indemnify and hold harmles; the City of Miami Beach and its officers, employees, and agents, from and aga im t any and all actions, claims, liabilities, losses and expenses, including but not limite 1 to attorneys' fees, for personal, economic or bodily injury, wrongful death, los; c f or damage to property, in law or in equity, which may arise or be alleged to hav.~ arisen from the negligent acts or omissions or other wrongful conduct of th.~ successful proposer, its employees, or agents in connection with the performanc.~ of service pursuant to the resultant Contract; the successful proposer shall pay all s uc: 1 claims and losses and shall pay all such costs and judgments which may issue fi'OIl any lawsuit arising from such claims and losses, and shall pay all costs expende(. b: r the City in the defense of such claims and losses, including appeals. C. TERMINATION FOR DEFAULT If through any cause within the reasonable control of the successful proposer, it slall fail to fulfill in a timely manner, or otherwise violate any of the covenants, agreements, or stipulations material to the Agreement, the City shall thereupon havl: the right to terminate the services then remaining to be performed by giving wri1teH notice to the successful proposer of such termination which shall become effeCliw: upon receipt by the successful proposer of the written termination notice. In that event, the City shall compensate the successful proposer in accordance witll the Agreement for all services performed by the proposer prior to termination, net 0 ' any costs incurred by the City as a consequence of the default. Notwithstanding the above, the successful proposer shall not be relieved of liabi lit; . to the City for damages sustained by the City by virtue of any breach of thl. Agreement by the proposer, and the City may reasonably withhold payments to the successful proposer for the purposes of set off until such time as the exact amoun: 0 ' damages due the City from the successful proposer is determined. TERMINATION FOR CONVENIENCE OF CITY The City may, for its convenience, terminate the services then remaining to 1: e performed at any time without cause by giving written notice to successful propJs( r of such termination, which shall become effective thirty (30) days following receiJ "t by proposer of the written termination notice. In that event, all finished or unfini!:he i documents and other materials shall be properly delivered to the City. RFP NO.: 134-96/97 DATE: 9/10/97 CITY OF MIAMI BEACH 14 380 SECTION VI - SPECIAL TERMS AND CONDITIONS A. INSURANCE The successful respondent(s) shall obtain, provide, and maintain during the term of the proposl:d Agreement the following types and amounts of insurance issued by insurers licensed to Sl 11 insurance in the State of Florida and having a B+ VI or higher rating in the latest edition of A vI Best's Insurance Guide. Any exceptions to these requirements must be approved by the Ci y Manager or designee. 1. Commercial General Liability. A policy including, but not limited to, comprehensi'e general liability including bodily injury, personal injury, property damage in the amount Ilf a combined single limit of not less than $1,000,000. Coverage shall be provided on ,n occurrence basis. The City of Miami Beach must be named as additional insured on polic T. 2. Professional Liability (Errors and Omissions). Minimum of $500,000 per occurrence. 3. Worker's Compensation. A policy of Worker's Compensation and Employers Liabili1 y Insurance in accordance with State worker's compensation laws. Thirty (30) days' written notice of cancellation or substantial modification in insurance cove:a~ e must be given to the City by the architect/engineer and its insurance company. Evidence of such insurance shall be submitted to and approved by City prior to commencement ( f any work or tenancy under the proposed Agreement.
