99-23251 RESO RESOLUTION NO. 99-23251 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING RESOLUTION NO. 99- 23146 BY AMENDING THE COMPOSITION OF THE CODE ENFORCEMENT TASK FORCE. WHEREAS, the Mayor and City Commission believe that portions of the City's laws with regard to Code Enforcement may be outdated, ambiguous, in conflict with state and/or federal law or otherwise in need of revision in order to meet current and future needs of the citizens of the City; and WHEREAS, the Mayor and City Commission believe that review and revision of the City's laws pertaining to code enforcement is important to the welfare of the citizens of the City of Miami Beach; and WHEREAS, on April 28, 1999, the Mayor and City Commission adopted Resolution No. 99- 23146 establishing a Code Enforcement Task Force; and WHEREAS, amendments are required to Resolution No. 99-23146 to reduce the members of the Task Force from nine to seven in order for the Task Force to function more effectively. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a City of Miami Beach Code Enforcement Task Force be and the same is hereby amended as follows: 1. Said Board shall consist of nine seven members, scvcn of all of whom shall be direct appointments, one made by the Mayor and each City Commissioner, which appointments shall be made on the basis of experience in the fields of law, zoning, City Code, South Florida Building Code, Fire Code, Americans with Disabilities Act, and general code enforcement and procedures relating thereto. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND The City Commission created the Code Compliance Task Force by Resolution on April 28, 1999. The Task Force has six months in which to examine City Codes and make recommendations regarding relevant codes, enforcement procedures, settlements, mitigation issues, and assess the fines and liens which have been imposed through the Special Master process. ANALYSIS The Task Force will strive to update the City's Code Compliance laws and to recommend changes as they deem appropriate. The Task Force was originally created as a nine member group with two of the members being non-voting ex-officio (one designated by the City Manager and a representative designated by the City Attorney). It is recommended that the committee structure be reduced by these two members and not specify City staff. In so doing, staff will be able to more efficiently assist the committee and interact with its members. CONCLUSION The proposed Resolution will enhance the Code Compliance Task Force's ability to function more efficiently.
