96-22219 RESORESOLUTION NO. 96-22219 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZINGAN INCREASE IN THE CONTRACT BETWEEN THE CITY AND PHILCORP LANDSCAPE INC., WORK ORDER NO. 366.2114, AND APPROVING CHANGE ORDER NO. 001, IN ANAMOUNT NOT TO EXCEED $71,027, FOR THE PURCHASE AND INSTALLATION OF ELECTRICAL CONDUITS, WIRING, ELECTRICAL PANELS AND LIGHT FIXTURES NECESSARY TO UPLIGHT THE NEDJOOL DATE PALMS TO BE PLANTED IN THE TWO (2) MEDIANS ON ALTON ROAD LOCATED AT WEST aTTH COURT ANDWEST 51ST STREET; SAID FUNDS TO BE APPROPRIATED FROM A DONATIONMADE BY THE MIAMI HEART INSTITUTE, AS ACCEPTED BY THE MAYOR AND CITY COMMISSION ON FEBRUARY 28, 1996. WHEREAS, on July 17, 1996, the Mayor and City Commission apprDv,~d Resolution No. 96-22074, authorizing the execution of an Agreement with Phil2o;p Landscape, Inc., to provide landscaping services as required in the plans az~d specifications for the Alton Road Landscape Improvement Project, Phase (Agreement); and WHEREAS, Change Order No. 001, requested herein, in an amount not to ex2e.~d of $71,027, represents the additional costs associated with the installazi,~n of electrical conduits, wiring, electrical panels and light fixtures to upl[g]~t the Medjool Date Palms in the two (2) medians on Alton Road located at West ~7:h Court and West 51st Street; and WHEREAS, this Change Order will increase the original Agreement fee amDU:~t from $143,320 to $214,347; and WHEREAS, funding is available from a donation from the Miami Hea:'t Institute designated for this Project and accepted by the Mayor and Ci':y Commission on February 28, 1996. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission approve Change Order ~o. 001 in an amount not to exceed $71,027 to Contract No. 38-95/96 with Philc3r) Landscape, Inc., for additional electrical work, and increase the curren: contract from $143,320 to $214,347. BACKGROIJND: The Administration, through the Recreation, Culture and Parks Department, ha~ been working toward a long term, multicomponent plan designed to beautify landscape the City's parks, medians and casuseways. In furtherance of this error: the Administration was awarded a grant from the State of Florida, Department Transportation on June 1,1995 for the second phase of the medians plantin~ project on Alton Road. This project includes the first median north of Ncrta Michigan Avenue, two 2) medians between West 47th Court and West 51st Street, three (3) medians between West 56th street and West 58th Street. On January 4, 1996 the City issued Invitation to Bid Number 38-95/96 for the installation of the Alton Road Phase II project. On May 15, 1996 the Commission awarded the bid to Reed Landscaping, Inc., and subsequently rescir..dE~ the bid award on July 17, 1996 due to Reed's failure to execute the contract with the City in a timely manner. Additionally, on July 17, 1996, the (ity Commission authorized execution of an agreement with Philcorp Landscape, Inc., the second low bidder, to provide landscaping services as required in the p].ars and specifications for the Alton Road Landscape Improvement Project, Phase I]. The installation of the uplighting of twenty four (24) Medjool Date Palms was nct included in the original landscape plans approved in the Florida Department; c f Transportation's grant award in June of.1995. The uplighting component was added only after the MiamiHeart Institute donated funding designated for this specXfic area of project. The project is currently under construction and must te completed no later than December 31, 1996 as required by the Florida Depar~er t of Transportation. The breakdown of costs includes $58,700 for the materials and installation, and $5,870 for the contractcr's overhead and profit. Additionally, included in the change order is $6,457 as a contingency fund for unforeseen conditions which will be expended on17 if necessary. The contractor's quote for this work is within the cost est.inate developed by the electrical engineer and project architect. Fundimg is available from a donation from the Miami Heart Institute designated for this project, which was accepted by the City Commission on February 28, 1996. The project is currently being installed. It would therefore be more cost effective to complete this task while the site is under construction rather than install the lighting at a later date. Installation at this time will reduce the cost of additional road/traffic control, repairs to the irrigation system, sod restoration and eliminate the risk of damage to the roots of the Medjoo] fate Palms due to trenching. CONCLUSIONs The Administration recommends that the City Commission approve Change Order No. 001 in an amount not to exceed $71,027 for Contract No. 38-95/96.
