99-23017 RESO RESOLUTION NO. 99-23017 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AND DECLARING THE EXISTENCE OF AN EMERGENCY AND ALLOWING THE POLICE ATHLETIC LEAGUE (PAL) TO UTILIZE THE PRIVATE VACANT LOT LOCATED AT DADE BOULEVARD AND MERIDIAN AVENUE FOR A FUND RAISING EVENT TO PROVIDE ADDITIONAL PARKING FOR THE NATIONAL FOOTBALL LEAGUE COMMISSIONER'S PARTY, CURRENTLY SCHEDULED FOR JANUARY 29, 1999; FURTHER PROVIDED THAT THE LOT BE UTILIZED EXCLUSIVELY BY PAL SUBJECT TO THE FOLLOWING CONDITIONS: (1) THAT INGRESS AND EGRESS TO THE LOT BE PROVIDED EXCLUSIVELY FROM DADE BOULEVARD; (2) THAT 100% OF THE PROFITS GENERATED FROM THIS FUND RAISER BE GENERATED BACK EXCLUSIVELY TO PAL; (3) THAT PAL AND THE CITY JOINTLY MONITOR THE USE OF THE LOT SO THE SURROUNDING RESIDENTIAL NEIGHBORHOOD IS NOT DISTURBED; (4) THAT THE SUBJECT PERMISSION IS GRANTED ON A ONE TIME ONLY EMERGENCY BASIS, IN VIEW OF THE CURRENT PARKING CRISIS IN THE CITY OF MIAMI BEACH; AND (5) IN ORDER TO ACCOMMODATE THE UNIQUE EMERGENCY CREATED BY THE INCREASED PARKING DEMANDS OF PATRONS ATTENDING SUPERB OWL EVENTS, THE SUBJECT PERMISSION IS GRANTED WITHOUT ESTABLISHING PRECEDENT SO AS TO SATISFY THIS UNIQUE EMERGENCY SITUATION. WHEREAS, the Administration received a request from the Miami Beach Police Athleti; League (PAL) for permission to utilize the private vacant lot located at Dade Boulevard an i Meridian Avenue (the Lot) for a fund raising event to provide additional parking for the Natioml Football League Commissioner's Party, scheduled in the City on January 29, 1999; and WHEREAS, the Administration recommends that the Mayor and City Commission appl 'o\e the PAL's request subject to the following conditions: (1) That ingress and egress to the Lot be maintained exclusively on Dade Boulevaod; (2) That all profits generated by this fund raising event go exclusively to PAL; (3) That the Administration and PAL workjointly in preserving the residential chan.ctl r of the surrounding neighborhood, and that disturbance to these residential areas 1 e maintained at a minimum; (4) That this request is specifically granted on a one time only basis, the Mayor and Ci y Commission having found that an emergency exists due to the increasing parkir g crisis within the City of Miami Beach, and the aggravation of this situm:io 1, particularly during special events such as the Superbowl; and (5) In order to accommodate the unique emergency created by the increased parkin.~ demands of patrons attending Superbowl events, the subject permission is grante. I without establishing precedent so as to satisfy this unique emergency situation; an 1 WHEREAS, the Administration would herein recommend that the Mayor and Cit' Commission, finding that an emergency exists with regard to the scarcity of parking during specie 1 events such as the Superbowl, and the need for increased parking during the duration of these event~, and herein approve, the PAL's request, subject to the afore stated conditions, on a one time cni r emergency basis, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and Cit T Commission herein finds and declares the existence of an emergency, and allows the Police Athl;:ti: League (PAL) to utilize the private vacant lot located at Dade Boulevard and Meridian A venue I. th : Lot) for a fund raising event to provide additional parking for the National Football League'; Commissioner's Party, currently scheduled on January 29, 1999; provided that the Lot be utilize 1 exclusively by PAL subject to the following conditions: (1) that ingress and egress to the Lot b: provided exclusively from Dade Boulevard; (2) that 100% of the profits generated from this fmll raiser be generated back exclusively to PAL; (3) that PAL and the City jointly monitor the use ofth: Lot so the surrounding residential neighborhood is not disturbed; (4) that the subject permission i: granted on a one time only emergency basis, in view of the current parking crisis in the Cit:1 c f Miami Beach; and (5) in order to accommodate the unique emergency created by the increased parking demands of patrons attending the Superbowl Events, the subject permission is grartell without establishing precedent so as to satisfy this unique emergency situation. ADMINISTRATION RECOMMENDATION Adopt the Resolution, BACKGROUND The National Football League is holding the annual Super Bowl in Miami-Dade County, Many)f the events related to the Super Bowl are being held in the City of Miami Beach. One of the m05t prestigious events is the Commissioner's Party that is being held at the Miami Beach Conventic'n Center on January 29, 1999, DATE ~{G t-L,-~ t AGENDA ITEM The Miami Beach Police Athletic League (PAL) has requested permission to use the private vacan lot, located at Dade Boulevard and Meridian Avenue for parking of vehicles for persons attendln~ the Commissioner's Party, ANAL YSIS The Super Bowl, like other Special Events, increases the parking problems that occur in the C .ty The use of this vacant lot for parking for this event would ease the parking and create less of ar inconvenience for those citizens who live in the area. In addition, the Police Athletic League will: 1. Hire an off-duty police officer to direct traffic for the ingress and egress on Dade Boulevard, 2. Obtain a letter from the Mid-Golf Homeowners Association stating that they are in agreement with the use of this property on this date and these times, 3, Submit a plan showing the use of the property to the Planning Department for appro\al. 4. Supply a letter from PAL to the owner of the property stating that the property will be returned in the same condition as it was before the use. 5. Obtain a General Liability Certificate ofInsurance naming the City as an additional narr .ed insured, CONCLUSION By permitting PAL to use this vacant lot, parking would be eased and PAL will be able to raise mlch needed funds for its operations.
