WHEREAS, pursuant to Section 106-76 of the Miami Beach City Code, the City ~,lanager is authorized to determine if a residential area is impacted by commuter vehicles in accordance with the criteria set forth therein; and WHEREAS, pursuant to Section 106-78 of the Miami Beach City Code, the City Manager may create Residential Permit Parking Zones and amend the administrative rules and regulations regarding paid programs; and WHEREAS, Resolution No. 94-21126 (Exhibit "A" ) created Residential Permit Parking Zone One (South Pointe); Zone Two (Flamingo Park); Zone Four (Convention Center-East); and Zone Five (Art Deco), and the Administrative Rules and Regulations of the Program; and WHEREAS, Resolution No. 97-22454 (Exhibit "B") created Residential Permit Parking Zone Three (Michigan Avenue), and Administrative Rules and Regulations of the Program; and WHEREAS, the parking areas established by Resolution Nos. 94-21126 and 97-22454, respectively, for Residential Permit Parking should be expanded due to continued residential development and increases in vehicle volume requiring on-street parking; and WHEREAS, the expansion of each Residential Permit Parking Zone would provide for additional parking opportunities for bonafide residents and their visitors; and WHEREAS, the expanded areas include: Zone One (South Pointe): South Pointe Drive between Ocean Drive and east street end; South Pointe Drive (north side) between Washington Avenue and Jefferson Avenue; Commerce Street between Washington Avenue and Jefferson Avenue; Collins Avenue between South Pointe Drive and First Street; First Street between Ocean Drive and Collins Avenue; First Street between Washington Avenue and Alton Road; Third Street between Ocean Drive and Washington Avenue; Fourth Street between Ocean Drive and Washington Avenue. Zone Five (Art Deco District): Collins Avenue between 5th Street and 15th Street (both sides); 6th Street (200 block) between Collins Avenue and Washington Avenue; 7th Street (200 block) between Collins Avenue and Washington Avenue; 8th Street (200 block) between Collins Court and Washington Avenue; 9th Street (200 block) between Collins Avenue and Washington Avenue; 10th Street (200 block) between Collins Court and Washington Avenue; lith Street (200 block) between Collins Court and Washington Avenue; 12th Street (200 block) between Collins Avenue and Washington Avenue; 13th Street (200 block) between Collins Avenue and Washington Avenue; 14th Street (200 block) between Collins Avenue and Washington Avenue; Espanola Way (200 block) between Collins Avenue and Washington Avenue; Municipal Parking Lot 17X, located on Collins Avenue and 13th Street; Municipal Parking Garage 17 A, located on 13th Street and Collins Avenue; and Municipal Parking Lot 7D, located on Collins Avenue (east side) and 10th Street (lot is available first-come first-serve, until such time that a building permit is issued for development of the property; and WHEREAS, restricted residential parking is permitted for bonafide residents and/or their visitors only, on a first come first served basis; and WHEREAS, pursuant to Section 106-79 of the Miami Beach City Code, the City Manager is authorized to make provisions for Administrative Rules and Regulations necessary to effectively manage the Residential Parking Permit Program; and WHEREAS, an amendment to the Administrative Rules and Regulations pertaining to the provision of visitor parking permits is necessary to better manage the Residential Parking Permit Program; and WHEREAS, a reduction from two (2) to one (1) visitor hang-tags per household will substantially diminish the existing abuse of visitor hang-tags; and WHEREAS, as a service enhancement, the visitor hang-tag will be extended from seven (7) hours, to 24 hours; and WHEREAS, the implementation of a disposable (one-time use only) visitor hang-tag program will afford bonafide residents the opportunity to purchase scratch-off (disposable) hang-tags for daily use; and WHEREAS, a public hearing was duly noticed and held on June 23, 1999, following the mailing of notices to every household that could reasonably be established within the area(s) under consideration fifteen (15) days prior to the hearing date. BACKGROUND: On April 13, 1994, the Mayor and Commission approved the establishment of four (4) restricted residential permit parking zones: Zone One/South Pointe; Zone Two/Flamingo Park; Zone Four/Convention Center-East; and Zone Five/Art Deco (Zone Three-Convention Center/West was not approved due to lack of citizen interest/participation). On July 2, 1997, the Mayor and Commission approved the establishment of Residential Permit Parking Zone ThreefMichigan Avenue. Upon receiving citizen/resident input regarding parking opportunities, or lack thereof, in residential parking zones, the Parking Department surveyed all residential parking zones in search of additional areas that may be deemed residential parking. The continued residential development and changing demographics in these areas has increased the ratio of permitted vehicles to parking spaces (on-street and off-street). In addition, the existing administrative rules and regulations allow for two (2) visitor hang-tags per household. The inventory of active visitor hang-tags exceeds the active inventory of residential parking permits two to one; therefore, there are more active residential permits and hang-tags than parking inventory. Visitor hang-tags were implemented for use by visitors of residents only. The 253 AGENDAITEM~ DATE Co- ~ 3- 9:1 Administration has identified abuse of visitor hang-tags. Clearly, the proliferation of visitor hang- tags has substantially decreased parking opportunities for bonafide residents and their visitors. Visitor hang-tags are used by employees of adjacent commercial areas and other unauthorized uses. This unauthorized use has created an inefficient use of the available parking inventory for bonafide residents. ANALYSIS: The Administration recommends that the following areas be included in each residential permit parking zone, respectively. It is important to note that the areas identified are in addition to existing permitted areas and are recommended for inclusion; however, they may not necessarily be deemed restricted to authorized permit holders only. For example, a resident of Zone One/South Pointe who resides on a street that is included in the proposed expansion will not be required to purchase a permit to park there. The areas proposed for expansion are metered parking areas. The metered parking areas will remain first-come first-served. The inclusion of these recommended areas will provide additional parking opportunities, but will not be restricted for residential use. These areas will be deemed first-come first-served in order to meet the overall parking needs in the vicinity. If the area added is metered, then a valid residential parking permit or visitor hang-tag will allow parking at meters in the respective zone. This will allow for areas in the city with competing residential and commercial uses to maintain and/or increase parking opportunities, contingent upon the type of adjacent use (residential and/or commercial). The areas recommended for inclusion are as follows: Zone One (South Pointe): South Pointe Drive between Ocean Drive and east street end. South Pointe Drive (north side) between Washington Avenue and Jefferson Avenue. Commerce Street between Washington Avenue and Jefferson Avenue. Municipal Parking Garage 17 A, located on 13th Street and Collins Avenue. Visitor Hang-Tags Visitor hang-tags were implemented for use by visitors of residents only. The proliferation of visitor hang-tags has substantially decreased parking opportunities for residents and their visitors. The Administration recommends the following multi-pronged approach for Residential Parking Permit Zones One (South Pointe), Two (Flamingo Park), and Four (Convention Center - East) to address this issue: 1. A reduction from two (2) to one (1) visitor hang-tag per household. 2. Implementation of a Disposable (one-time use only) Visitor Hang-Tag Program 3. Increase the time limit of the existing visitor hang-tag from seven (7) hours to 24 hours. 255 It is important to note that the proposed revisions to the visitor hang-tag program are not applicable to Zone Three (Michigan Avenue) and/or Five (Art Deco). A reduction from two (2) to one (1) visitor hang-tags per household will reduce the active inventory of visitor hang-tags. This will substantially diminish the existing abuse of visitor hang-tags. Moreover, the Disposable (one-time use only) Visitor Hang-Tag Program, implemented as a pilot program for six (6) months, would afford bonafide residents the opportunity to purchase scratch-off (disposable) hang-tags for daily use. The hang-tag would be valid for a 24 hour period from the date it is scratched. Any hang-tag scratched for a period over 24 hours will be void. Residents may purchase scratch-off hang-tags in quantities of five (5) per month for overnight guests and visitors. It is important to note that the standard (existing) hang-tag will continue to be available for visitor use, and, as a service enhancement, the hang-tag will be extended from seven (7) hours to 24 hours. In addition, residents may purchase quantities of up to ten (10) scratch-off hang-tags every six (6) months for events, private parties, etc. The Administration proposes a $1.00 fee for each scratch-off hang-tag to cover printing, production, and administrative costs (actual cost of each scratch-off hang-tag is $0.74). The limitation in quantity to five (5) per month serves as a disincentive for residents to resell or giveaway their hang-tags. The existing abuse of scratch-off hang-tags should be minimal as residents' opportunity cost will be to forego their monthly allotment of scratch-off hang-tags, should they decide to sell or give them away. The scarcity of scratch-off hang-tags should drive the price of scratch-off hang-tags to within competitive commercial parking rates; thus, discouraging and/or eliminating abuse of scratch-off hang-tags. A progressive enforcement plan is recommended for the 24 hour time limit of the standard hang-tag. Warnings should be issued for a period of thirty (30) days, followed by citation issuance for a period of thirty (30) days and after sixty (60) days, vehicles violating the 24 hour time limit might be towed, if necessary. CONCLUSION: The Administration recommends that the Mayor and City Commission approve the resolution and schedule a second and final public hearing to further ascertain public comment.
