99-23052 RESO RESOLUTION NO. 99-23052 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO SUBMIT AN APPLICATION TO THE MIAMI-DADE COUNTY DEPARTMENT OF ENVIRONMENTAL RESOURCE MANAGEMENT FOR A GRANT FROM THE ENVIRONMENT ALLY ENDANGERED LANDS PROGRAM TO DEFRAY THE COSTS OF ACQUIRING THE ALASKA PARCEL; AND AUTHORIZING THE ACCEPTANCE OF THE GRANT, IF AWARDED. WHEREAS, the Miami-Dade County Board of County Commissioners has developed the Environmentally Endangered Lands Program to acquire environmentally sensitive property in Miami-Dade County; and WHEREAS, the City of Miami Beach is seeking funds to acquire the Alaska Parcel to buffer City owned park land and protect the open space environment of South Pointe Park which is located on Government Cut and Biscayne Bay; and WHEREAS, the City proceeded to prepare an application to meet the February 1, 1999 deadline for submission and future consideration; and WHEREAS, the City submitted an application to the Miami-Dade County Department of Resources Management for funds to defray the acquisition costs of purchasing the Alaska Property. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida, retroactively authorize the City Manager, or his designee, to submit an application to the Miami-Dade County Department of Environmental Resources Management for a grant from the Environmentally Endangered Lands Program to defray the costs of acquiring the Alaska Parcel; and authorizing the acceptance of the grant, if awarded. DESCRIPTION OF PROPERTY (a) Description of Subiect Area Subject property consists of 3.4 acres located in the South 1/2 of the Northeast 1/4 of Section 3, Township 54, Range 42. The property is more accurately described as beginning at the West most comer of Lot 6, Block 4, as recorded in Plat Book 6, page 77, thence South 240 West a distance of 420.23 feet;.thence North 650 West a distance of 261.59 feet; thence North 310 West a distance of242.83 feet: thence North 570 East a distance of 226.20 feet; thence East a distance of 208.58 feet; thence Southeasterly a distance of 151.63 feet to the point of beginning. This parcel is identified by Folio Number 02-4201-000-0041. The property is vacant land at the southern tip of Miami Beach. The site is bounded on the south by Government Cut Inlet and by Biscayne Bay to the West. TYPE OF ELIGIBLE LAND The property is being nominated as: () Environmental Land (X) Buffer Land 5. PLANT COMMUNITY TYPE () Pinelands () Hammocks () Freshwater Wetlands () Mangroves (X) Other: (Please describe). The area was previously developed urban land that is currently vacant. The land has been filled with sand dredged from Government Cut and Biscayne Bay. All native plant and animal communities have been destroyed. 6. REASON FOR APPLICATION The City of Miami Beach has the opportunity to acquire the property described in this application to expand the adjacent City owned South Pointe Park. This property, referred to locally as the Alaska Parcel, is currently owned by East Coastline Development LTD., a development company. Under the terms of a settlement agreement the City has the right to purchase the land at the stipulated price of $7,200,000. The City of Miami Beach recognizes that if this parcel which is currently zoned MR (Marine Recreational) and has a limited development potential of less than 40,000 square feet of marine related development, th.e developer could initiate an effort to up zone this parcel through the City, which would require a referendum, or by court action. If successful, the upzoning may result in one of the following classifications: R-PS4 which has a floor area ratio (F.A.R.) of2.0 and a height limit of 80 feet, C-PS3 which has an (F.A.R.) of2.0 and a height limit of 80 feet, or C-PS4 which has an (F.A.R.) of2.5 and a height limit of 150 feet. Any of these zoning categories would result in development that would negatively impact the adjacent South Pointe Park. Even though this land is only 3.4 acres in size, the purchase of the property would resolve an expansion of the current 17 acre South Pointe Park to a recreation facility in excess of 20 acres. If acquired and assembled with South Pointe Park, the management of this property would be provided by the City of Miami Beach Department of Recreation, Culture and Parks. This acquisition will assure that the southern tip of the island of Miami Beach would be held by the public for recreational purposes. The future development of the property would provide water-front park land from the Atlantic Ocean through Government Cut to Biscayne Bay. - 2 7. ADDITIONAL INFORMA nON A. DISTURBANCES . The natural vegetation in the South Pointe area of Miami Beach has long been destroyed. The size and shape of the original barrier island has been changed by dredging and enlarging the island through the years. In years past, this property has been commercial and at one time there was a service station on the property. There is a seawall to protect the shore line of the property. However, through time this wall has deteriorated to expose dangerous supports which protrude from the shoreline. At some point, this land came under the control of the federal government. In 1979 through the surplus land process, the federal government disbursed this property to an Alaskan Indian Tribe and at the same time titled the area known as South Pointe Park to the City of Miami Beach, along with a small triangular property which is north of the Alaska Parcel, commonly known as the Federal Triangle. B. VULNERABILITY The property to the northeast of this site and the property to the southeast are both zoned for recreation and open space. The subject property is zoned MR for Marine Recreational which will permit marinas, boat docks, piers, etc. for noncommercial or commercial vessels and related upland structures, aquarium, restaurants, and commercial uses. However, the property immediately to the northeast is zoned C-PS3 which is Intensive Mixed Use Commercial and is probably the zoning which would be sought for this parcel of land. This zoning permits single-family, townhome, apartment, apartment/hotel, hotel, and commercial. The permitted 2.5 floor area ratio of the C-PS3 zoning would permit development up to 80 feet. 8. DISCLOSURE OF INTEREST (a) Do you own the candidate property or have an ownership interest in the property? The City of Miami Beach does not own the property and the property is currently owned by East Coastline Development LTD. (b) Do you represent the owner? No. The City has a purchase agreement to acquire the property. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. BACKGROUND: The Miami-Dade County Commission developed the Environmentally Endangered Lands (EEL) Program to protect environmentally sensitive habitat within the county. Applications are made to the Miami-Dade County Department of Environmental Resources Management (DERM) which reviews the applications and makes recommendations to the Land Acquisition Selection Committee. This committee reviews applications and makes recommendations for the properties for the County Commission to acquire. The Board of County Commissioners is scheduled to act on the recommendations of the selection committee at the meeting on September 9, 1999. Another recommendation of the selection committee is whether the county provides 50% or 100% of the appraised value of the land for the purchase. All awards are based on the appraised value of the subject property. In most cases, the County provides funding for only 50% of the appraised value. The acquisition of the property on Government Cut and Biscayne Bay, generally called the Alaska Parcel, appears to be eligible for funding under this program. AGENDA ITEM Q,L L-~-g9 DATE Historically, the County has acquired and held title to all environmentally sensitive land purchased with EEL funds. Also, because of problems managing small parcels of land, the County requests that all parcels nominated for acquisition be five acres or larger. The City of Miami Beach is requesting that the county provide full or partial funding to purchase the 3.4 acre parcel of land which the City would own and manage. The City would assure to the county that the property would be used to enlarge the area of South Pointe Park and the acquired land would be managed as part of the park. This land would increase the size of South Pointe Park from 17 acres to approximately 20.4 acres. The County made applications for the Spring 1999 filing period available on January 4, 1999 with the deadline for submittal of February 1, 1999. To meet this deadline, the City proceeded to prepare and submit an application to DERM for consideration. There was insufficient time to prepare a resolution beforehand to request City Commission approval prior to the submittal of the application. A copy of the grant application is attached. See Exhibit 1. With the adoption of this resolution, the City Commission and Mayor are retroactively authorizing the City Manager, or his designee, to submit an application; prepare and submit any back-up or supporting documents, as may be needed, and receive acquisition funds as granted for the purchase of the property. ANAL YSIS The City Commission has instructed the City Administration to seek funds to purchase the Alaska Parcel of land on Government Cut. Since the EEL Program is a possible funding opportunity, an application was filed to meet the February 1, 1999, deadline. If the City of Miami Beach were to receive an award of grant funds from the EEL Program, the City would be required to use the funds to defray the acquisition costs of the Alaska Property. If the City receives a grant from this program, the exact amount of the grant will be between 50% and 100% of the appraised value of the property at the time of acquisition. The last appraisal of the property as of January 1, 1995, was $4,443,000 for as-is Marine Recreational (MR), and $6,665,000 for CPS-4 (Commercial Performance Standards District). The property is currently zoned as Marine Recreational (MR). Application of this grant will enhance the City's chances of acquiring the subject parcel and benefit the community with the added value of maintaining the Alaska Parcel open to the public. Even though the subject parcel is only 3.4 acres in size, the purchase of the property would result in an expansion of the current 17 acres that is South Pointe Park to a recreation facility in excess of 20 acres. If acquired and assembled with South Pointe Park, the management of this property would be provided by the City of Miami Beach Department of Recreation, Culture and Parks. This acquisition will assure that the southern tip of the island of Miami Beach would be held by the public for recreational purposes. The future development of the property would provide water-front park space from the Atlantic Ocean through Government Cut to Biscayne Bay.
