93-2873 Ordinance ORDINANCE NO. 93-2873 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTIONS 45-4(A), 45.4(C), AND 45- 4(D) OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA; AMENDING THE SCHEDULE OF RATES FOR WATER SUPPLY SERVICE TO NON-MUNICIPAL CONSUMERS OF WATER AS FOLLOWS: METER THE RATES FOR WATER SUPPLY SERVICE FROM JUNE 1 THROUGH NOVEMBER 30, DECREASING FROM $1.32 PER THOUSAND GALLONS TO $1.22 PER THOUSAND GALLONS, AND INCREASING SAME FROM DECEMBER 1 THROUGH MAY 31, FROM $1.32 PER THOUSAND GALLONS TO $1.37 PER THOUSAND GALLONS; AND INCREASING THE MINIMUM MONTHLY SERVICE CHARGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 45-4(a) of the Code of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "(a) The meter rate to non-municipal consumer for water supply service in the territory shall be $1.32 per thousand gallons decrease from $1.32 per thousand gallons to $1.22 per thousand gallons from June 1 through November 30. and increase from $1.32 per thousand gallons to $1.37 per thousand gallons from December 1 through May 31." SECTION 2: That Section 45-4(c) of the Code of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "(c) The water rate of $1.32 per 1,000 gallons shall decrease from $1.32 per thousand gallons to $1.22 per thousand gallons from June 1 through November 30. and increase from $1.32 per thousand gallons to $1.37 per thousand gallons from December 1 through May 31 for non-municipal consumers of water as set forth in Section 1 of this Ordinance is to be applied to all water billings based on meter readings taken on or after Octobcr 1, 1991 October 3. 1993." SECTION 3: That Section 45-4(d) of the Code of the City of Miami Beach, Florida. be and the same is hereby amended to read as follows: "( d) Every water supply service shall have a monthly minimum service charge on each service installed, varying with and based upon the size of the service pipe required and installed in accordance with the rules of the Public Works Department. SECTION 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 5: SEVERABILITY: If any section, sub-section, sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission approve an ordinance on second reading amending Section 45-4(a), 45-4(c), and 45-4(d) to change the schedule of rates for water supply service to non-municipal consumers of water including provisions for a wet season rate (June 1 through November 30) and a dry season rate (December 1 through May 31) to promote conservation of water as follows: June 1 through November 30 - from One Dollar and Thirty-Two Cents ($1.32) per thousand gallons to One Dollar and Twenty-Two Cents ($1.22) per thousand gallons. December 1 through May 31 - from One Dollar and Thirty-Two Cents ($1.32) per thousand gallons to One Dollar and Thirty- Seven Cents ($1.37) per thousand gallons; and changing the minimum monthly service charge; providing for severability: providing for an effective date; repealing all ordinances in conflict herewith, effective October 3, 1993. BACKGROUND The first reading of the ordinance took place on September 8, 1993. On June 30, 1993, the City of Miami Beach was notified by Miami-Dade Water and Sewer Authority Department that the Authority was implementing a uniform wholesale water rate effective October I, 1993, which for purposes of water conservation would provide a wet season rate (June 1 through November 30) and a dry season rate (December 1 through May 31). During the wet season the rate will decrease from $1.32 per thousand gallons to $1.22 per thousand gallons, similarly during the dry season the monthly rate charged to City 65 DATE R-3-(~ 9 ~~ - d :J - -=) AGENDA ITEM Commission Memorandum Page 2 September 22, 1993 customers will increase from $1.32 per thousand gallons to $1.37 per thousand gallons. A typical customer's bill would be reduced from $ 16.44 to $ 15.00 during the wet season and increase to $16.80 in the dry season resulting in an average annual decrease of $6.48. This savings could be increased by conserving water during the dry season. On estimated total revenues of $ to, 0 13,605, this action will reduce revenues by approximately $63,000 per year, off-setting a projected surplus to the Water Enterprise Fund for F.Y. 1993/94. CONCLUSION In keeping with the objective of conservation of water it is recommended that the City of Miami Beach adopt the proposed ordinance creating a twenty-five percent conservation surcharge during the dry months and a similar reduction during the wet season of the year. This ordinance parallels the Miami-Dade Water and Sewer Authority Department wholesale rate to municipal users and results in an overall annual decrease to the average user.
