99-23062 RESO RESOLUTION No. 99-23062 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE SECOND AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1998/99, IN THE AMOUNT OF $1,215,797, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS. WHEREAS, Section 932.705, Florida Statutes, addresses the purpose and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. (SECOND AMENDMENT FY98/99) ADMINISTRATION RECOMMENDATION Adopt the Resolution BACKGROUND Florida Statute 932.705 provides for expenditures of forfeiture funds for law enforcement purposes. The Chief of Police of the City of Miami Beach has reviewed and identified the need for the appropriation and the expenditures of forfeiture funds and confirmed compliance with Section 932.705, Florida State Statutes. ANALYSIS The Administration Amendment to the Confiscation Trust funds to be used to requests authorization to adopt the Second operating budget for the FY 98/99 Police Fund in the amount of $1,215,797 from State provide for the expenditures listed in Exhibit "A" . In accordance with Florida State Statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has complied with all statutory procedures involved in the transaction of these funds.
