A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF -
MIAMI BEACH, FLORIDA, SUPPORTING CONDOMINIUM WORKERS'
LEGALLY PROTECTED RIGHT TO FORM, JOIN, OR ASSIST LABOR
ORGANIZATIONS WITHOUT FEAR OF REPRISALS, DISCRIMINATION,
COERCION, OR INTERFERENCE BY THEIR EMPLOYERS.
WHEREAS, Sec. 7. [§ 157.] of the National Labor Relations Act [Title 29, Chapter 7,
Subchapter II, United States Code], states that "Employees shall have the right to self-
organization, to form, join, or assist labor organizations, to bargain collectively through
representatives of their own choosing, and to engage in other concerted activities for the
purpose of collective bargaining or other mutual 'aid or protection"; and
WHEREAS, Sec. 8. [§ 158.] (a) of the NLRA states that, "It shall be an unfair labor practice
for an employer--
(1) to interfere with, restrain, or coerce employees in the exemise of the rights
guaranteed in section 7 [section 157 of this title];
(2) to dominate or interfere with the formation or administration of any labor
organization or contribute financial or other support to it:
(3) by discrimination in regard to hire or tenure of employment or any term or condition
of employment to encourage or discourage membership in any labor organization:
(4) to discharge or otherwise discriminate against an employee because he has filed
charges or given testimony under this Act [subchapter]"
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby support the right of condominium and other workers in Miami Beach to

OF MIAMI BEACH, FLORIDA SUPPORTING CONDOMINIUM WORKERS'
LEGALLY PROTECTED RIGHT TO FORM, JOIN, OR ASSIST LABOR
ORGANIZATIONS WITHOUT FEAR OF REPRISALS, DISCRIMINATION,
COERCION, OR INTERFERENCE BY THEIR EMPLOYERS.
ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
At the November 3, 2004, Neighborhoods/Community Affairs Committee meeting, there
was a discussion regarding a resolution supporting condominium worker's rights to form,
join or assist labor organizations without interference by their employees. The Committee
Members heard testimony from condominium workers that were unfairly terminated or
treated. The Committee members unanimously approved a motion to support the right of
condominium workers in Miami Beach to exercise their legally protected right to form, join,
or assist labor organizations without fear of reprisals, discrimination, coercion, or
interference by their employers.
