2004-25759 Reso RESOLUTION NO. 2004-25759 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FOLLOWING A DULY NOTICED PUBLIC HEARING, ACCEPTING THE RECOMMENDATION OF THE HISTORIC PRESERVATION BOARD AND GRANTING A CERTIFICATE OF APPROPRIATENESS FOR THE DEMOLITION OF CERTAIN EXISTING NON-CONTRIBUTING ACTIVITY BUILDINGS AND STRUCTURES INCLUDING, BUT NOT LIMITED TO, RESTROOMS AND ACCESS RAMP, IN WASHINGTON PARK, LOCATED AT 201 WASHINGTON AVENUE. WHEREAS, certain buildings and structures located within Washington Park, located at 201 Washington Avenue, including, but not limited to, restrooms and access ramps, have deteriorated to the point that repairs or renovations are no longer economically feasible; and WHEREAS, following discussions on the condition of the existing buildings and structures and the future use of the Park, the Administration recommended the application for a Certificate of Appropriateness for the demolition of the buildings and structures; and WHEREAS, the procedures for granting and denying a request for a Certificate of Appropriateness for demolition of a building in a historic district require that the Historic Preservation Board hold a public hearing and transmit a recommendation to the City Commission; it is then appropriate that the City Commission then hold a hearing to consider the request; and WHEREAS, on October 12, 2004, the Historic Preservation Board (HPB) discussed the Planning Department File No. HPB-2440 and determined the aforestated buildings and structures within Washington Park to be non-contributing; the Board, in its advisory capacity, voted unanimously to recommend to the City Commission the demolition of the subject buildings and structures; and WHEREAS, on December 8, 2004 the City Commission held a duly noticed public hearing to consider the aforestated request. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that, following a duly noticed public hearing, the Mayor and City Commission hereby accept the recommendation of the Historic Preservation Board and grant a Certificate of Appropriateness for the demolition of existing non-contributing buildings and structures including, but not limited to, restrooms and access ramp, in Washington Park, located at 201 Washington Avenue. Following discussions on the conditions of the structures and the future use of the property, the Administration recommended the application for a Certificate of Appropriateness for the demolition of the non-contributing buildings and structures within the Park. Pursuant to the City Code, Certificates of Appropriateness for such sites are granted or denied in accordance with the procedures set forth within the Ordinance. In following the procedures required for granting and denying a request for a Certificate of Appropriateness for demolition of a building in a historic district require that the Historic Preservation Board hold a public hearing and transmit a recommendation to the City Commission, and it is appropriate that the City Commission then hold a hearing and vote on the request. On September 14, 2004, the Historic Preservation Board (HPB) discussed the Planning Department File No. HPB 2440 and determined the structures to be non-contributing and resolved to unanimously recommend to the City Commission, in their advisory capacity, the demolition of the subject structures. The Administration recommends that the Mayor and City Commission accept the recommendations of the Historic Preservation Board and approve the Resolution granting a Certificate of Appropriateness for the demolition of the non-contributing buildings and structures in Washington Park.
